I, JOHN PAUL PHELAN, Minister of State at the Department of Housing, Planning and Local Government, in exercise of the powers conferred on me by section 20 of the Electoral Act 1992 (No. 23 of 1992 as amended) and the Housing, Planning and Local Government (Delegation of Ministerial Functions) Order 2017 ( S.I. No. 473 of 2017 ), hereby make the following regulations, a draft of which has been laid before each House of the Oireachtas in accordance with section 20

(3)of that Act and a resolution approving of the draft has been passed by each such House.
  1. These Regulations may be cited as the Electoral (Supplement to the Register of Electors) Regulations
  3. Part II of the Second Schedule to the Electoral Act 1992 is to be amended by the insertion of the following after Rule 14A
(1)(b). “(
  1. c)Where the registration authority has put in place an electronic means by which the identity of an individual can be verified as follows; (
  2. a)Name (
  3. b)Personal Public Service Number (as defined in Section 262 of the Social Welfare Consolidation Act 2005 ) (
  4. c)Date of Birth (
  5. d)Address an application to be entered on the Supplement to the Register of Electors may be made by the applicant directly to the registration authority without making the declaration referred to in paragraph (

EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These regulations amend Part II of the Second Schedule to the Electoral Act 1992 in order to remove the need for someone to sign an application to be entered on the Supplement to the Register of Electors in the presence of a member of the Garda Síochána from the applicant’s local Garda station, if they wish to register online instead in a local authority/registration authority that has put in place an electronic means to facilitate this, providing they can verify their identity online according to the criteria stated.
