I, DARRAGH O’BRIEN, Minister for Transport, in exercise of the powers conferred on me by section 34
(3)(inserted by section 23 of the Road Traffic Act 2016 (No. 21 of 2016)) and section 41 of the Road Traffic Act 2010 (No. 25 of 2010) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), hereby make the following regulations: Citation 1.
(1)These Regulations may be cited as the Road Traffic (Small Public Service Vehicle) (Fixed Charge Offences) Regulations
- Definition
- In this Regulation “Act” means Taxi Regulation Act 2013 (No. 37 of 2013). Declaration of fixed charge offences – small public service vehicles
- An offence under— (a) section 20
(4)(
- b)of the Act, consisting of a contravention of a provision of— (
- i)the Taxi Regulation (Small Public Service Vehicle) Regulations 2015 ( S.I. No. 33 of 2015 ), or (
- ii)the Small Public Service Vehicle (Cashless Payment Facility) Regulations 2022 ( S.I. No. 294 of 2022 ), referred to in Schedule 1, and (
- b)Part 3 of the Act, consisting of a contravention of a provision of the Act referred to in Schedule 2, is declared to be a fixed charge offence for the purpose of paragraph (
- e)of subsection
(2)of section 34 (inserted by section 23 of the Road Traffic Act 2016 (No. 21 of 2016)) of the Road Traffic Act 2010 (No. 25 of 2010). Prescribed fixed charge amounts 4. The amount prescribed for a fixed charge offence referred to in— (a) column
(1)of Schedule 1, is the amount indicated in column
(3)of that Schedule opposite the mention of the fixed charge offence, and (b) column
(1)of Schedule 2, is the amount indicated in column
(3)of that Schedule opposite the mention of the fixed charge offence. Revocation 5. The Road Traffic Acts 1961 to 2014 (Small Public Service Vehicle) (Fixed Charge Offences) Regulations 2014 (S. I. No. 507 of 2014) are revoked. Regulation 4(a) Schedule 1 Fixed Charge Offences Offence under section 20

- b)of the Taxi Regulation Act 2013 consisting of a contravention of a provision of— (
- a)the Taxi Regulation (Small Public Service Vehicle) Regulations 2015 ( S.I. No. 33 of 2015 ) namely— Regulation

These Regulations declare the contraventions of offences under Section 20
(4)(b) and Part 3 of the Taxi Regulation Act 2013 ;the Taxi Regulation (Small Public Service Vehicle) Regulations 2015 ( S.I. No. 33 of 2015 ) and the Small Public Service Vehicle (Cashless Payment Facility) Regulations 2022 ( S.I. No. 294 of 2022 ) relating to the operation of small public service vehicles for which fixed charge notices may be issued by An Garda Síochána and prescribe the amounts in respect of such contraventions.
