I, Eamon Ryan, Minister for the Environment, Climate and Communications in exercise of the powers conferred on me by section 6 , section 85

(4)and section 89 of the Environmental Protection Agency Act 1992 (No. 7 of 1992) and for the purpose of giving further effect to Directive 2010/75/EU of the European Parliament and of the Council of 24 November 20101 and further effect to Directive No. 2011/92/EU of the European Parliament and of the Council of 13 December 20112 on the assessment of the effects of certain public and private projects on the environment, amended by Directive 2014/52/EU of the European Parliament and of the Council of 16 April 20143 hereby make the following regulations:
  1. These Regulations may be cited as the Environmental Protection Agency (Industrial Emissions) (Licensing) (Amendment) Regulations
  3. These Regulations shall come into operation on the 25th day of August
  5. In these Regulations, “Principal Regulations” means the Environmental Protection Agency (Industrial Emissions) (Licensing) Regulations 2013 ( S.I. No. 137 of 2013 ).
  6. Regulation 2
(1)of the Principal Regulations is amended, in paragraph (b) of the definition of “application for permission”, by the insertion of “181(2A),” after “177AE”. 5. Regulation 9
(2)of the Principal Regulations is amended - (
  1. a)in paragraph (d)(ii), by the insertion of “or, was exempted in accordance with that Act from being so required,” after “Act of 2000”, and (
  2. b)in paragraph (
  3. e)- (
  4. i)in the chapeau, by the insertion of “or, in the case where an order under section 181
(2)(
  1. a)of the Act of 2000 is made in respect of development comprising or for the purposes of the industrial emissions directive activity to which the application for the licence relates, a copy of the order made,” after “a copy of the grant of permission”, and (
  2. ii)in subparagraph (
