I, SIMON COVENEY, Minister for Housing, Planning, Community and Local Government, in exercise of the powers conferred on me by sections 4 and 43 of the Housing (Miscellaneous) Provisions Act 2014 (No. 21 of 2014) (as adapted by the Environment, Community and Local Government (Alteration of Name of Department and Title of Minister) Order 2016 ( S.I. No. 394 of 2016 )) and with the consent of the Minister for Public Expenditure and Reform, hereby make the following regulations: Citation 1. These Regulations may be cited as the Housing Assistance Payment (Amendment) (No.4) Regulations 2016. Commencement 2. These Regulations come into operation on 1 December 2016. Definition 3. In these Regulations– “No. 2 Regulations of 2016” means the Housing Assistance Payment (Amendment)(No. 2) Regulations 2016 ( S.I. No. 338 of 2016 ); “Principal Regulations” means the Housing Assistance Payment Regulations 2014 ( S.I. No. 407 of 2014 ). Maximum rent limits 4.

(1)Regulation 10 (inserted by the Housing Assistance Payment (Amendment) Regulations 2014 ( S.I. No. 576 of 2014 )) of the Principal Regulations is amended— (a) in paragraph
(3)(inserted by the Housing Assistance Payment (Amendment) (No. 3) Regulations 2016 ( S.I. No. 354 of 2016 )) by substituting the following for subparagraph (
  1. b)(inserted by the No. 2 Regulations of 2016): “(
  2. b)The housing authorities for the purposes of subparagraph (
  3. a)are— Carlow County Council, Cavan County Council, Clare County Council, Cork City Council, Cork County Council, Donegal County Council, Galway City Council, Galway County Council, Kerry County Council, Kildare County Council, Kilkenny County Council, Laois County Council, Leitrim County Council, Limerick City and County Council, Longford County Council, Louth County Council, Mayo County Council, Meath County Council, Monaghan County Council, Offaly County Council, Roscommon County Council, Sligo County Council, South Dublin County Council, Tipperary County Council, Waterford City and County Council, Westmeath County Council, Wexford County Council, and Wicklow County Council.”, and (

EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) These Regulations in effect amend the Housing Assistance Payment Regulations 2014 ( S.I. No. 407 of 2014 ) to prescribe the maximum rent limits that will apply for the purposes of the Housing Assistance Payment scheme in the administrative area of Cavan County Council, Kerry County Council, Laois County Council, Leitrim County Council, Longford County Council, Roscommon County Council, Westmeath County Council, Wexford County Council and Wicklow County Council (from 1 December 2016). The Regulations also provide a revised list of the local authorities the effect of which is that the maximum rent limits set out in the Table may be exceeded by not more than 20% in the administrative areas of Carlow County Council, Cavan County Council, Clare County Council, Cork City Council, Cork County Council, Donegal County Council, Galway City Council, Galway County Council, Kerry County Council, Kildare County Council, Kilkenny County Council, Laois County Council, Leitrim County Council, Limerick City and County Council, Longford County Council, Louth County Council, Mayo County Council, Meath County Council, Monaghan County Council, Offaly County Council, Roscommon County Council, Sligo County Council, South Dublin County Council, Tipperary County Council, Waterford City and County Council, Westmeath County Council, Wexford County Council and Wicklow County Council, where this is necessary to source suitable accommodation for a household that is qualified for social housing support.
