ΑΠΟΦΑΣΗ ΚΛΑΔΟΥ ΕΝΕΡΓΕΙΑΣ ΤΗΣ ΡΑΑΕΥ ΥΠ’ ΑΡΙΘΜ. Ε-181/2023

Ε-181/2023 Για την Κοινή Απόφαση των Ρυθμιστών Ελλάδας, Κύπρου και Ιταλίας επί του Αιτήματος Επένδυσης της εταιρείας IGI Poseidon S.A. και του επιμερισμού του επενδυτικού κόστους για το Έργο Κοινού Ενδιαφέροντος 7.3.1 «Αγωγός μεταφοράς από τα αποθέματα φυσικού αερίου της Ανατολικής Μεσογείου προς την ενδοχώρα της Ελλάδας μέσω της Κύπρου και της Κρήτης [έργο επί του παρόντος γνωστό ως EastMed Pipeline], με σταθμό μέτρησης και ρύθμισης στη Μεγαλόπολη», σύμφωνα με το άρθρο 12 του Κανονισμού (ΕΕ) αριθ. 347/2013 Η Σύνθεση του Κλάδου Ενέργειας της Ρυθμιστικής Αρχής Αποβλήτων, Ενέργειας και Υδάτων Κατά την τακτική συνεδρίαση της στην έδρα της Αρχής, στις 25 Οκτωβρίου 2023, και Λαμβάνοντας υπόψη:

  1. Τις διατάξεις του ν. 5037/2023 «Μετονομασία της Ρυθμιστικής Αρχής Ενέργειας σε Ρυθμιστική Αρχή Αποβλήτων, Ενέργειας και Υδάτων και διεύρυνση του αντικειμένου της με αρμοδιότητες επί των υπηρεσιών ύδατος και της διαχείρισης αστικών αποβλήτων, ενίσχυση της υδατικής πολιτικής - Εκσυγχρονισμός της νομοθεσίας για τη χρήση και παραγωγή ηλεκτρικής ενέργειας από ανανεώσιμες πηγές μέσω της ενσωμάτωσης των Οδηγιών ΕΕ 2018/2001 και 2019/944 - Ειδικότερες διατάξεις για τις ανανεώσιμες πηγές ενέργειες και την προστασία του περιβάλλοντος» (ΦΕΚ Α΄ 78/28.03.2023), όπως ισχύει, και ιδίως τα άρθρα 1-

  3. Τις διατάξεις του ν. 4001/2011 «Για τη λειτουργία των Ενεργειακών Αγορών Ηλεκτρισμού και Φυσικού Αερίου για Έρευνα, Παραγωγή και δίκτυα μεταφοράς Υδρογονανθράκων και άλλες ρυθμίσεις» (ΦΕΚ Α΄ 179) ), όπως ισχύει, και ιδίως τα άρθρα 21, 22 και 25 αυτού.
  4. Τις διατάξεις της Οδηγίας (ΕΚ) 2009/73 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου της 13ης Ιουλίου 2009 «σχετικά με τους κοινούς κανόνες για την εσωτερική αγορά φυσικού αερίου και την κατάργηση της Οδηγίας 2003/55/ΕΚ» (L 211, 14.08.2009), όπως ισχύει.
  5. Τον Κανονισμό (ΕΕ) 347/2013 «σχετικά με τις κατευθυντήριες γραμμές για τις διευρωπαϊκές ενεργειακές υποδομές, την κατάργηση της απόφασης αριθ. 1364/2006/ΕΚ και την τροποποίηση των κανονισμών (ΕΚ) αριθ. 713/2009, (ΕΚ) αριθ. 714/2009 και (ΕΚ) αριθ. 715/2009», και ιδίως το άρθρο 12 αυτού, όπως ισχύει.
  6. Τον κατ’ εξουσιοδότηση Κανονισμό 2022/564 (ΕΕ) της Επιτροπής της 19ης Νοεμβρίου 2021 «για την τροποποίηση του κανονισμού (ΕΕ) αριθ. 347/2013 του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου όσον αφορά τον ενωσιακό κατάλογο έργων κοινού ενδιαφέροντος».
  7. Τον Κανονισμό (ΕΕ) 2022/869 «σχετικά με τις κατευθυντήριες γραμμές για τις διευρωπαϊκές ενεργειακές υποδομές, την τροποποίηση των κανονισμών (ΕΚ) αριθ. 715/2009, (ΕΕ) 2019/942 και (ΕΕ) 2019/943 και των οδηγιών 2009/73/ΕΚ και (ΕΕ) 2019/944 και την κατάργηση του κανονισμού (ΕΕ) αριθ. 347/2013», και ιδίως τα άρθρα 16, 24, 31 και 32 αυτού.
  8. Την υπ’ αριθμ. 5/2015 Σύσταση του Οργανισμού Συνεργασίας των Ρυθμιστικών Αρχών Ενέργειας (ACER-εφεξής Οργανισμός) «On good practices for the treatment of the investment requests including cross border cost allocation (CBCA) requests for electricity and gas projects of common interest (PCI)».

  15. Την υπ΄ αριθμ. πρωτ. Ο-103486/30.06.2023 επιστολή της ΡΑΑΕΥ, ως συντονίστριας Αρχής και εκ μέρους και των Ρυθμιστικών Αρχών Κύπρου και Ιταλίας, προς την IGI Poseidon S.A. με θέμα «Investment Request of IGI Poseidon regarding the EastMed Pipeline Project», με την οποία ζητήθηκαν συμπληρωματικά στοιχεία.

  21. Την υπ’ αριθμ. πρωτ. 4439/17.10.2023 επιστολή της εταιρείας IGI Poseidon S.A. με την οποία παρασχέθηκαν συμπληρωματικά στοιχεία (ΡΑΑΕΥ Ι-360126/18.10.2023).
  22. Την από 17.10.2023 ηλεκτρονική επιστολή της IGI Poseidon S.A. (ΡΑΑΕΥ Ι360122/18.10.2023, εμπιστευτικό).
  23. Τις διαβουλεύσεις της ΡΑAΕY με τις Ρυθμιστικές Αρχές Ενέργειας της Κύπρου (ΡΑΕΚ) και της Ιταλίας (ARERA).
  24. Το γεγονός ότι η παρούσα απόφαση δεν προκαλεί δαπάνη στον Κρατικό Προϋπολογισμό. 3 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Σκέφτηκε ως εξής: Α. Νομικό πλαίσιο Επειδή, η ΡΑΕ σύμφωνα με την παράγραφο 1 του άρθρου 22 του Νόμου 4001/2011 «παρακολουθεί και εποπτεύει τη λειτουργία της αγοράς ενέργειας, […] αποφασίζει […] τη λήψη αναγκαίων μέτρων, συμπεριλαμβανομένης της έκδοσης κανονιστικών και ατομικών πράξεων, ιδίως για την τήρηση των κανόνων του ανταγωνισμού και των ρυθμιστικών υποχρεώσεων που τίθενται με τον παρόντα νόμο, την Προστασία των Καταναλωτών, την εκπλήρωση υποχρεώσεων παροχής υπηρεσιών κοινής ωφέλειας, την προστασία του περιβάλλοντος, την ασφάλεια εφοδιασμού και την ανάπτυξη της εσωτερικής αγοράς ενέργειας της Ευρωπαϊκής Ένωσης…». Συναφώς, σύμφωνα με τις παραγράφους 2 και 5 του άρθρου 25 του Νόμου 4001/2011 : «
  25. Η ΡΑΕ συμβάλλει με κάθε τρόπο στην ανάπτυξη της εσωτερικής αγοράς ενέργειας και στην προαγωγή του υγιούς ανταγωνισμού σε αυτή, συνεργαζόμενη με τις ρυθμιστικές αρχές των κρατών μελών της Ευρωπαϊκής Ένωσης και άλλες ρυθμιστικές αρχές, ιδίως στην περιοχή της Ενεργειακής Κοινότητας, της Μαύρης Θάλασσας και της Μεσογείου, καθώς και με τον Οργανισμό Συνεργασίας Ρυθμιστικών Αρχών Ενέργειας, την Ευρωπαϊκή Επιτροπή, τα όργανα της Ενεργειακής Κοινότητας και διεθνείς οργανισμούς, και ιδίως:. [...]
