Η Ρυθμιστική Αρχή Αποβλήτων, Ενέργειας και Υδάτων, σε συνέχεια της από 14 Οκτωβρίου 2025 Δημόσιας Διαβούλευσης επί της εισήγησης της ΔΕΣΦΑ Α.Ε. αναφορικά με το ειδικό προϊόν δυναμικότητας για την μεταφορά φυσικού αερίου από την Ελλάδα στην Ουκρανία έως το τέλος του Έτους Αερίου 2025/2026, δημοσιοποιεί τον ακόλουθο πίνακα συμμετεχόντων στη Διαβούλευση, καθώς και το περιεχόμενο των επιστολών που υποβλήθηκαν στο πλαίσιο αυτής, με εξαίρεση όσων αιτήθηκαν τη μη δημοσιοποίηση των στοιχείων ή/και των απόψεών τους. Дізнайтеся, чому це важливо Dear RAAEY, With respect to Public Consultation on the proposal of DESFA S.A. regarding the special capacity product for the transport of natural gas from Greece to Ukraine until the end of the Gas Year 2025/2026 we would like to inform you on the following. As representatives of Naftogaz Group we welcome the initiative of the TSOs and we kindly ask you to approve it and give it your support. We see LNG as one of the key ways of diversifying gas flows to Ukraine, and we believe that Greek LNG terminals are very well positioned to be used for transporting gas to Ukraine for injection to storage and consumption in winter period. However, transportation costs along the route are prohibitively high, making it less competitive than it can be. Special capacity product is expected to mitigate this issue, and while so far there are still many unsolved operational and commercial issues, we are optimistic about its potential given rapid progress achieved during last year. We are looking forward to further development of this product and are especially keen to explore the potential of using it in the upcoming winter season and following injection season. Thank you, With our utmost respect, Naftogaz Slovakia s.r.o. – member of Naftogaz Group, Ukraine CONSULTATION RESPONSE The Route 1 Capacity Product Poses a Risk to EU Market Integrity Brussels, 21 October 2025 – Energy Traders Europe appreciates the opportunity to comment on the proposed prolongation of the Route 1 capacity product under consultation by RAEEY, which enables point-to-point transport of natural gas from Greece to Ukraine via Bulgaria, Romania, and Moldova. While we recognise the importance of ensuring Ukraine’s secure gas supply and commend the TSOs and NRAs for their cooperation and commitment to regional energy security, Energy Traders Europe notes that the current design of the Route 1 capacity product risks undermining the integrity of the EU internal gas market. Please find our key messages and detailed remarks below. Key messages

  1. Conflict with EU Market Rules Bundling capacity across multiple transmission systems into a single fixed route which bypasses national markets, reduces transparency and liquidity, and risks privileging certain users. Market Distortion and Hindered Regional Development The point-to-point product with a discount set outside the agreed framework disadvantages traders using compliant routes, replacing market-based optimisation with administrative allocation and weakening competition and liquidity. “Route 1” is also structured in a way that limits its accessibility to just a few market participants, which merely reinforces the distortion. Dangerous Precedent Against European Market Integration Route-specific products risk encouraging similar measures elsewhere, fragmenting the internal gas market and undermining two decades of progress towards harmonised capacity allocation and cross-border cooperation. 1 of 3 CONSULTATION RESPONSE Detailed comments Energy Traders Europe believes that the Route 1 capacity product is unlikely to be deemed compliant with the EU acquis. By combining capacity across multiple transmission systems into a single pre-defined point-to-point route, the product is at odds with the entry-exit framework that underpins the internal gas market. Such a hastily implemented approach undermines the principles of transparency, nondiscrimination, and market-based allocation established under the Gas Package. Route 1 is also established outside the auction calendar functioning under the Capacity Allocation Mechanisms Network Code (CAM NC) and applies a collective discount outside the framework of Tariffs Network Code (TAR NC). Even if introduced as a temporary measure to facilitate gas flows to Ukraine, this approach creates legal uncertainty and risks privileging certain users. Crucially, the product allows injection only in Greece and withdrawal only in Ukraine, with no possibility to access or extract capacity at intermediate points along the route, in direct conflict with EU rules and the principles of a free, flexible integrated gas market. In practice, this rigid point-to-point configuration also undermines the efficient integration of LNG imports from Greece (particularly from the Alexandroupolis FSRU) into regional markets. There are other, legally sound solutions that can improve the attractiveness of the Trans-Balkan route. The product is also inherently distortive. Capacity holders on competing routes are disadvantaged, while market-based optimisation is replaced by administrative allocation. Its design, even if linked to a discount mechanism, reinforces the position of national incumbents along the Trans-Balkan corridor and contributes to further fragmentation of the regional market. Moreover, the design of Route 1, which requires shippers to hold contracts with all the TSOs along the route limits the number of eligible participants, increasing its distortive impact further. All of these effects reduce liquidity, weaken competition, limit flexibility, and may increase costs for shippers and consumers, while discouraging investment in regional infrastructure and undermining long-term market development. 2 of 3 CONSULTATION RESPONSE The creation of a route-specific point-to-point product also sets a dangerous precedent. Other Member States could be encouraged to adopt similar exceptional products, fragmenting the internal gas market into isolated corridors and undermining two decades of progress towards harmonised cross-border capacity allocation, cooperation, and hubbased trading. Maintaining the integrity of EU market rules is essential to safeguard transparency, liquidity, and investor confidence across the European gas market. We recommend considering alternative solutions – specifically, targeted tariff rebates implemented in accordance with the TAR NC – instead of ad-hoc, route-specific discounts. Such measures would strengthen Ukraine’s security of supply while maintaining the transparency, consistency, and non-discriminatory principles of the EU gas market framework. Energy Traders Europe stands ready to engage with RAEEY and all Route 1 stakeholders to identify practical, market-based approaches that facilitate competitive and efficient gas flows to Ukraine without distorting price signals or compromising EU market integrity.
