I, TIMMY DOOLEY, Minister of State at the Department of Climate, Energy and the Environment, in exercise of the powers conferred on me by section 76
(2)(
- ii)of the Maritime Area Planning Act 2021 , and after consultation with the Maritime Area Regulatory Authority, hereby make the following regulations: Citation 1. These Regulations may be cited as the Maritime Area Planning (Section 76) Regulations 2026. Relevant Class of Maritime Usage 2. A class of usage which is authorised, or is required to be authorised, by a local authority in its functional area under – (
- a)section 199 of the Local Government Act 2001 ; (
- b)section 46 of the Control of Horses Act 1996 ; (
- c)section 17 of the Control of Dogs Act 1986 ; or (
- d)Part 16 of the Planning and Development Regulations 2001, and which takes place wholly or partly in its nearshore area, is hereby specified a class of maritime usage for the purposes of paragraph 9 of Schedule 4 of the Maritime Area Planning Act 2021 . EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These Regulations specify certain activities for the purposes of paragraph 9 of Schedule 4 of the Principal Act and provide that a Maritime Area Consent (MAC) application is not required in respect of activities that are authorised by or under the specified enactments.