  26. Η ΡΑΕ διαβουλεύεται και συνεργάζεται για διασυνοριακά θέματα με τις ρυθμιστικές αρχές ενέργειας άλλων κρατών - μελών της Ευρωπαϊκής Ένωσης και της Ενεργειακής Κοινότητας, καθώς και τρίτων χωρών με τα συστήματα των οποίων διασυνδέονται τα Συστήματα Μεταφοράς της Ελλάδος, με τον Οργανισμό Συνεργασίας Ρυθμιστικών Αρχών Ενέργειας και την Ευρωπαϊκή Επιτροπή, και ιδίως για: (α) Την προώθηση της δημιουργίας λειτουργικών διευθετήσεων, ώστε να παρέχεται η δυνατότητα για βέλτιστη διαχείριση του συστήματος, να προωθείται η ανάπτυξη κοινών χρηματιστηρίων ηλεκτρικής ενέργειας και φυσικού αερίου και η διασυνοριακή κατανομή δυναμικότητας, καθώς και να παρέχεται η δυνατότητα επαρκούς επιπέδου δυναμικού διασύνδεσης, μέσω και νέων Διασυνδέσεων, σε περιφερειακό επίπεδο και μεταξύ περιφερειών, ώστε να καθίσταται εφικτή η ανάπτυξη υγιούς ανταγωνισμού και η βελτίωση της ασφάλειας του εφοδιασμού, χωρίς διακρίσεις μεταξύ προμηθευτών σε διάφορα κράτη - μέλη. (β) Τον συντονισμό της ανάπτυξης όλων των κωδίκων δικτύου και των κατευθυντήριων γραμμών για τους σχετικούς φορείς εκμετάλλευσης συστημάτων μεταφοράς και άλλους παράγοντες της αγοράς, καθώς και την ανάπτυξη κοινών κανόνων σχετικά με την κατανομή δυναμικότητας και διαχείρισης της συμφόρησης στις διασυνδέσεις. (γ) Τη διασφάλιση της συνεπούς εφαρμογής της Οδηγίας 2009/73/ΕΚ στο έδαφος των κρατών μελών, προκειμένου για υποδομή φυσικού αερίου προς και από τρίτη χώρα, το πρώτο σημείο διασύνδεσης της οποίας με το δίκτυο των κρατών μελών ευρίσκεται στην Ελλάδα. (δ) Τη διασφάλιση της συνεπούς εφαρμογής της Οδηγίας 2009/73/ΕΚ στο έδαφος και στα χωρικά ύδατα της Ελλάδας, προκειμένου για την εκμετάλλευση των υποδομών φυσικού αερίου προς και από τρίτες χώρες.». Επειδή, ο Κανονισμός (ΕΕ) αριθ. 347/2013 (σχετ. 4,) έθεσε το πλαίσιο για την έγκαιρη ανάπτυξη και διαλειτουργικότητα των διευρωπαϊκών ενεργειακών δικτύων , 4 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ προκειμένου για την επίτευξη των στόχων της ενεργειακής πολιτικής της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης (ΣΛΕΕ), μεταξύ των οποίων η διασφάλιση της λειτουργίας της εσωτερικής ενεργειακής αγοράς, η ασφάλεια του εφοδιασμού στην Ένωση και η περαιτέρω διασύνδεση των ενεργειακών δικτύων. Η ανάπτυξη των διασυνοριακών διασυνδέσεων επιφέρει, μεταξύ άλλων και την προσφορά όλων των πηγών ενεργείας στη χαμηλότερη δυνατή τιμή τόσο για τους καταναλωτές όσο και για τη βιομηχανία στην Ευρωπαϊκή Ένωση. Υπό το πρίσμα των ανωτέρω σκοπών, ο εν λόγω Κανονισμός εισήγαγε την έννοια του Έργου Κοινού Ενδιαφέροντος (ΕΚΕ, Project of Common Interest, PCI), το οποίο ορίζεται ως το έργο εκείνο που είναι «απαραίτητο για την υλοποίηση των διαδρόμων και ζωνών ενεργειακών υποδομών προτεραιότητας που καθορίζονται στο παράρτημα Ι το οποίο περιλαμβάνεται στον κατάλογο έργων κοινού ενδιαφέροντος που ισχύει για όλη την Ένωση, ο οποίος ορίζεται στο άρθρο 3·» (άρθρο 2 του Κανονισμού). Ωσαύτως, ο Κανονισμός 347/2013 «προβλέπει τον προσδιορισμό των απαραίτητων έργων κοινού ενδιαφέροντος για την υλοποίηση των διαδρόμων και ζωνών προτεραιότητας, […] διευκολύνει την έγκαιρη υλοποίηση των έργων κοινού ενδιαφέροντος με τον εξορθολογισμό, τον στενότερο συντονισμό και την επιτάχυνση των διαδικασιών αδειοδότησης και με την αύξηση της συμμετοχής των πολιτών, προβλέπει κανόνες και καθοδήγηση για τον διασυνοριακό επιμερισμό του κόστους και κίνητρα σχετικά με τον κίνδυνο σε ό,τι αφορά τα έργα κοινού ενδιαφέροντος και καθορίζει τις προϋποθέσεις επιλεξιμότητας των έργων κοινού ενδιαφέροντος για χρηματοδοτική στήριξη από την Ένωση» (άρθρο 1). Με τον ως άνω Κανονισμό καθορίσθηκαν περαιτέρω οι βασικές μεθοδολογικές αρχές για την εναρμονισμένη ανάλυση κόστους οφέλους, καθώς και καταρτίσθηκε ο κατάλογος έργων κοινού ενδιαφέροντος (ΕΚΕ). Επειδή, για τα έργα με διασυνοριακό αντίκτυπο, που έχουν περιληφθεί στον ενωσιακό κατάλογο ως έργα κοινού ενδιαφέροντος, υποβάλλεται από τον Φορέα Υλοποίησης του έργου (Project Promoter) προς τις εμπλεκόμενες εθνικές ρυθμιστικές αρχές, και μετά από σχετική διαβούλευση με τους αρμόδιους εθνικούς Διαχειριστές Συστημάτων Μεταφοράς (ΔΣΜ), αίτημα επένδυσης (Investment Request), εφόσον το έργο έχει φτάσει σε επαρκή βαθμό ωριμότητας. Το αίτημα περιλαμβάνει και αίτημα για διασυνοριακό επιμερισμό κόστους, ειδική ανάλυση κόστους οφέλους και επιχειρηματικό σχέδιο βιωσιμότητας. Επειδή, η υλοποίηση, κατασκευή και λειτουργία των έργων κοινού ενδιαφέροντος, με διασυνοριακό αντίκτυπο, δύναται να επιφέρει κόστος για τα διασυνδεόμενα κράτη μέλη, το οποίο, σύμφωνα με τον ως άνω Κανονισμό, θα πρέπει κατά κανόνα να καλύπτεται από τους χρήστες του έργου. Η αρμοδιότητα για τον επιμερισμό του Κόστους σύμφωνα με το άρθρο 12 του ως άνω Κανονισμού αποδίδεται στις αρμόδιες ρυθμιστικές αρχές οι οποίες, εντός έξι

