Short title and collective citation Acts Referred to Garda Síochána Act 2005 (No. 20) Garda Síochána Acts 2005 to 2015 Number 10 of 2022 GARDA SÍOCHÁNA (AMENDMENT) ACT 2022 An Act to amend section 8 of the Garda Síochána Act 2005 ; and to provide for related matters. [17th June, 2022] Be it enacted by the Oireachtas as follows: Definition 1. In this Act, “Act of 2005” means the Garda Síochána Act 2005 . Amendment of Act of 2005 2.
(1)Section 8 of the Act of 2005 is amended— (a) in subsection
(2), by the substitution of “institute or conduct” for “institute and conduct”, and (b) by the insertion of the following subsection after subsection
(2): “(2A) Where a prosecution is instituted by a member of the Garda Síochána pursuant to subsection
(2), the prosecution may be conducted by that member or any other such member.”.
(2)The amendments to section 8 of the Act of 2005 effected by subsection
(1)shall apply in respect of prosecutions instituted pursuant to subsection
(2)of that section irrespective of whether such prosecutions were instituted before or after the coming into operation of this section. Short title and collective citation 3.
(1)This Act may be cited as the Garda Síochána (Amendment) Act 2022.
(2)The Garda Síochána Acts 2005 to 2015 and this Act may be cited together as the Garda Síochána Acts 2005 to 2022.
