In short
This law allows for the reduction or cancellation of certain outstanding loans related to sea fishing and provides for the writing off of loans that cannot be recovered. It aims to manage debts incurred for purposes like acquiring fishing boats, equipment, or gear.
What it regulates
- The remission or reduction of outstanding balances on loans made for sea fishing purposes.
- The conditions under which such remissions or reductions can be granted.
- The writing off of loan balances deemed irrecoverable.
- The reporting of remitted or written-off sums to the Oireachtas.
Who it concerns
- Individuals or entities who received loans for sea fishing purposes from specific government bodies.
- Sureties who guaranteed the repayment of these loans.
Key points
- The Minister for Lands and Fisheries, with the consent of the Minister for Finance, can remit all or part of a loan balance outstanding at the passing of this Act.
- Remissions can be unconditional or subject to conditions, such as making a payment or transferring fishing assets.
- Remitting part of a loan does not relieve sureties from liability for the remaining amount.
- The Minister for Finance can authorize the writing off of irrecoverable loan balances, whether the loan was made before or after this Act.
- Statements detailing sums remitted or written off must be laid before each House of the Oireachtas.