(6)μηνών από την ημερομηνία παραλαβής του πλήρους φακέλου της επένδυσης, οφείλουν να προβούν «σε αποφάσεις σχετικά με «τον επιμερισμό του επενδυτικού κόστους που θα βαρύνει κάθε φορέα εκμετάλλευσης συστήματος για το έργο, καθώς επίσης και για τη συμπερίληψή του στα τιμολόγια». Κατά την απόφαση αυτή, σύμφωνα με την παράγραφο 5 του ως άνω άρθρου 12 του Κανονισμού 347/2013, λαμβάνεται υπόψη το οικονομικό, κοινωνικό και περιβαλλοντικό κόστος, αλλά και τα αντίστοιχα οφέλη που αποκομίζει κάθε κράτος 5 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ μέλος από την υλοποίηση του έργου. Ειδικότερα αναφέρονται στη σχετική απόφαση επιμερισμού η αξιολόγηση του επιχειρηματικού σχεδίου, οι επιπτώσεις στα τιμολόγια των δικτύων, οι θετικές επιδράσεις του έργου σε εθνικό και περιφερειακό επίπεδο αλλά και τα αποτελέσματα της διαβούλευσης με τους εμπλεκόμενους φορείς. Επειδή, αναλυτικότερα, το άρθρο 12 του Κανονισμού «Διευκόλυνση των επενδύσεων με διασυνοριακό αντίκτυπο», περιλαμβάνει συγκεκριμένα τις ακόλουθες ρυθμίσεις : «
  1. Οι πράγματι προκύψασες επενδυτικές δαπάνες, από τις οποίες εξαιρούνται οι δαπάνες συντήρησης, που σχετίζονται με έργο κοινού ενδιαφέροντος που εμπίπτει στις κατηγορίες που αναφέρονται στο παράρτημα ΙΙ σημείο 1 στοιχεία α), β) και δ) και στο παράρτημα ΙΙ σημείο 2 βαρύνουν τους αντίστοιχους ΔΣΜ ή τους φορείς υλοποίησης των υποδομών μεταφοράς των κρατών μελών όπου εντοπίζονται τα καθαρά θετικά αποτελέσματα του έργου και, στον βαθμό που δεν καλύπτονται από μισθώματα συμφόρησης ή άλλα τέλη, καταβάλλονται από τους χρήστες του δικτύου μέσω των τιμολογίων πρόσβασης στα δίκτυα σε αυτά τα κράτη μέλη.
  2. Για ένα έργο κοινού ενδιαφέροντος που εμπίπτει στις κατηγορίες που αναφέρονται στο παράρτημα ΙΙ σημείο 1 στοιχεία α), β) και δ) και στο παράρτημα ΙΙ σημείο 2, οι διατάξεις της παραγράφου 1 εφαρμόζονται μόνον εφόσον τουλάχιστον ένας φορέας υλοποίησης έργου ζητήσει από τις αρμόδιες εθνικές αρχές την εφαρμογή του παρόντος άρθρου για ολόκληρο το κόστος του έργου ή μέρος αυτού. Για ένα έργο κοινού ενδιαφέροντος που εμπίπτει στις κατηγορίες του παραρτήματος ΙΙ σημείο 2, οι διατάξεις της παραγράφου 1 εφαρμόζονται μόνον εφόσον έχει ήδη διενεργηθεί αξιολόγηση της ζήτησης στην αγορά και διαπιστώθηκε ότι οι πράγματι προκύψασες επενδυτικές δαπάνες δεν αναμένεται να καλυφθούν από τα τιμολόγια. Όταν υπάρχουν περισσότεροι του ενός φορείς υλοποίησης για ένα έργο, οι οικείες εθνικές ρυθμιστικές αρχές ζητούν αμελλητί από όλους τους φορείς υλοποίησης να υποβάλουν από κοινού το αίτημα επένδυσης σύμφωνα με την παράγραφο
  3. Για ένα έργο κοινού ενδιαφέροντος στο οποίο εφαρμόζονται οι διατάξεις της παραγράφου 1, οι φορείς υλοποίησης του έργου ενημερώνουν τακτικά, τουλάχιστον μία φορά ανά έτος και εωσότου το έργο τεθεί σε λειτουργία, όλες τις εμπλεκόμενες εθνικές ρυθμιστικές αρχές σχετικά με την πρόοδο του έργου και τον προσδιορισμό του κόστους και των συνεπειών που επιφέρει. Μόλις ένα τέτοιο έργο φτάσει σε επαρκή βαθμό ωριμότητας, οι φορείς υλοποίησης του έργου, μετά από διαβούλευση με τους ΔΣΜ από όλα τα κράτη μέλη όπου εντοπίζονται τα καθαρά θετικά αποτελέσματα του έργου, υποβάλλουν αίτημα επένδυσης. Αυτό το αίτημα επένδυσης περιλαμβάνει αίτημα για διασυνοριακό επιμερισμό κόστους και υποβάλλεται σε όλες τις εμπλεκόμενες εθνικές ρυθμιστικές αρχές μαζί με τα εξής: α) ειδική ανάλυση κόστους-οφέλους του έργου που συνάδει με τη μεθοδολογία που καταρτίζεται δυνάμει του άρθρου 11 και λαμβάνει υπόψη τα πέραν των συνόρων του εμπλεκόμενου κράτους μέλους οφέλη· β) επιχειρηματικό σχέδιο που αξιολογεί την οικονομική βιωσιμότητα του έργου, συμπεριλαμβανομένου του επιλεχθέντος τρόπου χρηματοδότησης, και, για ένα έργο κοινού ενδιαφέροντος που εμπίπτει στην κατηγορία του παραρτήματος ΙΙ σημείο 2, τα αποτελέσματα της δοκιμής αγοράς· και γ) αν είναι δυνατή η συμφωνία των φορέων υλοποίησης του έργου, τεκμηριωμένη πρόταση για διασυνοριακό επιμερισμό του κόστους. 6 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Εάν έργο υλοποιείται από διάφορους φορείς εκμετάλλευσης, το αίτημα επένδυσης υποβάλλεται από κοινού. Για τα έργα που περιλαμβάνονται στον πρώτο ενωσιακό κατάλογο έργων, οι φορείς υλοποίησης υποβάλλουν το αίτημα επένδυσής τους έως την 31η Οκτωβρίου
  4. Οι εθνικές ρυθμιστικές αρχές διαβιβάζουν αμελλητί ένα αντίγραφο κάθε αιτήματος επένδυσης, μόλις το λάβουν, στον Οργανισμό προς ενημέρωση αυτού. Οι εθνικές ρυθμιστικές αρχές και ο Οργανισμός διαφυλάσσουν τον εμπιστευτικό χαρακτήρα των εμπορικώς ευαίσθητων πληροφοριών.
