ARMY PENSIONS (INCREASE) ACT, 1964 AN ACT TO INCREASE RETROSPECTIVELY CERTAIN PENSIONS AND ALLOWANCES PAYABLE UNDER THE ARMY PENSIONS ACTS, 1923 TO 1962, AND TO INCREASE CERTAIN GRATUITIES PAYABLE UNDER THOSE ACTS. [15th July, 1964.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— Interpretation. 1.—(1) In this Act— “the Act of 1923” means the Army Pensions Act, 1923 ; “the Act of 1927” means the Army Pensions Act, 1927 ; “the Act of 1932” means the Army Pensions Act, 1932 ; “the Act of 1937” means the Army Pensions Act, 1937 ; “the Act of 1941” means the Army Pensions Act, 1941 ; “the Act of 1943” means the Army Pensions Act, 1943 ; “the Act of 1946” means the Army Pensions Act, 1946 ; “the Act of 1949” means the Army Pensions Act, 1949 ; “the Act of 1953” means the Army Pensions Act, 1953 ; “the Act of 1957” means the Army Pensions Act, 1957 ; “the Act of 1959” means the Army Pensions Act, 1959 ; “the Act of 1960” means the Army Pensions Act, 1960 ; “the No. 2 Act of 1960” means the Army Pensions (No. 2) Act, 1960 ; “the Increase Act of 1961” means the Army Pensions (Increase) Act 1961 ; “the Act of 1962” means the Army Pensions Act, 1962 ; “the Increase Act of 1962” means the Army Pensions (Increase) Act, 1962 ; “the Acts” means the Army Pensions Acts, 1923 to 1962; “the April, 1922-September, 1924, period” means the period which commenced on the 1st day of April, 1922, and ended on the 30th day of September, 1924. (2) This Act shall be construed as one with the Acts. (3) References in this Act to any enactment shall be construed as references to that enactment as amended by any subsequent enactment. Increase of wound pensions and gratuities under section 1 of the Act of 1923. 2.—(1) A wound pension granted under section 1 of the Act of 1923 to an officer discharged from the forces before the 1st day of October, 1924, which under the Acts is payable at the rate mentioned in column (3) of the First Schedule to this Act at a particular reference number shall be payable at the increased rate mentioned in column (4) of that Schedule at that reference number. (2) The amount of a wound pension granted under section 1 of the Act of 1923 to an officer discharged from the forces on or after the 1st day of October, 1924, and before the 16th day of December, 1959, shall be the amount which would be payable to such officer in respect of such wound pension under the Acts if— (a) he had been discharged from the forces on the 16th day of December, 1959, (b) his rank and service in that rank on that date were the same as those on the date of his actual discharge, and (c) the scale of pension applicable to him were the appropriate scale contained in the Tables to subsection (2) of section 4 of the Act of 1957. (3) Subsection (2) of this section shall not apply in the case of an officer discharged from the forces on the 18th day of December, 1954. (4) A wound pension granted under section 1 of the Act of 1923 to a soldier which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (5) Section 1 of the Act of 1923, as amended by section 4 of the Act of 1957, is hereby further amended by the substitution, in subsection (3), of “£251” for “£175” and “£150 10s. 0d.” for “£105”, and section 3 of the Act of 1923 (in so far as it relates to the grant of a gratuity) shall have effect accordingly. Increase of wound pensions under section 3 of the Act of 1923. 3.—(1) A wound pension granted under section 3 of the Act of 1923 to a person deemed to have held the rank of officer in the forces which under the Acts is payable at the rate mentioned in column (3) of the First Schedule to this Act at a particular reference number shall be payable at the increased rate mentioned in column (4) of that Schedule at that reference number. (2) A wound pension granted under section 3 of the Act of 1923 to a person deemed to have held the rank of soldier in the forces which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. Amendment of Second Schedule to the Act of 1923. 4.—The Second Schedule (which specifies allowances for dependants of certain deceased officers) to the Act of 1923 is hereby amended in the following respects— (a) in paragraph 1, “£217” shall be substituted for “£206 10s.” (inserted by section 5 of the Increase Act of 1962), and “£270” shall be substituted for “£188” (inserted by section 6 of the Act of 1957), (b) in paragraphs 2 and 3, “£60” and “£98 10s.” shall be substituted for “£57” and “£94” (inserted by section 5 of the Increase Act of 1962) respectively, and (c) in paragraph 5, “£2 9s. 3d.” shall be substituted for “£2 7s.” (inserted by section 5 of the Increase Act of 1962). Amendment of Third Schedule to the Act of 1923. 