I, PETER BURKE, Minister for Enterprise, Tourism and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Regulation (EU) 2024/1735 of the European Parliament and of the Council of 13 June 20241 on establishing a framework of measures for strengthening Europe’s net-zero technology manufacturing ecosystem and amending Regulation (EU) 2018/1724, hereby make the following Regulations: Citation 1. These Regulations may be cited as the European Union (Net-Zero Industry Act) Regulations 2026. Interpretation 2.
(1)In these Regulations – “Council Regulation” means Regulation (EU) 2024/1735 of the European Parliament and of the Council of 13 June 20241 on establishing a framework of measures for strengthening Europe’s net-zero technology manufacturing ecosystem and amending Regulation (EU) 2018/1724; “Minister” means the Minister for Enterprise, Tourism and Employment; “relevant project body” means a body that issues a permit or authorisation or other necessary document in the permit-granting process for projects under the Council Regulation and includes the bodies listed in the Schedule.
(2)A word or expression that is used in these Regulations and that is also used in the Council Regulation has, unless the context otherwise requires, the same meaning in these Regulations as it has in that Regulation.
(3)Unless the context otherwise requires, a reference in these Regulations to a numbered Article is a reference to the Article so numbered of the Council Regulation. Single point of contact 3.
(1)The Minister is designated, for the purpose of Article 6
(1), as the single point of contact.
(2)The Minister may request information from a relevant project body for the purpose of his or her functions as the single point of contact under the Council Regulation.
(3)Where the Minister requests information under paragraph
(2), a relevant project body shall provide that information to the Minister within the time period specified in the request.
(4)The Minister shall ensure that relevant information is provided to a relevant project body to avoid duplication of any studies, permits or authorisations for the purposes of Article 6
(5).
(5)The Minister may request information from a relevant project body for the purposes of providing an opinion requested under Article 10
(1), and where the Minister so requests, the relevant project body concerned shall provide that information to the Minister as soon as is practicable to enable the Minister to provide the opinion within the time period specified in that Article.
(6)The Minister shall ensure that a coordinated procedure is carried out under Article 10
(2). Extension of time limits by Minister 4. The Minister may, following consultation with a relevant project body concerned, extend the time limits – (a) in accordance with Article 9
(6)and 9
(7)and where he or she does so, he or she shall inform the project promoter in writing in accordance with Article 9
(8), and (b) in accordance with Article 10
(4)and where he or she does so, he or she shall inform the project promoter in writing in accordance with that Article. Information to be provided for purpose Article 7
- Information to be provided for the purpose of Article 7 shall be made available on a website maintained by the Minister. Competent authority
- The Minister is designated as the competent authority for the purposes of Article 3
(10). Relevant project body 7. A relevant project body shall – (a) specify and make available to the Minister, in advance of the commencement of the permit-granting process, the requirements and extent of information requested of a project promoter referred to in Article 6
(9), (b) notify the Minister in writing, as soon as practicable, when the permit-granting application is complete in accordance with the time period specified in Article 9
(10), (c) take account of the time limits specified in Article 9
(1)and
(2)and Article 16, and (d) issue the reasoned conclusion in accordance with Article 10
(3). Application and recognition under the Council Regulation 8.
(1)An application by a project promoter submitted under Article 14 through the strategic projects application process shall be assessed by the Minister in accordance with Article 14
(3)taking into account the selection criteria in Article 13.
(2)A project promoter may notify the Minister in accordance with Article 14
(4)and request an updated deadline.
(3)Where the Minister finds that a net-zero strategic project – (
- a)has undergone substantial changes, (
- b)no longer fulfils the criteria laid down in Article 13, or (
- c)an application was based on incorrect information, he or she shall inform the project promoter concerned, and after hearing the project promoter, the Minister may repeal the decision recognising a project as a net-zero strategic project in accordance with Article 14
(7). Collection of data
- The Minister shall collect and provide the data required under Article