  5. Εντός έξι μηνών από την ημερομηνία παραλαβής του τελευταίου αιτήματος επένδυσης από τις εμπλεκόμενες εθνικές ρυθμιστικές αρχές, οι εθνικές ρυθμιστικές αρχές, κατόπιν διαβούλευσης με τους εμπλεκόμενους φορείς υλοποίησης του έργου, λαμβάνουν συντονισμένες αποφάσεις σχετικά με τον επιμερισμό του επενδυτικού κόστους που θα βαρύνει κάθε φορέα εκμετάλλευσης συστήματος για το έργο, καθώς επίσης και σχετικά με την συμπερίληψή του στα τιμολόγια. Οι εθνικές ρυθμιστικές αρχές μπορούν να αποφασίσουν τον επιμερισμό ενός μέρους μόνο των δαπανών ή μπορούν να αποφασίσουν να επιμερίσουν τις δαπάνες σε μια δέσμη διαφόρων έργων κοινού ενδιαφέροντος. Κατά τον επιμερισμό του κόστους, οι εθνικές ρυθμιστικές αρχές λαμβάνουν υπόψη τα τρέχοντα ή εκτιμώμενα: μισθώματα συμφόρησης ή άλλα τέλη, έσοδα από τον μηχανισμό αντιστάθμισης μεταξύ των διαχειριστών συστημάτων μεταφοράς που ιδρύθηκε δια του άρθρου 13 του κανονισμού (ΕΚ) αριθ. 714/
  6. Κατά την απόφαση διασυνοριακού επιμερισμού του κόστους, λαμβάνονται υπόψη το οικονομικό, κοινωνικό και περιβαλλοντικό κόστος, αλλά και τα αντίστοιχα οφέλη των έργων στα οικεία κράτη μέλη και η ενδεχόμενη ανάγκη χρηματοδοτικής στήριξης. Κατά την απόφαση διασυνοριακού επιμερισμού του κόστους, οι σχετικές εθνικές ρυθμιστικές αρχές, σε διαβούλευση με τους οικείους ΔΣΜ, επιδιώκουν την επίτευξη αμοιβαίας συμφωνίας που θα βασίζεται μεταξύ άλλων και στις πληροφορίες της παραγράφου 3 στοιχεία α) και β). Εάν ένα έργο κοινού ενδιαφέροντος μετριάζει αρνητικές εξωτερικές επιδράσεις, όπως ροές κλειστού βρόγχου, και το έργο αυτό εκτελείται στο κράτος μέλος στο οποίο δημιουργείται η αρνητική εξωτερική επίδραση, τέτοιος μετριασμός δεν θεωρείται διασυνοριακό όφελος και δεν συνιστά, ως εκ τούτου, βάση για τον επιμερισμό του κόστους στον ΔΣΜ των κρατών μελών που πλήττονται από αυτές τις αρνητικές εξωτερικές επιδράσεις.
  7. Οι εθνικές ρυθμιστικές αρχές, με βάση τον διασυνοριακό επιμερισμό του κόστους όπως ορίζεται στην παράγραφο 4 του παρόντος άρθρου, λαμβάνουν υπόψη τις πραγματικές δαπάνες που προκύπτουν για έναν ΔΣΜ ή άλλο φορέα υλοποίησης του έργου ως αποτέλεσμα των επενδύσεων κατά τον καθορισμό ή την έγκριση των τιμολογίων σύμφωνα με το άρθρο 37 παράγραφος 1 στοιχείο α) της οδηγίας 2009/72/ΕΚ και το άρθρο 41 παράγραφος 1 στοιχείο α) της οδηγίας 2009/73/ΕΚ, στο μέτρο που οι δαπάνες αυτές αντιστοιχούν στις δαπάνες ενός αποτελεσματικού και διαρθρωτικά συγκρίσιμου φορέα εκμετάλλευσης. Η απόφαση για τον επιμερισμό του κόστους κοινοποιείται, αμελλητί, από τις εθνικές ρυθμιστικές αρχές στον Οργανισμό μαζί με όλες τις σχετικές πληροφορίες. Ειδικότερα, αναφέρονται λεπτομερώς οι λόγοι βάσει των οποίων έγινε ο επιμερισμός του κόστους μεταξύ των κρατών μελών, όπως τα εξής: α) εκτίμηση των εντοπιζόμενων επιπτώσεων, μεταξύ άλλων σχετικά με τα τιμολόγια των δικτύων, για καθένα από τα εμπλεκόμενα κράτη μέλη· β) αξιολόγηση του επιχειρηματικού σχεδίου της παραγράφου 3 στοιχείο β)· γ) τις θετικές εξωτερικές επιδράσεις 7 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ του έργου σε περιφερειακό ή ενωσιακό επίπεδο· δ) το αποτέλεσμα της διαβούλευσης με τους εμπλεκόμενους φορείς υλοποίησης του έργου. Η απόφαση επιμερισμού του κόστους δημοσιεύεται.
  8. Αν οι εμπλεκόμενες εθνικές ρυθμιστικές αρχές δεν καταλήξουν σε συμφωνία σχετικά με το αίτημα επένδυσης εντός έξι μηνών από την ημερομηνία παραλαβής του αιτήματος από την τελευταία εθνική ρυθμιστική αρχή, ενημερώνουν αμελλητί τον Οργανισμό. Στην περίπτωση αυτή ή κατόπιν κοινού αιτήματος των εθνικών ρυθμιστικών αρχών, η απόφαση σχετικά με το επενδυτικό αίτημα, συμπεριλαμβανομένου του διασυνοριακού επιμερισμού του κόστους κατά την παράγραφο 3 καθώς και του τρόπου με τον οποίο το κόστος των επενδύσεων θα αντικατοπτρίζεται στα τιμολόγια, λαμβάνεται από τον Οργανισμό εντός τριών μηνών από την ημερομηνία της προσφυγής. Πριν αποφανθεί, ο Οργανισμός διαβουλεύεται με τις εμπλεκόμενες εθνικές ρυθμιστικές αρχές και τους φορείς υλοποίησης του έργου. Η περίοδος τριών μηνών που προβλέπεται στο δεύτερο εδάφιο μπορεί να επεκταθεί κατά δύο μήνες στην περίπτωση που ο Οργανισμός χρειάζεται επιπλέον πληροφορίες. Η επιπλέον προθεσμία αρχίζει την επομένη της ημέρας παραλαβής όλων των πληροφοριών. Η απόφαση επιμερισμού του κόστους δημοσιεύεται. Εφαρμόζονται εν προκειμένω τα άρθρα 19 και 20 του κανονισμού (ΕΚ) αριθ. 713/
  9. Ο Οργανισμός κοινοποιεί αμελλητί αντίγραφο όλων των αποφάσεων επιμερισμού του κόστους, καθώς και όλων των σχετικών πληροφοριών, στην Επιτροπή. Τα εν λόγω στοιχεία είναι δυνατόν να παρέχονται σε συγκεντρωτική μορφή. Η Επιτροπή διαφυλάσσει τον εμπιστευτικό χαρακτήρα των εμπορικώς ευαίσθητων πληροφοριών.