5.—The Third Schedule (which specifies allowances for dependants of certain deceased soldiers) to the Act of 1923 is hereby amended in the following respects— (a) in paragraph 1, “£2 3s. 6d.” shall be substituted for “£2 1s. 6d.” (inserted by section 6 of the Increase Act of 1962) and “£112 10s.” shall be substituted for “£78 10s.” (inserted by section 7 of the Act of 1957), (b) in paragraph 2, “12s. 6d.”, “8s. 6d.” and “£1 1s. 6d.” shall be substituted for “12s. 0d.”, “8s. 0d.” and “£1 0s. 6d.” (inserted by section 6 of the Increase Act of 1962) respectively, and (c) in paragraph 4, “£1 17s. 3d.” shall be substituted for “£1 15s. 6d.” (inserted by section 6 of the Increase Act of 1962). Increase of disability pensions under section 9 of the Act of 1927. 6.—(1) A disability pension granted under subsection (1) of section 9 of the Act of 1927 to an officer which under the Acts is payable at the rate mentioned in column (3) of the First Schedule to this Act at a particular reference number shall be payable at the increased rate mentioned in column (4) of that Schedule at that reference number. (2) A disability pension granted under subsection (1) of section 9 of the Act of 1927 to a soldier which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. Increase of disability pensions under section 10 of the Act of 1927. 7.—(1) The amount of a disability pension granted under subsection (1) of section 10 of the Act of 1927 to an officer discharged from the forces before the 16th day of December, 1959, shall be determined in accordance with the provisions set out in the Third Schedule to this Act. (2) A disability pension granted under subsection (1) of section 10 of the Act of 1927 to a soldier suffering at the date of his discharge from the forces from a disablement caused by disease attributable to service in the forces during the April, 1922-September, 1924, period, and which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number, shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (3) A disability pension granted under subsection (1) of section 10 of the Act of 1927 to a soldier who was at the date of his discharge from the forces suffering from a disablement caused by disease attributable to service in the forces during the emergency period and which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (4) The First Schedule (which specifies the scales and rates of disability pensions payable under section 10 of the Act of 1927 to officers and soldiers and members of the Army Nursing Service suffering from disease attributable to service with a United Nations Force) to the No. 2 Act of 1960, as amended by section 8 of the Increase Act of 1962, is hereby further amended— (a) by the substitution for Part II of the following— “PART II. Soldiers. Degree of Disablement Rates of Disability Pension per week £ s. d. 100 per cent. 4 17 6 90 ” ” 4 11 0 80 ” ” 4 1 6 ” and (b) by the substitution for Part IV of the following— “PART IV. Members of the Army Nursing Service. Degree of Disablement Scale of pension per annum £ s. d. 100 per cent. 255 0 0 90 ” ” 239 0 0 80 ” ” 213 0 0 .” Increase of wound pensions and gratuities under section 11 of the Act of 1927. 8.—(1) A wound pension granted under subsection (1) of section 11 of the Act of 1927 to an officer which under the Acts is payable at the rate mentioned in column (3) of the First Schedule to this Act at a particular reference number shall be payable at the increased rate mentioned in column (4) of that Schedule at that reference number. (2) A wound pension granted under subsection (1) of section 11 of the Act of 1927 to a soldier which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number, shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (3) Subsection (4) of section 11 of the Act of 1927, as amended by section 10 of the Act of 1957, is hereby further amended by the substitution of “£251” for “£175” and “£150 10s.” for “£105”. Increase of certain wound pensions and gratuities under section 12 of the Act of 1927. 9.