The Maritime Area Regulatory Authority, in exercise of the powers conferred on it by section 90
(1)of the Maritime Area Planning Act 2021 , after consultation with the Minister of State at the Department of Climate, Energy and the Environment (as adapted by the Climate, Energy and the Environment (Delegation of Ministerial Functions) (No.2) Order 2025 ( S.I. 384 of 2025 )) and having had regard to the matters listed in section 90
(2)of the Act, hereby orders as follows: Citation
- This Order may be cited as the Maritime Area Planning Act 2021 (Fit and Proper Person – EirGrid) Order
- Interpretation
- In this Order: “Act” means Maritime Area Planning Act 2021 (No. 50 of 2021); “EirGrid” means the public limited company incorporated pursuant to Regulation 34 of the European Communities (Internal Market in Electricity) Regulations 2000 ( S.I. No. 445 of 2000 ); and “MAC” means maritime area consent, as defined in the Act. Specified fit and proper person
- That EirGrid, registered in the companies registration office with registered number 338522 and having its registered office at The Oval, 160 Shelbourne Road, Ballsbridge, Dublin 4 is, for the purpose of Section 90
(1)(a)(i) of the Act, hereby declared a fit and proper person to be granted and to hold any MAC. PRESENT when the SEAL of the MARITIME AREA REGULATORY AUTHORITY was affixed hereto and was authenticated by the signatures of:, LAURA BRIEN, Chief Executive, Maritime Area Regulatory Authority. PHILIP DALY, Board Member and duly Authorised Signatory under section 42
(3)(a) of the Act Maritime Area Regulatory Authority 16 June, 2026. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) This Order provides for EirGrid to be declared a fit and proper person to be granted and to hold any Maritime Area Consent (MAC), both at the time a MAC application is made and at the time that the MAC application concerned is determined by the Maritime Area Regulatory Authority (MARA).