  10. Η απόφαση επιμερισμού του κόστους δεν επηρεάζει το δικαίωμα των ΔΣΜ να επιβάλουν επιβαρύνσεις για την πρόσβαση στο δίκτυο ούτε το δικαίωμα των εθνικών ρυθμιστικών αρχών να τις εγκρίνουν σύμφωνα με το άρθρο 32 των οδηγιών 2009/72/ΕΚ και 2009/73/ΕΚ, το άρθρο 14 του κανονισμού (ΕΚ) αριθ. 714/2009 και το άρθρο 13 του κανονισμού (ΕΚ) αριθ. 715/
  11. […] Επειδή, ο Κανονισμός (ΕΕ) αριθ. 347/2013 αντικαταστάθηκε από τον Κανονισμό (ΕΕ) αριθ. 2022/869 (σχετ. 8), με ισχύ από την 23η Ιουνίου
  12. Ωστόσο, σύμφωνα με το άρθρο 32 του τελευταίου: «… το παράρτημα VII του κανονισμού (ΕΕ) αριθ. 347/2013, όπως τροποποιήθηκε με τον κατ’ εξουσιοδότηση κανονισμό (ΕΕ) 2022/564 της Επιτροπής, το οποίο περιέχει τον πέμπτο ενωσιακό κατάλογο έργων κοινού ενδιαφέροντος, καθώς και τα άρθρα 2 έως 10, τα άρθρα 12, 13 και 14, τα παραρτήματα I έως IV και το παράρτημα VI του κανονισμού (ΕΕ) αριθ. 347/2013 παραμένουν σε ισχύ και παράγουν αποτελέσματα όσον αφορά τα έργα κοινού ενδιαφέροντος που περιλαμβάνονται στον πέμπτο ενωσιακό κατάλογο έως την έναρξη ισχύος του πρώτου ενωσιακού καταλόγου έργων κοινού ενδιαφέροντος και έργων αμοιβαίου ενδιαφέροντος που καταρτίζεται δυνάμει του παρόντος κανονισμού.». Επειδή, περαιτέρω, σύμφωνα με το άρθρο 24 παρ. 1 του ίδιου ως άνω Κανονισμού : «Στην περίπτωση της Κύπρου και της Μάλτας, οι οποίες δεν είναι διασυνδεδεμένες με το διευρωπαϊκό δίκτυο αερίου, εφαρμόζεται παρέκκλιση από το άρθρο 3, το άρθρο 4 8 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ παράγραφος 1 στοιχεία α) και β), το άρθρο 4 παράγραφος 5, το άρθρο 16 παράγραφος 4 στοιχείο α) και τα παραρτήματα I, II και III, με την επιφύλαξη του άρθρου 32 παράγραφος
  13. Μία διασύνδεση για καθένα από τα εν λόγω κράτη μέλη διατηρεί το καθεστώς έργου κοινού ενδιαφέροντος δυνάμει του παρόντος κανονισμού με όλα τα σχετικά δικαιώματα και υποχρεώσεις, όταν η εν λόγω διασύνδεση: α) η εν λόγω διασύνδεση βρίσκεται στο στάδιο της ανάπτυξης ή του σχεδιασμού την 23η Ιουνίου 2022, β) στην η εν λόγω διασύνδεση έχει χορηγηθεί καθεστώς έργου κοινού ενδιαφέροντος δυνάμει του κανονισμού (ΕΕ) αριθ. 347/2013 και γ) η εν λόγω διασύνδεση είναι απαραίτητη για να εξασφαλιστεί η μόνιμη διασύνδεση των εν λόγω κρατών μελών με το διευρωπαϊκό δίκτυο φυσικού αερίου. Τα εν λόγω έργα αυτά διασφαλίζουν τη μελλοντική ικανότητα πρόσβασης σε νέες αγορές ενέργειας, συμπεριλαμβανομένου του υδρογόνου.». Επειδή, τέλος, αναφορικά με τα βασικά στοιχεία ενός αιτήματος επένδυσης (Investment Request), όπως αυτά προσδιορίζονται στο άρθρο 122 παρ. 3 του Κανονισμού (ΕΕ) αριθ. 347/2013, ο Οργανισμός εξέδωσε σχετικές κατευθυντήριες οδηγίες υπό την μορφή Σύστασης (Recommendation 5/2015, σχετ. 7, και στη συνέχεια Recommendation 2/2023 βάσει του Κανονισμού (ΕΕ) 2022/869, σχετ. 8), με τις οποίες εξειδικεύονται και επεξηγούνται τα προαπαιτούμενα για την πλήρη στοιχειοθέτηση του αιτήματος, ώστε τόσο οι Φορείς Υλοποίησης να μεριμνούν για την κατάλληλη προετοιμασία του φακέλου της επένδυσης και την υποβολή τεκμηριωμένων αιτημάτων όσο και οι αρμόδιες Ρυθμιστικές Αρχές να κρίνουν βάσει ομοιόμορφων και ενιαίων κριτηρίων και οδηγιών. Β. Επί του αιτήματος της εταιρείας IGI Poseidon S.A. Επειδή, η εταιρεία IGI Poseidon S.A.3 είναι ο Φορέας Υλοποίησης του έργου “EastMed Pipeline”, το οποίο είχε περιληφθεί από το έτος 2013 στους καταλόγους Έργων Κοινού Ενδιαφέροντος του Κανονισμού (ΕΕ) 347/2013, όπως στη συνέχεια τροποποιήθηκε και επικαιροποιήθηκε (σχετ. 5-7) αναφορικά με τον ενωσιακό κατάλογο έργων κοινού ενδιαφέροντος, διατηρείται, δε. μέχρι και σήμερα στον ισχύοντα, κατά τα προαναφερθέντα, 5ο ενωσιακό κατάλογο. Συγκεκριμένα, περιλαμβάνεται στο Παράρτημα VII του Κανονισμού (ΕΕ) αριθ. 347/2013, ο οποίος έχει αντικατασταθεί, κατά τα ανωτέρω, από τον κατ’ εξουσιοδότηση Κανονισμό 2022/564 (σχετ. 5), με ρητή πρόβλεψη στο άρθρο 32 αυτού περί της διατήρησης σε ισχύ του εν λόγω Παραρτήματος, και κατατάσσεται σε αυτό ως το έργο 7.3.1: «Αγωγός μεταφοράς από τα αποθέματα φυσικού αερίου της Ανατολικής Μεσογείου προς την ενδοχώρα της Ελλάδας μέσω της Κύπρου και της Κρήτης [έργο επί του παρόντος γνωστό ως EastMed Pipeline], με σταθμό μέτρησης και ρύθμισης στη Μεγαλόπολη» (εφεξής, το «Έργο»). 2 Το οποίο παρατίθεται ανωτέρω και, ως έχει σημειωθεί, διατηρείται σε ισχύ και μετά την αντικατάσταση του Κανονισμού 347/2013 από τον Κανονισμού (ΕΕ) 2022/869 και σύμφωνα με το άρθρο 32 αυτού. 3 Στη μετοχική σύνθεση της «IGI Poseidon S.A.» συμμετέχουν, με ποσοστό 50% αμφότερες, οι εταιρείες «ΔΕΠΑ Διεθνών Έργων Α.Ε.» και «Edison SpA» 9 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Επειδή, το Έργο ανήκει στη Δέσμη ΕΚΕ (PCI cluster) στις υποδομές μεταφοράς νέου φυσικού αερίου από τα αποθέματα φυσικού αερίου της Ανατολικής Μεσογείου, η οποία περιλαμβάνει: 7.3.1: Αγωγός μεταφοράς από τα αποθέματα φυσικού αερίου της Ανατολικής Μεσογείου προς την ενδοχώρα της Ελλάδας μέσω της Κύπρου και της Κρήτης [έργο επί του παρόντος γνωστό ως EastMed Pipeline], με σταθμό μέτρησης και ρύθμισης στη Μεγαλόπολη και εξαρτώμενα από το έργο αυτό τα ακόλουθα ΕΚΕ: 7.3.3: Αγωγός υπεράκτιου φυσικού αερίου μεταξύ Ελλάδας και Ιταλίας [έργο επί του παρόντος γνωστό ως Poseidon Pipeline] 7.3.4: Ενίσχυση της εσωτερικής δυναμικότητας μεταφοράς στην Ιταλία, η οποία περιλαμβάνει ενίσχυση της εσωτερικής δυναμικότητας μεταφοράς από νότο προς βορρά [έργο επί του παρόντος γνωστό ως Adriatica Line] και ενίσχυση της εσωτερικής δυναμικότητας μεταφοράς στην περιφέρεια της Απουλίας [αγωγός Matagiola - Massafra]. Επειδή, το Έργο αποτελείται από περίπου 1.300 km υποθαλάσσιου και περίπου 500 km υπόγειου αγωγού που ξεκινά από σημείο διασύνδεσης με τον σχεδιαζόμενο αγωγό που θα μεταφέρει φυσικό αέριο από κοιτάσματα της νοτιοανατολικής Μεσογείου (ιδίως Κύπρου και Ισραήλ) στο σημείο που σύμφωνα με το διεθνές δίκαιο αποτελεί όριο Ευρωπαϊκών υδάτων, και καταλήγει στο Φλωροβούνι Ημαθίας. Πιο συγκεκριμένα, το Έργο αποτελείται από τρία κύρια τμήματα:
  14. Νότια Υποθαλάσσια Γραμμή – ξεκινάει από τα υποθαλάσσια κοιτάσματα της Κυπριακής Δημοκρατίας, μετά από μια διακλάδωση για είσοδο στην Κύπρο προχωρά προς την Κρήτη, όπου επανασυμπιέζεται και καταλήγει στη Μεγαλόπολη Αρκαδίας. Έχει δυναμικότητα 12bcm, ενώ η διακλάδωση προς την Κύπρο 1bcm.
