I, EOGHAN MURPHY, Minister for Housing, Planning and Local Government, in exercise of the powers conferred on me by sections 33 and 262 of the Planning and Development Act 2000 (No. 30 of 2000) (as adapted by the Housing, Planning, Community and Local Government (Alteration of Name of Department and Title of Minister) Order ( S.I. No. 358 of 2017 )), hereby make the following regulations: 1.
(1)These Regulations may be cited as the Planning and Development (Fees) Regulations 2018.
(2)These Regulations shall be included in the collective citation the Planning and Development Regulations 2001 to
- Article 168 of the Planning and Development Regulations 2001 ( S.I. No. 600 of 2001 ) is amended, in sub-article
(2), by the insertion of the following paragraph: “(aa) a member of a local authority acting in his or her capacity as such member,”. GIVEN under my Official Seal 16 November 2018. EOGHAN MURPHY, Minister for Housing, Planning and Local Government. EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation). These Regulations amend Article 168 of the Planning and Development Regulations 2001 ( S.I. No. 600 of 2001 ) to provide that the fee for making a submission or observation to a planning authority in respect of a planning application shall not be payable by a member of a local authority acting in his or her capacity as such member.