—(1) The amount of a wound pension granted under subsection (1) of section 12 of the Act of 1927 to an officer discharged from the forces before the 16th day of December, 1959, shall be determined in accordance with the provisions set out in the Third Schedule to this Act. (2) A wound pension granted under subsection (1) of section 12 of the Act of 1927 to a soldier who was discharged from the forces before the 30th day of July, 1949, and who at the date of his discharge was suffering from a disablement due to a wound attributable to service in the forces other than during the emergency period and which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number, shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (3) A wound pension granted under subsection (1) of section 12 of the Act of 1927 to a soldier who was discharged from the forces before the 30th day of July, 1949, and who at the date of his discharge was suffering from a disablement due to a wound attributable to service in the forces during the emergency period, and which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number, shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (4) Subsection (4) of section 12 of the Act of 1927, as amended by section 11 of the Act of 1957, is hereby further amended— (a) by the substitution in paragraph (a) of “two hundred and one pounds” for “one hundred and forty pounds” and “twelve pounds and ten shillings” for “eight pounds and fifteen shillings”, (b) by the substitution in paragraph (b) of “one hundred pounds and ten shillings” for “seventy pounds” and “six pounds and five shillings” for “four pounds seven shillings and sixpence”. (5) The First Schedule to the Act of 1949 (which specifies the amount of a wound pension payable under section 12 of the Act of 1927 to persons discharged from the forces on or after the 30th day of July, 1949) is hereby amended by the substitution for Part II (inserted by subsection (4) of section 10 of the Increase Act of 1962) of the following: “PART II. Wound Pensions—Soldiers. Degree of Disablement Rate of Pension per week £ s. d. 100 per cent. 4 17 6 90 ” ” 4 11 0 80 ” ” 4 1 6 70 ” ” 3 11 6 60 ” ” 3 2 6 50 ” ” 2 12 3 40 ” ” 2 1 6 30 ” ” 1 11 3 20 ” ” 1 0 9 .” Increase of disability pensions under section 13 of the Act of 1927. 10.—(1) A disability pension granted under subsection (1) of section 13 of the Act of 1927 to an officer discharged from the forces before the 1st day of October, 1924, or to a person determined to have been an officer, which under the Acts is payable at the rate mentioned in column (3) of the First Schedule to this Act at a particular reference number, shall be payable at the increased rate mentioned in column (4) of that Schedule at that reference number. (2) The amount of a disability pension granted under subsection (1) of section 13 of the Act of 1927 to an officer discharged from the forces on or after the 1st day of October, 1924, and before the 16th day of December, 1959, shall be the amount which would be payable to such officer in respect of such disability pension under the Acts if— (a) he had been discharged from the forces on the 16th day of December, 1959, (b) his rank and service in that rank on that date were the same as those on the date of his actual discharge, and (c) the scale of pension applicable to him were the appropriate scale contained in the Tables to subsection (2) of section 4 of the Act of 1957. (3) A disability pension granted under subsection (1) of section 13 of the Act of 1927 to a soldier discharged from the forces before the 1st day of October, 1924, or to a person determined to have been a soldier, which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number, shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. (4) A disability pension granted under subsection (1) of section 13 of the Act of 1927 to a soldier discharged from the forces on or after the 1st day of October, 1924, and which is payable at the rate mentioned in column (3) of the Second Schedule to the Increase Act of 1962 at a particular reference number shall be payable at the increased rate mentioned in column (3) of the Second Schedule to this Act at the corresponding reference number. Increased rates of further and married pensions for officers. 11.—A further or married pension shall be payable to an officer at the rate shown in column (2) of the Table to this section opposite the appropriate degree of disablement shown in column (1) of that Table, in substitution for the corresponding rate in respect of that degree of disablement specified in the sixth column of the First Schedule to the Act of 1923, as amended, and the third column of the Second Schedule to the Act of 1927, as amended. Degree of Disablement Rate of further or married pension per week (1) (2) £ s. d. 100 per cent. 1 9 0 90 ” ” 1 6 3 80 ” ” 1 3 3 70 ” ” 1 0 6 60 ” ” 17 6 50 ” ” 14 6 40 ” ” 11 9 30 ” ” 8 9 20 ” ” 5 9 Increased rates of further and married pensions for soldiers. 