  15. Βόρεια Υποθαλάσσια Γραμμή – δυναμικότητας 10bcm, ξεκινάει από τα υποθαλάσσια κοιτάσματα της Κυπριακής Δημοκρατίας και κείται παράλληλα με τη Νότια Γραμμή έως την Κρήτη, όπου ενώνεται με αυτή στον συμπιεστή. Κατόπιν, συνεχίζει έως τη Μεγαλόπολη.
  16. Υπόγεια Γραμμή – σχεδιασμένη να μεταφέρει το φυσικό αέριο και από την Νότια και από την Βόρεια Γραμμή (20bcm), ξεκινάει από την Μεγαλόπολη και καταλήγει στο Φλωροβούνι Θεσπρωτίας, όπου προβλέπεται να ενωθεί με τον υποθαλάσσιο αγωγό Poseidon Pipeline προς την Ιταλία. Επειδή, ο Φορέας Υλοποίησης υπέβαλε το Αίτημα Επένδυσης (Investment Request) (εφεξής και «το Αίτημα») στις Ρυθμιστικές Αρχές Ενέργειας της Ελλάδας (ΡΑΑΕΥ), της Κύπρου (ΡΑΕΚ ή CERA) και της Ιταλίας (ARERA). Το Έργο δεν χωροθετείται στην Ιταλία, ωστόσο επειδή ο κύριος όγκος του φυσικού αερίου σχεδιάζεται να διοχετεύεται στην Κεντρική Ευρώπη μέσω της Ιταλίας, ο Φορέας Υλοποίησης επέλεξε να θεωρήσει την ARERA ως αρμόδια Αρχή και να της απευθύνει επίσης το Αίτημα, το οποίο η ARERA αποδέχθηκε. Σημειώνεται ότι το Αίτημα αφορά αποκλειστικά το Έργο 7.3.1 και όχι τα λοιπά έργα του cluster. 10 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Επειδή, η ΡΑΑΕΥ ενημέρωσε τον ACER σχετικά με το υποβληθέν αίτημα, κατά τα οριζόμενα στην παράγραφο 3 του άρθρου 12 του Κανονισμού (ΕΕ) αριθ. 347/201 (σχετικό 12). Επειδή, οι τρεις Ρυθμιστικές Αρχές συμφώνησαν ότι η ΡΑΑΕΥ αποτελεί την «συντονιστική Αρχή» (“coordinating NRA”), κατά τα οριζόμενα στην παράγραφο 2.1 της Σύστασης του Οργανισμού (ΑCER Recommendation 5/2015, σχετ. 7), καθώς το μεγαλύτερο μέρος των επενδύσεων του έργου χωροθετείται στον Ελληνικό χώρο. Επειδή, οι τρεις Αρχές εξέτασαν το σύνολο των υποβληθέντων στοιχείων, ζητήθηκαν, δε, δύο φορές συμπληρωματικά στοιχεία και διευκρινίσεις από τον Φορέα Υλοποίησης (σχετ. 14 και 17). Γ. Επί της αξιολόγησης του αιτήματος της εταιρείας IGI Poseidon S.A. Επειδή, το Αίτημα αξιολογείται βάσει του Κανονισμού (ΕΕ) αριθ, 347/2013, ως έργο του 5ου καταλόγου ΕΚΕ, κατά τα οριζόμενα στο άρθρο 32 του Κανονισμού (ΕΕ) αριθ. 2022/
  17. Κατά την αξιολόγηση, οι Ρυθμιστές Ελλάδας, Κύπρου και Ιταλίας ακολούθησαν τις σχετικές Συστάσεις του Οργανισμού (σχετ. 9 και 10) . Επειδή, ειδικότερα, αναφορικά με το παραδεκτό του αιτήματος, οι Ρυθμιστές, κατόπιν σχετικής συνεργασίας, έκριναν τα ακόλουθα: Το Έργο εμπίπτει στην κατηγορία υποδομών του Παραρτήματος II.2(a) του ως άνω Κανονισμού και έχει περιληφθεί στον 5ο Ενωσιακό Κατάλογο των Έργων Κοινού Ενδιαφέροντος (σχετ. 5). Επίσης, δεν έχει λάβει καμία από τις εξαιρέσεις που αναφέρονται στην παρ. 9 του άρθρου 12 του Κανονισμού. Επομένως, το Έργο εμπίπτει στο γενικό πεδίο εφαρμογής του ανωτέρω άρθρου. Οι αρμόδιοι Ρυθμιστές επιβεβαίωσαν την πληρότητα του φακέλου της αίτησης, καθώς περιλαμβάνει όλα τα έγγραφα που απαιτούνται κατά την παρ. 3 του ως άνω άρθρου 12, ήτοι: i. Μελέτη Κόστους-Οφέλους για το συγκεκριμένο Έργο, ii. Επιχειρηματικό σχέδιο περιλαμβανομένων αποτελεσμάτων προκαταρκτικού ελέγχου της αγοράς (market test), iii. Πρόταση Διασυνοριακής Κατανομής Κόστους (Cross-Border Cost Allocation, CBCA). Περαιτέρω, οι ίδιες ανωτέρω διατάξεις προβλέπουν δύο προϋποθέσεις για την υποβολή Αιτήματος Επένδυσης: a. Το Έργο να έχει φτάσει σε επαρκές στάδιο ωρίμανσης: ο βαθμός ωρίμανσης κρίθηκε από τους Ρυθμιστές ως επαρκής, σύμφωνα με τα επιμέρους σημεία που αναφέρονται στην Ενότητα 1.2 της Σύστασης 5/2015 του Οργανισμού (ACER Recommendation, σχετ. 9,). Ιδιαίτερα επισημαίνεται ότι ο Φορέας Υλοποίησης έχει ολοκληρώσει τη Μελέτη FEED, βάσει της οποίας η εκτίμηση του κόστος περιορίζεται εντός διαστήματος αβεβαιότητας ±15%. b. Να έχει προηγηθεί διαβούλευση με τους Διαχειριστές των Συστημάτων Μεταφοράς των Κρατών-Μελών για τα οποία προκύπτει «σημαντική» καθαρή θετική επίπτωση (“significant 11 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ net positive impact”)4: επειδή δεν προκύπτει καθαρή θετική επίπτωση σε καμία από τις 3 χώρες, δεν απαιτείται η ικανοποίηση αυτής της διαδικαστικής προϋπόθεσης. Επειδή, σχετικά με το CBCA, όπως προαναφέρθηκε, σε καμία εκ των τριών χωρών δεν προκύπτει σημαντική καθαρή θετική επίπτωση, και συνεπώς ο Φορέας Υλοποίησης δεν αιτείται την κατανομή μέρους του κόστους του Έργου στους οικείους Διαχειριστές Συστημάτων Μεταφοράς. Δεδομένου αυτού, οι αρμόδιες Ρυθμιστικές Αρχές απηύθυναν ερώτημα στον Οργανισμό σχετικά με το εάν χρειάζεται να εκδοθεί (κοινή) απόφαση των Ρυθμιστικών Αρχών περί της Διασυνοριακής Κατανομής Κόστους (CBCA), επί του οποίου ο ACER γνωστοποίησε την ανάγκη έκδοσης σχετικής κοινής απόφασης των Ρυθμιστών για την πληρότητα του φακέλου του Έργου (σχετικά 13). Κατόπιν αυτού, οι Ρυθμιστές συνεργάστηκαν από κοινού και κατέληξαν σε συμφωνία για την έκδοση Κοινής Απόφασης περί του Αιτήματος Επένδυσης και της Διασυνοριακής Κατανομής του κόστους του Έργου σύμφωνα με την πρόταση του Φορέα Υλοποίησης, ήτοι κατανομή 0% στα Συστήματα Κύπρου, Ελλάδας και Ιταλίας. Επειδή, αναφορικά με την υποβληθείσα Μελέτη Κόστους-Οφέλους (CBA), επιβεβαιώνεται ότι έχει εκπονηθεί σύμφωνα με την προταθείσα Μεθοδολογία του ENTSOG (σχετικό 9). Τα οφέλη έχουν εκτιμηθεί σε συμφωνία με τα προβλεπόμενα στον Κανονισμό (ΕΕ) αριθ. 347/2013 και αφορούν την ολοκλήρωση των αγορών (Market integration) και ιδίως την άρση της απομόνωσης της αγοράς φυσικού αερίου της Κύπρου, την ασφάλεια εφοδιασμού, τον ανταγωνισμό και την προστασία του περιβάλλοντος (sustainability). Επειδή, ο Φορέας Υλοποίησης παρουσιάζει επαρκή ανάλυση του Επιχειρηματικού Σχεδίου του Έργου και τις εναλλακτικές ανάκτησης του κόστους του. Επειδή, τα ανωτέρω, αναλύονται διεξοδικά στην Κοινή Απόφαση για το Αίτημα Επένδυσης του Έργου και τη σχετική Διασυνοριακή Κατανομή Κόστους (CBCA), που έχει συμφωνηθεί μεταξύ των Ρυθμιστικών Αρχών Ενέργειας της Ελλάδας, της Κύπρου και της Ιταλίας, όπως αποτυπώνεται στο Παράρτημα της παρούσας απόφασης. Επειδή, στο πλαίσιο της διαβούλευσης των Ρυθμιστών με τον Φορέα Υλοποίησης που προβλέπεται στο άρθρο 12 παρ. 5(d) του Κανονισμού (ΕΕ) αριθ. 347/2013, το τελικό σχέδιο της προαναφερθείσας Κοινής Απόφασης των Ρυθμιστών κοινοποιήθηκε στον Φορέα Υλοποίησης. Τα σχόλιά του ελήφθησαν υπόψη στην οριστικοποίηση του κειμένου. Σε κάθε περίπτωση, ο φορέας Υλοποίησης δήλωσε ότι δεν έχει σχόλια επί της ουσίας της απόφασης. Επειδή, το Παράρτημα αποτελεί αναπόσπαστο μέρος της παρούσας. Για τους παραπάνω λόγους 4 Σύμφωνα με τη Σύσταση 5/2025 του ACER, σημαντική κρίνεται η επίπτωση σε μία χώρα αν υπερβαίνει το 10% της συνολικής οικονομικής επίπτωσης του Έργου. 12 ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Αποφασίζει

The information provided by the Project Promoter, in response to the requests of RAEWW acting as coordinating national regulatory authority. 10. The consultation with the Project Promoter; and 11. The notification letters to ACER by the Regulators. 12. The letter sent on 5.9.2023 by RAEWW as the coordinating authority, in line with ACER Guidelines 05/2015, to CINEA and the Directorate General for Energy ENER.C.4, noting the expected timeframe for issuing the decision on the Investment Request and asking to (
