INTOXICATING LIQUOR (OCCASIONAL LICENCES) ACT, 1932.
AN ACT TO MAKE SPECIAL PROVISION IN RESPECT OF OCCASIONAL LICENCES FOR THE SALE OF INTOXICATING LIQUOR GRANTED IN RESPECT OF PREMISES SITUATE WITHIN THE GROUNDS OF THE INDUSTRIAL AND AGRICULTURAL FAIR INTENDED TO BE HELD IN OR NEAR THE CITY OF CORK IN THE YEAR 1932. [6th May, 1932.]
BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—
Definition.
1.—In this Act the expression “the Fair Grounds” means all the land and premises on which an industrial and agricultural fair is held by the Irish Industrial and Agricultural Fair, Cork, 1932, in or near the county borough of Cork in the year 1932.
Certain occasional licences.
2.—The following provisions shall have effect in relation to every occasional licence granted under section 13 of the Revenue Act, 1862, as amended by subsequent enactments, which is granted or proposed to be granted, with the consent of the Irish Industrial and Agricultural Fair, Cork, 1932, to any person in respect of premises situate in the Fair Grounds and for a period beginning on or after the 1st day of May, 1932, and ending on or before the 31st day of October, 1932, that is to say:—
(a) such licence may be granted for any period not exceeding three months;
(b) such licence may be granted to commence immediately on the expiration of another such licence previously granted to the same person in respect of the same or substantially the same premises, notwithstanding that such previously granted licence has not expired and notwithstanding that the total period of such licence and such other or every such other licence previously granted will exceed three months;
(c) if the premises to which such licence relates are not within the county borough of Cork, such premises shall, for the purposes of
Parts I
and
II
of the
Intoxicating Liquor Act, 1927
(No. 15 of 1927), and this Act, be deemed to be situate within the county borough of Cork and the said Parts I and II and this Act shall apply in respect of such premises and of such licence accordingly;
(d) such licence may be granted in respect of and may extend (subject to or without any special conditions) to any time on Sundays not earlier than the hour of one o'clock in the afternoon nor later than the hour of nine o'clock in the evening;
(e) the Justice of the District Court having jurisdiction in the district court area for the transaction of licensing business in which the premises to which such licence relates are or are deemed by this section to be situate may, on the application of the officer in charge of the Gárda Síochána for that area and after reasonable notice to the holder of such licence, revoke such licence if he is satisfied that breaches of the law relating to the sale of intoxicating liquor have occurred on or in relation to the premises to which such licence relates.
Short title and citation.
3.—(1) This Act may be cited as the Intoxicating Liquor (Occasional Licences) Act, 1932.
(2) This Act shall be construed as one with the Licensing (Ireland) Acts, 1833 to 1929.
