I, STEPHEN DONNELLY, Minister for Health in exercise of the powers conferred on me by section 1
(2)of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020), hereby order as follows:
- This Order may be cited as the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (Commencement of Certain Provisions) (No. 2) Order
- The 1st day of January 2021 is appointed as the day on which the following provisions of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020) shall come into operation: (a) section 2
(2); (
- b)section 24; (
- c)section 27; (
- d)section 35; (
- e)paragraph (
- a)of section 37; (
- f)sections 39 and 40; (
- g)section 81(a)(
- i)insofar as that section relates to the insertion of paragraph (
- ce)in section 11
(2)of the Act of 2007; (
- h)sections 90, 91 and 92; (
- i)paragraph (
- a)of section 93. GIVEN under my Official Seal, 17 December, 2020. STEPHEN DONNELLY, Minister for Health. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) This Order appoints 1st January 2021 as the day on which sections 2
(2), 24, 27, 35, 37(a), 39 and 40 of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 come into operation. These sections amend the role of the registration boards in relation to disciplinary sanctions under the Health and Social Care Professionals Act 2005 . The 1st January 2021 is also the day on which section 81(a)(i) (insofar as that section relates to the insertion of paragraph (ce) in section 11
(2)of the Medical Practitioners Act 2007 ) and sections 90, 91, 92 and 93(a) of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 come into operation. These sections amend the Medical Practitioners Act 2007 in relation to the circumstances in which a person may lawfully practise medicine.