  1. a)consider and assess the Project Promoter’s application for CEF funding for the EastMed Pipeline Project and (
  2. b)consider the letter to fulfil a priori the CBCA requirements according to the TEN-E regulation until the Investment Request procedural process is completed, since all information regarding the CBCA part of the Investment Request was available by that time, given that no compensation has been requested by the Project Promoter from the transmission system operators of Cyprus, Greece, or Italy and no costs concerning PCI 7.3.1 are to be allocated to Cyprus, Greece, and Italy. have jointly assessed the Investment Request as per the provisions of article 12 of Regulation (EU) 347/2013. 1. CONTENT OF THE INVESTMENT REQUEST 1.1.Technical description IGI Poseidon S.A. (the “Project Promoter”) is developing the EastMed Pipeline project (the “Project”). The Project aims to integrate Cyprus and Crete to the European gas networks ending their energy isolation and increase the European energy security of supply. The Project route, constituted by ~1.300 km of offshore and ~500 km of onshore sections, starts from the interconnection points in the European waters with the planned pipeline for the stable and direct collection of gas sources available in the South-Eastern Mediterranean area (from Cyprus, Israel and, via the Israeli network, from Egypt and other countries), and ends in Greek Ionian coast in Florovouni. More specifically, the project consists of three main sections: 1. Southern Line – offshore pipeline that receives gas from the Cypriot offshore entry and transports it directly to a compressor station in Crete, passing through a subsea Inlet Tee Assembly (ITA) in Cyprus and via the offshore entry in Cyprus. At Crete, the gas is re-compressed for onwards transport across the Aegean Sea and Peloponnese to the North-West of Greece to connect to the Poseidon Offshore pipeline. The Southern Line of the EastMed pipeline system is designed for a transport capacity of 12 bcm/yr whereby a first offtake with a maximum capacity of 1 bcm/yr willbring gas to Cyprus for domestic consumption via a small-diameter subsea branch pipeline. 2. Northern Line – Offshore pipeline (separate from and parallel to the offshore sections of the Southern Line) from the collection point of Cypriot offshore gas sources to the compressor in Crete, with a re-compression in Cyprus. At Crete, the gas stream will ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ commingle with the gas stream from the Southern Line and will be re-compressed for onwards transport to Peloponnese via a dual pipeline system. The Northern Line will be designed for a transport capacity of 10 bcm/yr. 3. Onshore Line – Single pipeline system, sized for the transportation of the combined system (i.e., Southern and Northern Line), downstream of the landfall location in southeast Peloponnese until West Greece (Florovouni, Thesprotia area). The onshore line is designed for a transport capacity of up to 20 bcm/yr and requires an additional compression along the cross-country pipeline in Peloponnese. An offtake of up to 3 bcm/yr will be constructed in Megalopolis (central Peloponnese), where a tie-in to the Greek gas grid is planned, or in a different location along the onshore route, depending upon emerging market conditions and related technical evaluations. A detailed technical description of the project including justification for the main technological choices and a map of the planned project are included in the Investment Request. Considerations for making the project hydrogen-ready have also been included nevertheless the NRAs have assessed only the project as an infrastructure intended to transport natural gas. ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ As evidence for the initiation of the permitting process, the Project Promoter presented the letters of acceptance of the “Notification Dossier” by the competent authorities of both countries. In Cyprus, the application procedure will begin with the receival of the full list of permits required for the development and construction activities. Also, with the finalization of such as the ESIA report, the Permitting Application File can be submitted. The Company will submit an application file for the issuance of the Town Planning Permit along with the final ESIA. The Environmental Opinion as well as the Town Planning Permit and the Building Permit, and other minor permits, will be issued prior to the commencement of construction. In Greece, upon the issuance of the Environmental Terms Approval (ETA) Decision, as per the Greek Legislation, IGI Poseidon will submit application files for the issuance of the Installation Act and Installation Permit to the competent Authorities. The relevant documents have already been prepared within the FEED, incorporating public consultation comments and requests. There is no construction to take place on the territory of Italy. 1.4.Project Maturity The Project Promoter states that he has performed all necessary activities in an effort to bring the level of maturity of the project to a satisfactory standard. In particular, the Project Promoter has provided information on costs and benefits, a cost breakdown of the project, information on the permitting procedure and the expected date of commissioning, as well as, other details relevant to maturity. 1.5.Consultations with the TSOs The Project Promoter has provided information regarding consultations with the TSOs of the involved countries, namely DESFA and SNAM acting as main TSOs in Greece and Italy respectively as well as the recent communication that the Project Promoter had with the Cyprus’ TSO namely CyGas. In particular the project Promoter states that there has been information conveyed on a regular basis from the Promoter’s part to the relevant TSOs about the maturity of the Eastmed Project and the status of development reached via the formal channels related to the preparation of the Ten Year National Development Plan (TYNDP) since 2013 and via the periodic data collections performed by ENTSOG. 