I, CATHERINE BYRNE, Minister of State at the Department of Health, in exercise of the powers conferred on me by sections 2 and 13 of the Public Health (Sunbeds) Act 2014 (No. 12 of 2014), and the Health (Delegation of Ministerial Functions) (No. 4) Order 2017 ( S.I. No. 339 of 2017 ), hereby make the following regulations: 1.

(1)These Regulations may be cited as the Public Health (Sunbeds) (Notification) (Amendment) Regulations 2017.
(2)The Principal Regulations and these Regulations may be cited together as the Public Health (Sunbeds) (Notification) Regulations 2015 and
  1. In these Regulations, “Principal Regulations” means the Public Health (Sunbeds) (Notification) Regulations 2015 ( S.I. No. 52 of 2015 ).
  2. Regulation 4 of the Principal Regulations is amended by inserting after paragraph
(2)the following paragraph: “
(3)For the purposes of online notification pursuant to section 13
(2),
(3),
(4)and
(7)of the Act, the form of the notice to be provided by the owner of a sunbed business, a person who intends to carry on a sunbed business or a new owner to whom a sunbed business has been transferred shall be the form of online notice made available by the Executive on www.hse.ie”. These Regulations amend the Public Health (Sunbeds) (Notification) Regulations 2015 ( S.I. No. 52 of 2015 ) to provide for online notice to be given under section 13
(2),
(3)or
(4)of the Public Health (Sunbeds) Act 2014 (No. 12 of 2014). The Regulations take account of the European Union (Provision of Services) Regulations 2010 ( S.I. No. 533 of 2010 ), which provide for the provision of services by electronic means. These Regulations may be cited as the Public Health (Sunbeds) (Notification) (Amendment) Regulations 2017.
