I, SIMON HARRIS, Minister for Further and Higher Education, Research, Innovation and Science, in exercise of the powers conferred on me by section 16 of the Student Support Act 2011 (No. 4 of 2011) and the Further and Higher Education, Research, Innovation and Science (Transfer of Departmental Administration and Ministerial Functions) Order 2020 ( S.I. No. 451 of 2020 ), and with the consent of the Minister for Public Expenditure and Reform, hereby make the following scheme:— Citation and commencement 1.

(1)This Scheme may be cited as the Student Grant (Amendment) Scheme 2021.
(2)This Scheme shall be deemed to have come into operation at 11 p.m. on 31 December

  2. In this Scheme “Principal Scheme” means the Student Grant Scheme 2020 ( S.I. No. 76 of 2020 ). Amendment of Principal Scheme consequent on prior amendments by Statutory Instrument No. 570 of 2020
  3. The articles inserted in the Principal Scheme by articles 5, 6 and 7 of the Student Grant (Amendment) Scheme 2020 ( S.I. No. 570 of 2020 ), and expressed, by the latter Scheme, to be numbered “article 13”, “article 32” and “article 40”, as the case may be, are renumbered as article 13A, article 32A and article 40A respectively. (1)of the Principal Scheme is amended – (a) in the definition of “EU rate of fee”, by the insertion of “, including a person who is a person of a class that stands prescribed under section 14A
(1)of the Act for the purposes of section 14
(1)(
  1. aa)of the Act” after “student”, and (
  2. b)by the insertion of the following definition after the definition of “relevant persons”: “ ‘relevant specified jurisdiction’ means the United Kingdom as respects the class of person standing prescribed by virtue of paragraph
(3)(inserted by Regulation 5 of the Student Support (Amendment) Regulations 2021) of Regulation 5 of the Regulations;”. Amendment of article 14

(2)of the Principal Scheme is amended by the insertion of “, relevant specified jurisdiction” after “EEA Agreement”. Amendment of article 19

(5)of the Principal Scheme is amended – (
  1. a)by the substitution of “, any other Member State or a relevant specified jurisdiction” for “or any other Member State”, and (
  2. b)by the substitution of “, another Member State or a relevant specified jurisdiction” for “or another Member State”. Amendment of article 32

  1. c)of the Principal Scheme is amended – (
  2. a)by the substitution of “, any other Member State or a relevant specified jurisdiction” for “or any other Member State”, and (

(3)of Principal Scheme 8. Article 33
(3)of the Principal Scheme is amended by the substitution of “, the Swiss Confederation or a relevant specified jurisdiction” for “or ggg Switzerland”. Amendment of Schedule 1 to Principal Scheme 9. Table G in Schedule 1 to the Principal Scheme is amended – (
  1. a)by the substitution of “, any other Member State or a relevant specified jurisdiction” for “or any other Member State”, and (
  2. b)by the substitution of “, another Member State or a relevant specified jurisdiction” for “or in another Member State”. Amendment of Schedule 2 to Principal Scheme 10. Schedule 2 to the Principal Scheme is amended by the substitution of “from a Member State or a relevant specified jurisdiction” for “from a Member State”.
