It is noted that the LNG Truck Loading Service to be provided by the Operator in the context of the above test will exceptionally include the cool-down of the LNG Truck(s). Upon completion of the loading of the LNG Truck(s), the Operator shall determine the Final LNG Truck Filling Quantity and communicate it to the respective TL User(s)

Article 89Ζ of the Code.

The LNG Truck(

  1. s)Loading service, including the cooling of the LNG Truck(s), as part of this test, is expected to be completed within 16 hours of the arrival of the Truck(
  2. s)at Revithousa Island and will be provided at no remuneration for the Operator. Therefore, it is not required that the TL User(
  3. s)participating in the performance test provide a Guarantee for the provision of the Truck Loading service,

Article 89H of the Code and Article 7 of the TL Agreement.

(08)Furthermore, the Operator will compensate the TL User in case of partial filling of the LNG Truck, for the quantity not loaded on it, at a unit price of 50 €/MWh. It is clarified that in the event that it is not possible to load an LNG Truck within the framework of the above test, the performance test will be considered unsuccessful and the Operator will not be liable to the LNG User participating in such test. With reference to the above, we propose: 1. The announcement of the allocation to TL Users of two LNG Truck Loading Slots, exclusively for the purpose of performing the TL Facility performance test, notwithstanding the provisions of Article 89Γ par. 1 of the Code, within the framework of the booking of which the LNG Truck Cooling-down Service will be provided, in addition to those referred to in Article 89A par. 1 of the Code. 2. The provision of the relevant services to TL Users, within the framework of the reservation of the aforementioned Slots for Loading LNG Trucks, without remuneration for the Operator, notwithstanding the provisions of Articles 89A, par. 6 and 89Γ, par. 10 of the Code and Article 6 of the TL Agreement and, respectively, the non-payment of a fee by the Operator to the LNG Terminal User(
  1. s)for its (their) participation in carrying out the test. 3. Not applying, by way of derogation, the provisions of Articles 89A, par. 6, 89Γ, par. 3 and 89H of the Code and Article 7 of the TL Agreement, regarding the provision by the LNG User(
  2. s)of a Guarantee for the TL service to be provided by the Operator within the framework of the performance test of the TL Facility. 4. In addition to what is provided for in the Code and the TL Agreement: a. the non-liability of the Operator and the non-payment of compensation to TL Users, in the event that the loading of an LNG Truck, that they will make available for the execution of the performance test is not carried out or is not successful b. the payment of compensation to TL Users, exclusively and only in the event of partial loading of LNG Trucks that they will make available for the execution of the performance test. This compensation will be calculated as the product of the Quantity less than the LNG Truck's Filling Quantity announced by the Operator on its website, assuming a tolerance of 10% and a unit price of 50 €/MWh. No other compensation will be due by the Operator on this account. c. the provision of cooling-down services for the LNG Trucks, in addition to those referred to in Article 89A par. 1 of the Code. d. the provision of the LNG Truck(
  3. s)loading service, including the cooling-down of the LNG Truck(s), as part of this test, which is expected to be completed within 16 hours of the arrival of the Truck(
  4. s)at Revithοusa Island. 5. The preparation of a separate agreement between the Operator and the TL User(
  5. s)who will participate in the TL Facility performance test, whereby the parties will agree to the deviations from and additions to the Code and the TL Agreement for the purposes of the test, as approved by the RAE. 6. In all other respects, the relevant provisions of the Code and the TL Agreement, entered into with the TL User, including the provisions thereof on the liability of the parties under Article 8 of the TL Agreement, shall apply. (08)For the purpose of conducting the aforementioned performance test, please approve that, notwithstanding the NNGS Code and the standard Agreement for the use of the LNG Facility for the loading of LNG Trucks and exclusively for this particular circumstance, that: (A) the above mentioned articles of the Code and the terms of the standard TL Agreement under items 1-3 will not be applied; (B) item 4 above will be applied in addition; and (C) a separate agreement will be drawn up between the Operator and the TL User reflecting the above, which will be brought to the attention of the Authority.
