section 12 of the EirGrid, Electricity and Turf (Amendment) Act 2022 (No. 17 of 2022)) of the Electricity Regulation Act 1999 (No. 23 of 1999) and the Communications, Energy and Geological Survey of Ireland (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 300 of 2002 ) (as adapted by the Communications, Climate Action and Environment (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 373 of 2020 )), following consultation with the Minister for Housing, Local Government and Heritage (as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 )), and having given a draft of this Order to the persons upon whom the obligation is to be imposed, hereby order as follows: Citation 1. This Order may be cited as the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) (No.2) Order 2024. Definitions 2. In this Order— “Order of 2024” means the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2024 ( S.I. No. 377 of 2024 ); “Principal Order” means the Electricity Regulation Act 1999 (Public Service Obligations) Order 2002 ( S.I. No. 217 of 2002 ). Amendment of Article 2 of Principal Order 3. Article 2 of the Principal Order is amended in paragraph
(1)(
Article 3
(d) of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2021 ( S.I. No. 532 of 2021 )), by the substitution of the following definitions for the definition of “RESS” and “RESS Contracts Notification”: “‘RESS’ means the Renewable Electricity Support Scheme, as referred to in State Aid Decision SA.54683 (2020/N) – Ireland, as modified by State Aid Decision SA. 105135; ‘RESS Contracts Notification’ means the correspondence referred to in paragraph
(1)of the European Commission document entitled ‘C
(2020)4795 final’ dated 20 July 2020 and at paragraph
(1)of the European Commission entitled C
(2023)3963 final dated 12 June 2023 relating to a notification to that Commission (Reference no. SA.54683 (2020/N) – Ireland) pursuant to Article 108
(3)of the Treaty on the Functioning of the European Union as modified by the letter from the Department of the 27 April 2023 and the letter of the Commission of the 13 June 2023 (Reference No SA.105135 – Ireland TCTF Amendment to SA.54683) ;” Amendment of Schedule 3 to Principal Order 4. The Principal Order is
the substitution of the schedule set out in Schedule 1 to this Order for Schedule 3 (
Article 3of the Order of 2024) to the Principal Order.
Amendment of Schedule 4 to Principal Order 5. The Principal Order is
the substitution of the schedule set out in Schedule 2 to this Order for Schedule 4 (
Article 4of the Order of 2024) to the Principal Order.
Amendment of Schedule 5 to Principal Order 6. The Principal Order is
the substitution of the schedule set out in Schedule 3 to this Order for Schedule 5 (
Article 5of the Order of 2024) to the Principal Order.
Amendment of Schedule 6 to Principal Order 7. The Principal Order is
the substitution of the schedule set out in Schedule 4 to this Order for Schedule 6 (
Article 6of the Order of 2024) to the Principal Order.
SCHEDULE 1 Article 3 “Schedule 3 In this Schedule— ‘biomass’ means the biodegradable fraction of products, waste and residues from biological origin from agriculture (including vegetal and animal substances), forestry and related industries including fisheries and aquaculture, as well as the biodegradable fraction of industrial and municipal waste; ‘CHP’ means combined heat and power; ‘hydro project’ means any hydro-powered electricity generating plant with a maximum export capacity of or less than 5 MW which is connected directly to the electricity network and metered independently of any other electricity generating plant; ‘LFG’ means landfill gas; ‘large scale wind project’ means an onshore wind-powered electricity generating plant with a maximum export capacity greater than 5 MW which is connected directly to the electricity network and metered independently of any other electricity generating plant; ‘small scale wind project’ means an onshore wind-powered electricity generating plant with a maximum export capacity of 5 MW or less which is connected directly to the electricity network and metered independently of any other electricity generating plant.
