Transport Infrastructure Ireland, in exercise of the powers conferred by section 25 of the Transport (Railway Infrastructure) Act 2001 (No. 55 of 2001) as amended, with the approval of the Minister for Transport, Tourism and Sport and the consent of the Minister for Public Expenditure and Reform, hereby make the following Scheme: Citation

  1. Definitions
  2. In this scheme “Principal Scheme” means the Transport (Railway Infrastructure) Act 2001 Railway Procurement Agency Pension and Life Assurance Plan 2003 Superannuation (No. 2) Scheme
  3. Commencement
  4. This scheme shall be deemed to have come into operation on 31st July 2018 which shall be known as the date of commencement. Amendments to the “Principal Scheme”
  5. The Principal Scheme is amended by deleting the current definition of “Normal Retirement Age” in paragraph 3.2 and replacing it with the following: ““Normal Retirement Age” shall have the same meaning as that of “normal retirement age” under section 13
(1)of the Public Service Pensions (Single Scheme and Other Provisions) Act, 2012 and any amendment thereto.” GIVEN under the Seal of Transport Infrastructure Ireland, 20 July

EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation) The Roads Act 2015 provided for the legal dissolution of the Railway Procurement Agency (RPA) and the transfer of its functions and employees to the National Roads Authority (NRA), now known as Transport Infrastructure Ireland (TII). The purpose of these Regulations is to further amend the Transport (Railway Infrastructure) Act 2001 RPA Pension and Life Assurance Plan 2003 Superannuation (No.1) Scheme 2012, to facilitate the alignment of the retirement age of members of the TII pension scheme with the Single Scheme.
