I, SIMON HARRIS, Minister for Further and Higher Education, Research, Innovation and Science, in exercise of the powers conferred on me by sections 4 , 7 , 8 and 14A
(1)of the Student Support Act 2011 (No. 4 of 2011) and the Further and Higher Education, Research, Innovation and Science (Transfer of Departmental Administration and Ministerial Functions) Order 2020 ( S.I. No. 451 of 2020 ), and with the consent of the Minister for Public Expenditure and Reform, hereby make the following regulations: Citation and commencement 1.
(1)These Regulations may be cited as the Student Support (Amendment) Regulations 2021.
(2)These Regulations shall be deemed to have come into operation at 11 p.m. on 31 December
- Definition
- In these Regulations “Principal Regulations” means the Student Support Regulations 2020 ( S.I. No. 77 of 2020 ). Amendment of Regulation 2
(1)of the Principal Regulations 3. Regulation 2
(1)of the Principal Regulations is amended by the insertion of the following definition after the definition of “prior scheme”: “ ‘relevant specified jurisdiction’ means the United Kingdom as respects the class of person standing prescribed by virtue of paragraph
(3)(inserted by Regulation 5 of the Student Support (Amendment) Regulations 2021) of Regulation 5;”. Amendment of Regulation 4(
- c)of the Principal Regulations 4. Regulation 4(
- c)of the Principal Regulations is amended – (
- a)in subparagraph (ii), by the substitution of “Member State, other than the State, or in a relevant specified jurisdiction that comes within the terms of section 7
(1)(
- e)or (
- f)of the Act” for “Member State other than the State that comes within the terms of section 7
(1)(
- e)of the Act”, and (
- b)in subparagraph (iii), by the insertion of “or the relevant specified jurisdiction, as the case may be” after “Member State” in each place where it occurs. Amendment of Regulation 5 of the Principal Regulations 5. Regulation 5 of the Principal Regulations is amended by the insertion of the following paragraph after paragraph
(2): “
(3)The following class of person is prescribed for the purposes of paragraph (aa) of section 14
(1)of the Act, namely a person who is a national of the United Kingdom”. The Minister for Public Expenditure and Reform consents to the making of the foregoing Regulations. GIVEN under the Official Seal of the Minister for Public Expenditure and Reform, 4 January,
