WHEREAS, by the Agreement between the European Union and the Republic of Iceland and the Kingdom of Norway on the surrender procedure between the Member States of the European Union and Iceland and Norway, done at Vienna on 28 June 20061 (referred to subsequently in these recitals as “the Agreement”), the European Union entered into an agreement with third countries (being Iceland and Norway) for the surrender of persons wanted for prosecution or punishment; AND WHEREAS the Agreement, pursuant to Article 38

(4)thereof, entered into force on 1 November 2019; NOW I, SIMON COVENEY, Minister for Foreign Affairs and Trade, in exercise of the powers conferred on me by section 2
(2)of the European Arrest Warrant (Application to Third Countries and Amendment) and Extradition (Amendment) Act 2012 (No. 30 of 2012), after consultation with the Minister for Justice and Equality, hereby order as follows:
  1. This Order may be cited as the European Arrest Warrant (Application to Third Countries) (Iceland and Norway) Order
  2. The provisions of the European Arrest Warrant Act 2003 (No. 45 of 2003) that would, apart from section 2 of the European Arrest Warrant (Application to Third Countries and Amendment) and Extradition (Amendment) Act 2012 (No. 30 of 2012) and this Order, apply only in relation to Member States shall apply in relation to Iceland and Norway.
