Proceedings Commitment Review Legal Framework Article 25 par. 6 of the Greek Competition Act 3959/2011 Decision Approves Complainant Aluminum S.A. Respondent Depa S.A. Summary of Decision The Competition Commission in its plenary session decided unanimously that: A. Accepts the proposal of DEPA S.A. for modification of the third commitment adopted by Decision no. 551/VII/2012, as amended by point 9 of Decision no. 589/2014. In particular, the decision concerns the elimination of the provision on aggregation of any requests to increase or decrease the supply prices of DEPA S.A., when setting the starting price of auctions. B. The above amendment enters into force on 01.01.2018 and becomes mandatory for the company in question (Article 25 par. 6 of the Greek Competition Act 3959/2011). The Decisions nos. 551/VII/2012, 589/2014, 596/2014, 618/2015 and 631/2016 are still valid. C. In case of non-compliance with the undertaken commitments, which have become mandatory, the Competition Commission may impose the fines provided for in Article 25 par. 1. (IV. and VI.) and par. 2 (I. and II.) of the Greek Competition Act 3959/2011.
