DARRAGH O’BRIEN, Minister for Transport. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) The purpose of these Regulations is to specify that Ireland will avail of optional exemptions from certain provisions of the Eurovignette Directive for contracts and tolling arrangements in place prior to the adoption of amendments to the Directive made under Directive (EU) 2022/362 as regards the charging of vehicles for the use of certain infrastructures. Eurovignette is an EU framework for applying toll and user charges. The current Regulations are the European Union (Charging of Vehicles for the Use of Road Infrastructures) Regulations 2024 (SI 601 of 2024). The Directive provides that Member States may choose not to apply certain provisions of Eurovignette where toll contracts were put in place before 24 March 2022. The provisions relate to the application of external-cost charges relating to traffic-based air pollution, infrastructure and user charges for heavy-duty vehicles, and to toll and user charges based on the environmental performance of the vehicle for other categories of vehicle. The requirements under Regulations 12
(1)and 12
(2)that are not being applied relate to the calculation of infrastructure charges for toll arrangements that were already in place or in train on 10 June 2008. 1 OJ No. L187, 20.7.1999, p.42 2 OJ No. L157, 9.6.2006, p.8 3 OJ No. L363, 20.12.2006, p.344 4 OJ No. L269, 14.10.2011, p.1 5 OJ No.L158, 10.6.2013, p.356 6 OJ No. L69, 4.3.2022, p.1 Privacy Statement Accessibility European Legislation Identifier (PDF) Open Data License Ráiteas Príobháideachais Inrochtaineacht Aitheantóir Eorpach Reachtaíochta (ELI) Ceadúnas Sonraí Oscailte Liosta Fianán © Government of Ireland.
