I, JENNIFER CARROLL MACNEILL, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving full effect (other than in respect of financial statistics) to Regulation (EC) No. 1338/2008 of the European Parliament and of the Council of 16 December 20081 as implemented by Commission Regulation (EU) 2022/2294 of 23 November 20222 , hereby make the following regulations: PART 1 PRELIMINARY AND GENERAL Citation 1. These Regulations may be cited as the European Union (Statistics on Healthcare Facilities, Human Resources and Utilisation) Regulations 2026. Interpretation 2.
(1)In these Regulations— “data” means the list of variables, their characteristics and breakdowns set out in Annex II to Commission Regulation (EU) 2022/2294 of 23 November 20222 , and includes metadata; “data reference year” means a calendar year commencing on 1 January 2025 or any year commencing on the anniversary of that date; “data source” means the persons and bodies set out in the Schedule; “metadata” shall be construed in accordance with Article 4 of the Commission Regulation (EU) 2022/2294 of 23 November 20222 ; “Minister” means the Minister for Health; “System of Health Accounts” means the System of Health Accounts 2011 produced jointly by the European Commission, the Organisation for Economic Cooperation and Development, and the World Health Organisation, as amended or replaced from time to time, that provides an economic framework for health accounting in the Member States using accounting rules methodologically compatible with the system of national accounts; “working day” means a day which is not a Saturday, Sunday or a public holiday in Ireland.
(2)A word or expression that is used in these Regulations and is also used Regulation (EC) No 1338/2008 of the European Parliament and of the Council of 16 December 20081 or Commission Regulation (EU) 2022/2294 of 23 November 20222 has, unless a contrary intention appears, the same meaning in these Regulations as it has in those Regulations. PART 2 OBLIGATION TO PROVIDE DATA Provision of data 3.
(1)Each data source mentioned in the Schedule shall, on the written request of the Minister in respect of a data reference year, provide to the Minister the data specified in such request.
(2)In respect of any data reference year, a data source shall provide the data requested of it in accordance with paragraphs
(1)and
(3)to the Minister not later than— (
- a)the last day of January of the year following the data reference year concerned, or (
- b)where the last day of January mentioned in subparagraph (
- a)is not a working day, the next working day.
(3)The data sources set out in the Schedule shall, when requested by the Minister under paragraph
(1)and in accordance with paragraph
(2), provide— (
- a)other than in respect of paragraphs 6.1 to 6.3 under the subheading Data on Hospital Care, aggregated data to the Minister for the data reference year concerned in respect of the list of variables, their characteristics and breakdowns specified in, and (
- b)record-level data to the Minister for the data reference year concerned in respect of the list of variables and their characteristics specified in paragraphs 6.1 to 6.3 under the subheading Data on Hospital Care in, Annex II to Commission Regulation (EU) 2022/2294 of 23 November 20222 .
(4)Nothing in this Regulation shall require the provision to the Minister of personal data within the meaning of paragraph
(1)of Article 4 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 20163 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). PART 3 OFFENCES AND PENALTIES Offence 4.
(1)A person or body who fails to comply with paragraph
(3)of Regulation 3 commits an offence.
(2)Where an offence under these Regulations is committed by a body corporate and is proved to have been so committed with the consent or connivance of or to be attributable to any neglect on the part of any person, being a director, manager, secretary or other officer of the body corporate, or a person who was purporting to act in such capacity, that person shall, as well as the body corporate, be guilty of an offence and shall be liable to be proceeded against and punished as if he or she were guilty of the first-mentioned offence.
(3)A summary offence under these Regulations may be prosecuted by the Minister. Penalties 5.
(1)A person guilty of an offence under these Regulations shall be liable— (
- a)on summary conviction, to a class A fine, or (
- b)on conviction on indictment, to a fine not exceeding €30,000.
(2)Where a person is convicted of an offence under paragraph
(1)and there is continuation of the offence by the person after his or her conviction, the person commits a further offence on every day on which the contravention continues and for each such offence shall be liable— (
- a)on summary conviction, to a fine not exceeding €100, or (
- b)on conviction on indictment, to a class D fine. SCHEDULE Regulations 2 & 3 DATA SOURCES 1. the Dental Council 2. the Environmental Protection Agency 3. the Health Information and Quality Authority 4. the Health Research Board 5. the Health Service Executive 6. the Higher Education Authority 7. the Irish Association of Physicists in Medicine 8. the Medical Council 9. the Mental Health Commission 10. the Nursing and Midwifery Board of Ireland 11. the Pharmaceutical Society of Ireland 12. Private sector hospitals operating in the State identified as General Hospitals (HP.1.1), Mental Health Hospitals (HP.1.2) or Other Specialised Hospitals (HP.1.3) in the System of Health Accounts GIVEN under my Official Seal, 18 June, 2026. The purpose of these Regulations is to enforce statutory collection of statistical information on healthcare facilities, healthcare human resources and healthcare utilisation in the State. This collection will result in comparable, consistent, synchronised and regular data at European Union level.
