I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2016/11 of 5 January 20161 and Commission Implementing Directive (EU) 2016/317 of 3 March 20162 , hereby make the following regulations: 1. These Regulations may be cited as the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2016. 2. The European Communities (Seed of Oil Plants and Fibre Plants) Regulations 2003 ( S.I. No. 280 of 2003 ) are amended by substituting in— (
- a)Regulation 2
(1)for the definition of “EC Directive” (as amended by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2005 ( S.I. No. 917 of 2005 )) the following: “‘Directive’ means Council Directive 2002/57/EC of 13 June 20023 (as amended by Council Directive 2002/68/EC of 19 July 20024 , Commission Directive 2003/45/EC of 28 May 20035 , Council Directive 2003/61/EC of 18 June 20036 , Council Directive 2004/117/EC of 22 December 20047 , Commission Directive 2009/74/EC of 26 June 20098 , Commission Implementing Directive (EU) 2016/11 of 5 January 2016 and Commission Implementing Directive (EU) 2016/317 of 3 March 2016) subject to Commission Regulation (EC) No 217/2006 of 8 February 20069 as it relates to oil and fibre plants;”, (b) Regulation 6
(1)(as amended by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2005) “Directive” for “EC Directive”, and (c) Regulation 21 (inserted by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2005) “Directive” for “EC Directive” in each place that it occurs. EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation.) These Regulations amend Council Directive 2002/57/EC on the marketing of seed of oil and fibre plants by adjusting the minimum varietal purity of the seed.