12.—A further pension (in the case of a non-commissioned officer or man) or a married pension (in the case of a soldier) shall be payable at the rate shown in column (2) of the Table to this section opposite the appropriate degree of disablement shown in column (1) of that Table, in substitution for the corresponding rate in respect of that degree of disablement specified in the seventh column of the First Schedule to the Act of 1923, as amended, the fifth column of the Second Schedule to the Act of 1927, as amended, and the third column of the table to subsection (6) of section 3 of the Act of 1943, as amended. Degree of Disablement Rate of further or married pension per week (1) (2) £ s. d. 100 per cent. 19 3 90 ” ” 17 6 80 ” ” 15 6 70 ” ” 13 6 60 ” ” 11 9 50 ” ” 9 9 40 ” ” 7 9 30 ” ” 5 9 20 ” ” 4 0 Amendment of Third Schedule to the Act of 1927. 13.—The Third Schedule to the Act of 1927 shall be construed as if— (a) for the reference in Part I to a married pension of £20 per annum, there were substituted a reference to a married pension of £39 per annum, and (b) for the reference in Part II to a married pension of five shillings a week, there were substituted a reference to a married pension of nine shillings and ninepence a week. Amendment of Sixth Schedule to the Act of 1927. 14.—The Sixth Schedule (which specifies allowances to dependants of certain deceased members of the forces) to the Act of 1927 is hereby amended in the following respects— (a) in paragraph 1 of Part I, “£217” shall be substituted for “£206 10s. 0d.” (inserted by section 13 of the Increase Act of 1962) and “£270” shall be substituted for “£188” (inserted by section 13 of the Act of 1957), (b) in paragraphs 2 and 3 of Part I, “£60” and “£98 10s.” shall be substituted for “£57” and “£94” (inserted by section 13 of the Increase Act of 1962) respectively, (c) in paragraph 1 of Part II, “£2 3s. 6d.” shall be substituted for “£2 1s. 6d.” (inserted by section 13 of the Increase Act of 1962), and “£112 10s.” shall be substituted for “£78 10s” (inserted by section 13 of the Act of 1957), and (d) in paragraph 2 of Part II, “12s. 6d.”, “8s. 6d.” and “£1 1s. 6d.” shall be substituted for “12s. 0d.”, “8s. 0d.” and “£1 0s. 6d.” (inserted by section 13 of the Increase Act of 1962) respectively. Amendment of Seventh Schedule to the Act of 1927. 15.—(1) The Seventh Schedule (which specifies allowances to dependants of certain deceased members of the forces) to the Act of 1927 is hereby amended in the following respects— (a) in Part I, “£148”, “£217”, “£270”, “£44 10s.” and “£82 10s.” shall be substituted for “£141”, “£206 10s.”, “£257 10s.”, “£42 10s.” and “£78 10s.” (inserted by subsection (1) of section 14 of the Increase Act of 1962) respectively and “£270” shall be substituted for “£188” (inserted by subsection (1) of section 14 of the Act of 1957), (b) In Part II, “£1 11s.”, “11s. 6d.” and “£1 3s.” shall be substituted for “£1 9s. 6d.”, “11s. 0d.” and “£1 2s.” (inserted by subsection (1) of section 14 of the Increase Act of 1962) respectively and “£123 10s.” shall be substituted for “£86” (inserted by subsection (1) of section 14 of the Act of 1957). (2) The reference in section 25 of the Act of 1953 to paragraphs 1 and 3 of Part I and paragraphs 1 and 3 of Part II of the Seventh Schedule to the Act of 1927 shall be deemed to be a reference to paragraphs 1 and 3 of Part I and paragraphs 1 and 3 of Part II of the Seventh Schedule to the Act of 1927 as amended by subsection (1) of this section. (3) Part III of the Seventh Schedule to the Act of 1927 (inserted by subsection (5) of section 5 of the Act of 1943), shall be construed as if in paragraph 6 “£129” were substituted for “£123” (inserted by subsection (3) of section 14 of the Increase Act of 1962) and “£258 10s.” were substituted for “£180” (inserted by subsection (3) of section 14 of the Act of 1957). (4) Part IV of the Seventh Schedule to the Act of 1927 (inserted by subsection (5) of section 5 of the Act of 1943), shall be construed as if in paragraph 6 “£64” were substituted for “£61” (inserted by subsection (4) of section 14 of the Increase Act of 1962) and “£258 10s.” were substituted for “£180” (inserted by subsection (4) of section 14 of the Act of 1957). Increase of wound disability and married pensions and gratuities under section 10 of the Act of 1932. 16.