I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 116 of the Maritime Area Planning Act 2021 (No. 50 of 2021), after consultation with the Maritime Area Regulatory Authority, hereby make the following regulations: Citation 1. These Regulations may be cited as the Maritime Area Usage (Licence Fees) Regulations 2023. Definition 2. In these Regulations “Act” means Maritime Area Planning Act 2021 (No. 50 of 2021). Specified application fees - licences 3. The fee specified to accompany an application under the Act for— (
- a)a declaration under section 115
(1), is €500, (b) the grant of a licence referred to in section 117
(1), is €1,000, together with a refundable amount of €1,000 in case appropriate assessment is not carried out under section 117
(6)(a), (c) the assignment of a licence under section 124
(2), is €500, (d) the material amendment of a licence under section 125
(1), is €1,000, and (d) the surrender of a licence under section 126
(1), is €500. Exemptions, refunds and waivers 4.
(1)Where appropriate assessment is not required to be carried out as referred to in paragraph (b) of Regulation 3 the refundable amount referred to in that paragraph shall be refunded to the applicant.
(2)The MARA may waive a fee under these Regulations where the applicant is a non-profit entity being a legal person organised for a collective, public or social benefit and does not operate as a business whose aim is to generate a profit for its owners. These Regulations provide for fees to accompany certain applications in relation to licences authorising certain maritime usage in the maritime area of the State.
