I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving partial effect to Commission Implementing Regulation (EU) 2018/941 of 2 July 20181 , hereby make the following regulations: 1. These Regulations may be cited as the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) (No. 2) Regulations 2018. 2. Regulation 2

(1)of the European Communities (Official Controls on the Import of Food of Non-Animal Origin) Regulations 2010 ( S.I. No. 391 of 2010 ) is amended— (
  1. a)by substituting for the definition of “designated point of entry (DPE)” (as amended by the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) (No. 2) Regulations 2013 ( S.I. No. 178 of 2013 )) the following: “‘designated point of entry (DPE)’ means a particular point of entry designated by the State pursuant to Article 17 of EC Regulation 882/2004, and listed on the website www.fsai.ie for the purposes of importation of a product listed in Annex I to EC Regulation 669/2009; in the case of consignments entering the European Economic Area by sea or by air transport from a third country, which are unloaded for the purposes of being loaded on respectively another vessel or aircraft in the same port or airport for onward travel to another port or airport in one of the territories referred to in Annex I to EC Regulation 882/2004, the designated point of entry shall be the latter port or airport;”, (
  2. b)by substituting for the definition of “EC Regulation 669/2009” (inserted by the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) Regulations 2018 ( S.I. No. 3 of 2018 )) the following: “‘EC Regulation 669/2009’ means Commission Regulation (EC) No. 669/2009 of 24 July 20092 , as amended by Commission Regulation (EU) No. 212/2010 of 12 March 20103 , Commission Implementing Regulation (EU) No. 323/2014 of 28 March 20144 , Commission Implementing Regulation (EU) No. 718/2014 of 27 June 20145 , Commission Implementing Regulation (EU) 2016/1024 of 24 June 20166 and Commission Implementing Regulation (EU) 2018/941 of 2 July 20181;”, and (
  3. c)by substituting for the definition of “EC Regulation 882/2004” the following: “‘EC Regulation 882/2004’ means Commission Regulation (EC) No. 882/2004 of the European Parliament and of the Council of 29 April 20047 as affected by the Corrigendum to Regulation (EC) No. 882/2004 of 28 May 20048 and as amended by Council Regulation (EC) No. 1029/2008 of 20 October 20089 , Regulation (EC) No. 596/2009 of the European Parliament and of the Council of 18 June 200910 , Commission Regulation (EU) No. 208/2011 of 2 March 201111 , Commission Regulation (EU) No. 880/2011 of 2 September 201112 , Commission Regulation (EU) No. 563/2012 of 27 June 201213 , Council Regulation (EU) No. 517/2013 of 13 May 201314 , Regulation (EU) No. 652/2014 of the European Parliament and of the Council of 15 May 201415 , Commission Regulation (EU) 2017/140 of 26 January 201716 , Commission Regulation (EU) 2017/212 of 7 February 201717 , Commission Regulation (EU) 2017/1389 of 26 July 201718 , Commission Regulation (EU) 2017/2460 of 30 October 201719 , Commission Regulation (EU) 2018/192 of 8 February 201820 , Commission Regulation (EU) 2018/455 of 16 March 201821 ;”. 3. The European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) Regulations 2018 are revoked. GIVEN under my Official Seal, 13 August 2018. SIMON HARRIS, Minister for Health. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation). These Regulations give partial effect to Commission Implementing Regulation (EU) 2018/941 of 2 July 2018 amending Regulation (EC) No. 669/2009 as regards the increased level of official controls on imports of certain food of non-animal origin. These Regulations amend the European Communities (Official Controls on the Import of Food of Non-Animal Origin) Regulations 2010 ( S.I. No. 391 of 2010 ) in the manner specified in these Regulations. These Regulations revoke the European Communities (Official Controls on the Import of Food of Non-Animal Origin) (Amendment) Regulations 2018 ( S.I. No. 3 of 2018 ).