—(1) A wound pension or a disability pension granted under subsection (1) or under subsection (2) of section 10 of the Act of 1932 which is payable at the rate mentioned in column (3) of the Fourth Schedule to this Act at a particular reference number shall be payable at the increased rate mentioned in column (5) of that Schedule at that reference number. (2) Subsection (1) of section 10 of the Act of 1932 is hereby amended by the substitution of “one hundred and eighty six pounds and ten shillings” for “one hundred and thirty pounds” (inserted by section 15 of the Act of 1957). (3) A married pension granted under subsection (3) of section 10 of the Act of 1932 which is payable at the rate mentioned in column (4) of the Fourth Schedule to this Act at a particular reference number shall be payable at the increased rate mentioned in column (6) of that Schedule at that reference number. Amendment of Second Schedule to the Act of 1932. 17.—The Second Schedule (which specifies allowances and gratuities to certain classes of persons) to the Act of 1932 is hereby amended in the following respects— (a) in paragraph 1 of Part I, “£166” shall be substituted for “£158 10s.” (inserted by section 16 of the Increase Act of 1962) and “£215 10s.” shall be substituted for “£150” (inserted by section 16 of the Act of 1957), (b) in paragraphs 2 and 3 of Part I, “£44 10s.” and “£74 10s.” shall be substituted for “£42 10s.” and “£71” (inserted by section 16 of the Increase Act of 1962) respectively, and (c) in paragraph 5 of Part II, “£1 17s. 3d.” shall be substituted for “£1 15s. 6d.” (inserted by section 16 of the Increase Act of 1962). Increase of allowances to certain relatives of Signatories to the Proclamation published on Easter Monday, 1916. 18.—(1) Subsection (1) of section 3 of the Act of 1937 is hereby amended by the substitution in paragraph (a) (which relates to the allowance payable to the widow (if any) of a Signatory to the Proclamation published on Easter Monday, 1916) of “seven hundred and sixty-one pounds” for “seven hundred and twenty-five pounds” (inserted by section 17 of the Increase Act of 1962). (2) Subsection (1) of section 3 of the Act of 1937 is hereby further amended by the substitution in paragraph (c) (which relates to the allowance payable to each sister of such Signatory) of “three hundred and thirty-one pounds” for “three hundred and fifteen pounds” (inserted by section 17 of the Increase Act of 1962). Amendment of section 19 of the Act of 1937. 19.—Section 19 of the Act of 1937 (which provides for gratuities to the widows or children of members of certain organisations) is hereby amended by the substitution in subsection (3), of “two hundred and fifty-eight pounds and ten shillings” for “one hundred and eighty pounds” (inserted by section 17 of the Act of 1957). Increase of pensions under section 26 of the Act of 1937. 20.—(1) Every final pension under section 26 of the Act of 1937 which is payable at the rate of one pound fifteen shillings and sixpence per week shall be payable at the rate of one pound seventeen shillings and threepence per week. (2) Every final pension under section 26 of the Act of 1937 which is payable at the rate of two pounds and seven shillings per week shall be payable at the rate of two pounds nine shillings and three pence per week. Increase of pensions under sections 28 and 29 of the Act of 1937. 21.—Section 28 and section 29 of the Act of 1937 (which provide for pensions to former members of the forces and members of certain organisations in respect of wounds or disease aggravated by service) shall have effect as if, for the Schedule to that Act, there were substituted the Fifth Schedule to this Act. Increase of pensions under section 6 of the Act of 1941. 22.—(1) Every final pension under section 6 of the Act of 1941 which is payable at the rate of one pound fifteen shillings and sixpence per week shall be payable at the rate of one pound seventeen shillings and three pence per week. (2) Every final pension under section 6 of the Act of 1941 which is payable at the rate of two pounds and seven shillings per week shall be payable at the rate of two pounds nine shillings and three pence per week. Amendment of section 3 of the Act of 1943. 23.—Section 3 of the Act of 1943 shall be construed as if for the reference, in the Table to subsection (5), to a married pension of £30 per annum there were substituted a reference to a married pension of £58 per annum. Increase of pensions under section 4 of the Act of 1943. 