I, SEÁN CANNEY, Minister of State at the Department of Transport, in exercise of the powers conferred on me by section 41
(1)(as amended by section 11 (c) of the Road Traffic and Roads Act 2023 (No. 16 of 2023)) of the Road Traffic Act 1994 (No. 7 of 1994) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )) and the Transport (Delegation of Ministerial Functions) Order 2025 ( S.I. No. 144 of 2025 ), after consultation with the Minister for Justice, hereby make the following regulations: 1.
(1)These Regulations may be cited as the Road Traffic Act 1994 (Detention of Vehicles) (Amendment) Regulations 2026.
(2)These Regulations come into operation on 14 August 2026. 2. Regulation 5
(1)of the Road Traffic Act 1994 (Detention of Vehicles) Regulations 2011 ( S.I. No. 460 of 2011 ) is amended – (
- a)by the substitution of the following paragraph for paragraph (a): “(
- a)in the case of a vehicle with a design gross weight not exceeding 3,500 kg – (
- i)€250 in respect of its detention, removal and storage for one day or a part of a day, and (
- ii)€70 in respect of each further day or part of a day that it is stored;”, and (
- b)by the substitution of the following paragraph for paragraph (b): “(
- b)in the case of a vehicle with a design gross weight exceeding 3,500 kg – (
- i)€500 in respect of its detention, removal and storage for one day or a part of a day, and (
- ii)€100 in respect of each further day or part of a day that it is stored.”. GIVEN under my hand, 21 July, 2026. SEÁN CANNEY Minister of State at the Department of Transport. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) These Regulations amend the Road Traffic Act 1994 (Detention of Vehicles) Regulations 2011 ( S.I. No. 460 of 2011 ) by increasing the charges payable to the Garda Commissioner by the owner of a vehicle which has been detained, removed and stored in accordance with the Regulations. The increased charges come into operation on 14 August 2026.
