I, HELEN MCENTEE, Minister for Justice, in exercise of the powers conferred on me by section 122
(1)(h) of the Garda Síochána Act 2005 (No. 20 of 2005) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), after consulting with the Garda Commissioner and the Authority and with the approval of the Government, hereby make the following regulations: 1.
(1)These Regulations may be cited as the Garda Síochána (Retirement) Regulations 2023.
(2)These Regulations shall come into operation on 2 September 2023. 2. Notwithstanding anything contained in - (
- a)the Gárda Síochána (Retirement) Regulations 1934 (S. R. & O. No. 146 of 1934), as continued in force by section 128 of the Garda Síochána Act 2005, (
- b)the Gárda Síochána (Retirement) (No. 2) Regulations 1951 ( S.I. No. 335 of 1951 ), as so continued in force, or (
- c)the Garda Síochána Act 2005 (Retirement) Regulations 2018 ( S.I. No. 28 of 2018 ), the member of the Garda Síochána who, immediately before the coming into operation of these regulations, holds the rank of Garda Commissioner shall retire on 1 June 2025.