24.—There shall be substituted for the Schedule (inserted by section 21 of the Increase Act of 1962) to section 4 of the Act of 1943 (which extends certain provisions of the Act of 1927 to members of the Army Nursing Service) the following— “SCHEDULE. Increase of pensions under section 6 of the Act of 1943. 25.—(1) Every final pension under section 6 of the Act of 1943 which is payable at the rate of one pound fifteen shillings and sixpence per week shall be payable at the rate of one pound seventeen shillings and threepence per week. (2) Every final pension under section 6 of the Act of 1943 which is payable at the rate of two pounds and seven shillings per week shall be payable at the rate of two pounds, nine shillings and threepence per week. Amendment of section 7 of the Act of 1943. 26.—For the purposes of section 7 of the Act of 1943, as amended by subsections (1), (2) and (3) of section 41 of the Act of 1953— (a) the expression “the appropriate annual sum” means, in respect of a person whose age is seventy years or more— (i) in relation to a single man or woman or to a widower or widow with no children, £108, (ii) in relation to a widower or widow who has children, the sum of the following amounts, namely, £108 and £11 14s. in respect of each child, (iii) in relation to a married man or woman whose spouse is living and who has no children and who is in receipt of an old age (contributory) pension under the Social Welfare Acts, 1952 to 1963, or whose spouse is in receipt of such pension or of an old age (non-contributory) pension or a blind pension under the Old Age Pensions Acts, 1908 to 1963, £127 10s., (iv) in relation to any other married man or woman whose spouse is living and who has no children, £151, (v) in relation to a married man or woman whose spouse is living and who has children and who is in receipt of an old age (contributory) pension under the Social Welfare Acts, 1952 to 1963, or whose spouse is in receipt of such pension or of an old age (non-contributory) pension or a blind pension under the Old Age Pensions Acts, 1908 to 1963, the sum of the following amounts, namely, £127 10s. and £11 14s. in respect of each child, (vi) in relation to any other married man or woman whose spouse is living and who has children, the sum of the following amounts, namely, £151 and £11 14s. in respect of each child; (b) the expression “the appropriate annual sum” means, in respect of a person whose age is less than seventy years— (i) in relation to a single man or woman or to a widower or widow with no children, £134, (ii) in relation to a widower or widow who has children, the sum of the following amounts, namely, £134 and £11 14s. in respect of each child, (iii) in relation to a married man or woman whose spouse is living but who has no children, £160, (iv) in relation to a married man or woman whose spouse is living and who has children, the sum of the following amounts, namely, £160 and £11 14s. in respect of each child. Increase of pensions under section 12 of the Act of 1946. 27.—Section 12 of the Act of 1946 (which provides for pensions in respect of tuberculosis aggravated by service during the emergency period) shall have effect as if, for the Second Schedule (inserted by section 24 of the Increase Act of 1962) to the Act of 1946, there were substituted the following:— “SECOND SCHEDULE. Increases of allowances under section 4 of the Act of 1953. 29.—Subsection (1) of section 4 of the Act of 1953 (which provides for allowances to certain relatives of certain deceased persons with pre-truce military service) is hereby amended in the following respects— (1) in paragraph (a), “£331” shall be substituted for “£315” (inserted by section 25 of the Increase Act of 1962), (2) in paragraphs (aa) and (ab) (inserted by section 8 of the Act of 1959), “£166” shall be substituted for “£158” (inserted by section 25 of the Increase Act of 1962), (3) in paragraph (b), “£238 10s.” shall be substituted for “£227” (inserted by section 25 of the Increase Act of 1962), and (4) in paragraphs (c) and (d), “£166” shall be substituted for “£158” (inserted by section 25 of the Increase Act of 1962). Increase of allowances to certain children of Signatories to the Proclamation published on Easter Monday, 1916. 30.—In subsection (1) of section 45 of the Act of 1953 (which relates to the allowances payable to certain children of Signatories to the Proclamation published on Easter Monday, 1916) “£166” shall be substituted for “£158” (inserted by section 26 of the Increase Act of 1962). Amendment of section 4 of the No. 2 Act of 1960. 