I, DARRAGH O’BRIEN, Minister for Transport, in exercise of the powers conferred on me by section 41
(1)(as amended by section 11 (c) of the Road Traffic and Roads Act 2023 (No. 16 of 2023)) of the Road Traffic Act 1994 (No. 7 of 1994) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), after consultation with the Minister for Justice, hereby make the following regulations: 1.
(1)These Regulations may be cited as the Road Traffic Act 1994 (Detention of Vehicles) (Amendment) Regulations 2025.
(2)These Regulations come into operation on the 27th day of March 2025. 2. Regulation 6 of the Road Traffic Act 1994 (Detention of Vehicles) Regulations 2011 ( S.I. No. 460 of 2011 ) is amended – (
- a)by the substitution of the following paragraph for paragraph (
- aa)(inserted by regulation 3 of the Road Traffic Act 1994 (Detention of Vehicles) (Amendment) Regulations 2018 ( S.I. No. 537 of 2018 ) – “(
- aa)in the case of a person to whom subparagraph (i), (ii), (iii) or (
- v)(inserted by section 11 (c)(i)(III) of the Road Traffic and Roads Act 2023 (No. 16 of 2023)) of section 41
(1)(
- a)of the Act of 1994 applies, he or she was, at the time when the vehicle was detained, the holder of a driving licence or learner permit licensing him or her to drive the vehicle,”, and (
- b)by inserting the following paragraph after paragraph (e): “(
- f)in the case of a vehicle referred to in section 41
(1)(
- f)(inserted by section 11 (c)(
- ii)of the Road Traffic and Roads Act 2023 ) of the Act of 1994, that at the time it was detained, a test certificate in accordance with Directive 2014/45/EU of the European Parliament and of the Counsel of 3 April 20141 on periodic roadworthiness tests for motor vehicles and their trailers and repealing Directive 2009/40/EC was in force in respect of the vehicle.”.
