I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive (EU) 2023/175 of 26 January 20231 , hereby make the following regulations: 1.

(1)These Regulations may be cited as the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations 2024.
(2)The Principal Regulations, the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations 2011 ( S.I. No. 129 of 2011 ), the Regulations of 2018 and these Regulations may be cited together as the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) Regulations 2010 to
  2. In these Regulations— “Principal Regulations” means the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) Regulations 2010 ( S.I. No. 119 of 2010 ); “Regulations of 2018” means the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations 2018 ( S.I. No. 190 of 2018 ).
  3. Regulation 2
(1)of the Principal Regulations (as last amended by Regulation 3 of the Regulations of 2018) is amended by substituting for the definition of “Directive” the following: “‘Directive’ means Directive 2009/32/EC of the European Parliament and of the Council of 23 April 20092 as amended by Commission Directive 2010/59/EU of 26 August 20103 , Commission Directive (EU) 2016/1855 of 19 October 20164 and Commission Directive (EU) 2023/175 of 26 January 20231 ;”.   1. STEPHEN DONNELLY, Minister for Health. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These Regulations give effect to Commission Directive (EU) 2023/175 of 26 January 2023 amending Directive 2009/32/EC of the European Parliament and of the Council as regards 2-methyloxolane. The Annex to Directive 2009/32/EC lists the extraction solvents for which conditions of use are specified with details of “name”, “conditions of use” and “maximum residue limits in the extracted foodstuff or food ingredient” set out in table format. “2-methyloxolane” is added to that list by Commission Directive (EU) 2023/175 of 26 January 2023 and its “conditions of use” and “maximum residue limits in the extracted foodstuff or food ingredient” are specified. These Regulations amend the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) Regulations 2010 ( S.I. No. 119 of 2010 ) in the manner specified in these Regulations. These Regulations may be cited as the European Communities (Extraction Solvents used in the Production of Foodstuffs and Food Ingredients) (Amendment) Regulations
