I, Damien English, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by sections 14 , 29 and 30 (as amended by sections 17 , 29 and 30 of the Employment Permits (Amendment) Act 2014 (No. 26 of 2014)) of the Employment Permits Act 2006 (No. 16 of 2006) (as adapted by the Business, Enterprise and Innovation (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 519 of 2020 )) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) Order 2020 ( S.I. No. 579 of 2020 ), hereby make the following regulations: Citation 1.

(1)These Regulations may be cited as the Employment Permits (Amendment) (No. 3) Regulations 2022.
(2)The collection citation “the Employment Permits Regulations 2017 to 2022” includes these Regulations. Definitions
  1. In these Regulations- “Principal Regulations” means the Employment Permits Regulations 2017 ( S.I No. 95 of 2017 ); “Regulations of 2022” means the Employment Permits (Amendment) (No. 2) Regulations 2022 ( S.I. No. 412 of 2022 ). Amendment of Regulation 3 of Principal Regulations
  2. Regulation 3 (as amended by Regulation 4 of the Employment Permits (Amendment) Regulations 2018 ( S.I. No. 70 of 2018 )) of the Principal Regulations is amended, in the definition of “carer in a private home” by substituting “carer of a person with exceptional medical needs’” for “carer in a private home”. Amendment of Regulation 8
(2)of Principal Regulations 4. Regulation 8
(2)(as amended by Regulation 3 of the Regulations of 2022) of the Principal Regulations is amended- (
  1. a)in subparagraph (
  2. f)by substituting “carer of a person with exceptional medical needs” for “carer in a private home”, and (
  3. b)in subparagraph (o), by substituting “employment;” for “employment; and”, (
  4. c)in subparagraph (p), by substituting “employment; and” for “employment.”, and (
  5. d)by inserting after subparagraph (
  6. p)the following subparagraph: “(
  7. q)in the case of an application for employment as a bus or coach driver, a clear and complete copy of- (I) the category D, DE, D1 or D1E driving licence, or (II) the equivalent category to the category D, DE, D1 or D1E driving licence identified through a mutual recognition agreement between the Road Safety Authority and the appropriate regulatory authority in another jurisdiction, of the foreign national in respect of whom the application is made.”. Amendment of Regulation 9
(2)of Principal Regulations 5. Regulation 9
(2)(as amended by Regulation 4 of the Employment Permits (Amendment) Regulations 2022 ( S.I. No. 273 of 2022 )) of the Principal Regulations is amended- (
  1. a)in subparagraph (l), by substituting “permit holder;” for “permit holder; and”, (
  2. b)in subparagraph (m), by substituting “(QQI) qualification; and” for “(QQI) qualification.”, and (
  3. c)by inserting after subparagraph (
  4. m)the following subparagraph: “(
  5. n)in the case of an application for employment as a care worker or home carer, where the permit holder in respect of whom the application is made has been in employment in the State on an employment permit as a care worker or home carer for two years or more, a copy of the permit holder’s relevant Level 5 Quality and Qualifications Ireland (QQI) qualification in health and social care, or an equivalent qualification .”. Amendment of Regulation 29
(1)of Principal Regulations 6. Regulation 29
(1)(as amended by Regulation 4 of the Employment Permits (Amendment) (No. 2) Regulations 2021 ( S.I. No. 559 of 2021 )) of the Principal Regulations is amended by substituting for subparagraphs (
  1. f)and (
  2. g)the following subparagraphs: “(
  3. f)in the case of employment as a health care assistant, the minimum remuneration is €27,000 and in respect of which the minimum hourly rate of remuneration is €13.31, (
  4. g)in the case of employment as a care worker or home carer, the minimum remuneration is €27,000 and in respect of which the minimum hourly rate of remuneration is €13.31, and (
  5. h)in any other case, the minimum annual remuneration is €30,000 and in respect of which the minimum hourly rate of remuneration is €14.79.”. Amendment of Regulation 30 of Principal Regulations 7. Regulation 30 (as amended by Regulation 4 of the Regulations of 2022) of the Principal Regulations is amended- (
  6. a)in paragraph
(5)(c), by substituting “500” for “100”, and (b) by inserting after paragraph
(6)the following paragraphs: “
(7)The maximum number of General Employment Permits that may be granted in respect of employment as a care worker or home carer is 1,000, and the period during which that maximum number shall be granted is the period up until that maximum number of permits is granted.
(8)The maximum number of General Employment Permits that may be granted in respect of employment of bus and coach drivers with category D, DE, D1 or D1E driving licence, or the equivalent category to the category D, DE, D1 or D1E driving licence identified through a mutual recognition agreement between the Road Safety Authority and the appropriate regulatory authority in another jurisdiction, is 1,500, and the period during which that maximum number shall be granted is the period up until that maximum number of permits is granted.”. Insertion of Regulation 33A into Principal Regulations
  1. The Principal Regulations are amended by inserting after Regulation 33 the following regulation: “Minimum period for which certain General Employment Permits may be granted 33A. The minimum period for which a General Employment Permit may be granted in respect of employment as care worker or home carer is 2 years.”. Amendment of Schedule 4 to Principal Regulations
  2. The Principal Regulations are amended by substituting for Schedule 4 (as amended by Regulation 5 of the Regulations of 2022) the Schedule set out in the Schedule to these Regulations. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These Regulations amend the Employment Permits Regulations 2017 to introduce new quotas of general employment permits, and new application requirements and grant restrictions, for the roles of care workers, home carers and bus and coach drivers, to introduce a further quota for dairy farm assistants, and to change the defined term of “carer in a private home” to “carer of a person with exceptional medical needs”. These Regulations may be cited as the Employment Permits (Amendment) (No. 3) Regulations