31.—Section 4 of the No. 2 Act of 1960 is hereby amended by the substitution in clause (i) of paragraph (b) of subsection (2) of “£201” and “£12 10s.” for “£140” and “£8 15s.” respectively. Increase of pensions under section 5 of the No. 2 Act of 1960. 32.—(1) Every final pension under section 5 of the No. 2 Act of 1960 which is payable at the rate of one pound fifteen shillings and sixpence per week shall be payable at the rate of one pound seventeen shillings and three pence per week. (2) Every final pension under section 5 of the No. 2 Act of 1960 which is payable at the rate of two pounds and seven shillings per week shall be payable at the rate of two pounds nine shillings and three pence per week. Increase of pensions under Section 7 of the No. 2 Act of 1960. 33.—Section 7 of the No. 2 Act of 1960 (which provides for pensions in respect of disease aggravated by service with a United Nations Force), as amended by section 29 of the Increase Act of 1962, shall have effect as if, for the Table thereto, there were substituted the following:— “TABLE Rates of Pensions. Amendment of Second Schedule to the No. 2 Act of 1960. 35.—(1) The Second Schedule (which specifies allowances to dependants of certain deceased members of the forces) to the No. 2 Act of 1960 is hereby amended in the following respects— (a) in Part I, “£148”, “£217”, “£270”, “£44 10s.” and “£82 10s.” shall be substituted for “£141”, “£206 10s.”, “£257 10s.”, “£42 10s.” and “£78 10s.” (inserted by subsection (1) of section 28 of the Increase Act of 1962) respectively and “£270” shall be substituted for “£188”, (b) in Part II, “£1 11s.”, “11s. 6d.” and “£1 3s.” shall be substituted for “£1 9s. 6d.”, “11s. 0d.” and “£1 2s.” (inserted by subsection (1) of section 28 of the Increase Act of 1962) respectively and “£123 10s.” shall be substituted for “£86”. (2) The reference in subsection (2) of section 6 of the No. 2 Act of 1960 to paragraphs 1 and 3 of Part I and paragraphs 1 and 3 of Part II of the Second Schedule to the No. 2 Act of 1960 shall be deemed to be a reference to paragraphs 1 and 3 of Part I and paragraphs 1 and 3 of Part II of the Second Schedule to the No. 2 Act of 1960 as amended by subsection (1) of this section. (3) In paragraph 6 of Part III of the Second Schedule to the No. 2 Act of 1960 “£129” shall be substituted for “£123” (inserted by subsection (3) of section 28 of the Increase Act of 1962) and “£258 10s.” shall be substituted for “£180”. (4) In paragraph 6 of Part IV of the Second Schedule to the No. 2 Act of 1960 “£64” shall be substituted for “£61” (inserted by subsection (4) of section 28 of the Increase Act of 1962) and “£258 10s.” shall be substituted for “£180”. Amendment of Second Schedule to the Act of 1962. 37.—The Second Schedule (which specifies allowances to dependants of certain deceased persons) to the Act of 1962 is hereby amended by the substitution of “£1 11s.”, “11s. 6d.” and “£ 1 3s.” for “£1 9s. 6d.”, “11s. 0d.” and “£1 2s.” (inserted by section 31 of the Increase Act of 1962) respectively and by the substitution of “£123 10s.” for “£86”. Repeals. 38.—The enactments mentioned in the Sixth Schedule to this Act are hereby repealed to the extent specified in the third column. Commencement. 39.—The provisions of this Act shall be deemed to have come into operation on the 1st day of November, 1963, and the increase in pensions (including further and married pensions) and allowances provided by those provisions shall have effect from that date. Short title and collective citation. 40.—(1) This Act may be cited as the Army Pensions (Increase) Act, 1964. (2) The Acts and this Act may be cited together as the Army Pensions Acts, 1923 to 1964. (1) The amount of a disability pension granted under subsection (1) of section 10 of the Act of 1927 to an officer discharged from the forces before the 16th day of December, 1959, and at the date of his discharge suffering from a disablement caused by disease attributable to service in the forces during the April, 1922—September, 1924, period shall be the amount which would be payable to such officer under the Acts if he had been discharged from the forces on the 16th day of December, 1959, and his rank and service in that rank on that date were the same as those on the date of his actual discharge and the scale of pension applicable to him were the appropriate scale contained in the Tables to subsection (2) of section 4 of the Act of 1957.
