In exercise of the powers conferred on Ervia by section 18 of the Gas Act 1976 (No. 30 of 1976) (as amended), with the approval of the Minister for Housing, Planning and Local Government having consulted with the Minister for Public Expenditure and Reform, Ervia hereby makes the following Scheme. Short title 1. This Scheme may be cited as the Ervia Severance Gratuity Scheme 2017. Commencement 2. The Scheme shall be deemed to have commenced with effect from 29 April 2013. Membership 3. Membership of this Scheme shall not apply to any person other than John Tierney. Severance gratuity 4. In accordance with a contractual commitment personal to John Tierney given by Ervia on 29 April 2013 which reflects a continuation of his entitlement to a severance gratuity which would have applied had he remained a Local Authority Chief Executive and which received the prior approval of the Minister for the Environment, Community and Local Government and the Minister for Public Expenditure and Reform, and in line with entitlements common to both the Local Government (Superannuation) (Consolidation) Scheme 1998 to 2014 and the contractual commitment, John Tierney shall be eligible to receive a severance gratuity of €100,000. The severance gratuity shall be paid on his retirement from Ervia. Present when the common seal ofErviawas affixed to this Scheme andthis Scheme was delivered: TONY KEOHANE, Director.