1.6.Cost Benefit Analysis (CBA) and Cross Border Cost Allocation (CBCA) proposal The Project Promoter states that the CBA of the project is based on the 2 nd ENTSO-G methodology. The Project Promoter provides details of the project specific CBA in a series of documents such as the Investment Request, the Business Plan, the CBA and the CBCA documents, including spreadsheets with economic and financial analysis. The Project’s base case capital expenditure for the construction of the EastMed pipeline sections located within the European borders have been estimated at ~€6 billion. In addition, the cost perimeter for the purpose of cost benefit analysis (which is different than the cost perimeter to be allocated) includes additional infrastructures intended to connect the Cypriot and Greek markets to the rest of the European market through Italy: those are the ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Poseidon pipeline and additional transport infrastructures in Italy, taking into account the definition of the PCI cluster and the ENTSOG practice of performing cost benefit analysis on project clusters. Project’s capital expenditures are summarized by section in the following table 2. Therefore, no single country is eligible for inclusion in the CBCA analysis. As such there is no rationale for a CBCA compensation, therefore the Project Promoter expects to cover the cost of the expenditure by the application of entry exit tariffs to future user ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ of the infrastructure, by European Funding for project of common interest (e.g CEF Funding) and by other support measures that might become available at the EU or State level, but in any case the cost will be not covered directly or indirectly by Cypriot, Greek or Italian tariff regimes. In relation to the access to European Funding, the CBCA requirements in accordance to Articles 14
(2)and 14
(3)of the TEN-E Regulation have been satisfied and transmitted to the relevant entities and to the Project Promoter as reported at point 12 (section of the document “The NRAs, having regard to the following”). 2. ASSESSMENT OF THE INVESTMENT REQUEST The Project Promoter submitted on 17 May 2023 to the Greek NRA (RAEWW) and the Cypriot NRA (CERA) and on 18 May 2023 to the Italian NRA (ARERA), the Investment Request, including a request for a cross-border cost allocation (CBCA), pursuant to article 12 of Regulation (EU) No 347/2013 and article 16 of Regulation 2022/869 for the Investment Project No 7.3.1 “Pipeline from the East Mediterranean gas reserves to Greece mainland via Cyprus and Crete [currently known as “EastMed Pipeline”], with metering and regulating station at Megalopoli”. The NRAs have been identified by the project promoter as being concerned NRAs. The Project will be located on the territories of Greece and Cyprus. Moreover, the largest portion of the gas carried by the EastMed Pipeline is expected to enter mainland Europe via Italy, through its connection with the Poseidon Pipeline Project and/or any other available infrastructure. For this reason, as well as because the analysis shows a net positive impact for the Italian system, the Italian NRA, ARERA, has also been proposed by the Project Promoter as a concerned NRA. All three NRAs have notified ACER accordingly. 2.1.Admissibility The Project falls under the category of infrastructure projects of Annex II.2(
  1. a)of Regulation (EU) No. 347/2013. It has been included in the 5th Union List of Projects of Common Interest, by virtue of the Commission Delegated Regulation (EU) 2022/564 of 19 November 2021 amending Regulation (EU) No 347/2013 of the European Parliament and of the Council as regards the Union list of projects of common interest, that amended Annex VII of Regulation (EU) No. 347/2013. Therefore, the Project falls within the scope of Article 12 of the aforementioned Regulation. Moreover, it has not received any of the exemptions of Article 12 par. 9. Therefore, the eligibility of the Project is established. The concerned NRAs find that all required documents as per Article 12 par.3 of Regulation (EU) 347/2013, namely project-specific cost-benefit analysis (CBA), a business plan including preliminary results of market testing are presented and complete. The investment request also includes a proposal for cross-border cost allocation (CBCA). Moreover, Article 12 par. 3 of Regulation (EU) No. 347/2013 contains two pre-conditions, which project promoters need to meet before submitting a valid Investment Request and which require assessment by the NRAs: ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ (
  2. i)a prior consultation with the TSOs from the Member States to which the project provides a significant net positive impact; and (
  3. ii)the project having reached sufficient maturity. 2.1.1. Evidence on TSO Consultations According to par. 1.5 of ACER’s Recommendation 05/2015, item 6, the Project Promoter must provide information on TSO consultations and their results; more specifically, the documents shared, the feedback received, as well as an explanation in sufficient detail of how their comments have been accepted and implemented or why they were rejected. The Project Promoter, IGI Poseidon S.A., has reported being in close cooperation with the TSOs CyGas, DESFA and SNAM via the formal channels related to the Ten Year National Development Plan since 2013 (first year of the Project’s inclusion in the PCI list) and via the periodic data collection performed by ENTSO-G, since Eastmed is in the same cluster of the Southern Gas Corridor with the offshore pipeline connecting Greece and Italy (Poseidon) and the reinforcement of the internal transmission capacities in Italy (Adriatica Line). The information provided is not in accordance with the provisions of the ACER Recommendation. However, the NRAs recognize that, according to Article 12
(3)of Regulation (EU) 347/2013, the pre-condition of the consultation with the relevant TSOs applies only to those of the Member States to which the project provides a significant net positive impact; i.e. to which costs could be potentially allocated. Following ACER’s Recommendation 05/2015, the significance is set to 10% of the sum of net positive impacts accruing to all beneficiary countries. The net positive impact on Cyprus, Greece and Italy is 6%, 5%, 5%, respectively, i.e. below the significance threshold. Since there is no country to which the Project has a significant net positive impact, the NRAs agree that no TSOs should have been consulted by the project promoter as a pre-requisite and that therefore the pre-condition is fulfilled. 2.1.2. Maturity The concerned NRAs have assessed the maturity of the projects pursuant to the ACER Recommendation No 05/2015, namely in terms of:
  1. a)sufficient maturity about the costs assessed by the project-specific CBA;
  2. b)good knowledge of the factors affecting expected costs and their ranges;
  3. c)a cost uncertainty range;
  4. d)reasonable foresight of the benefits assessed by the project-specific CBA;
  5. e)reasonable knowledge of factors affecting benefits and their ranges, also with regard to different scenarios and sensitivity analyses;
  6. f)permitting procedures having started in all hosting countries;
  7. g)commissioning to be achieved indicatively within 60 months from the date of submission of the investment request. The Project Promoter has concluded the FEED study for the project, which provides an assessment of the costs within a 15% range. Moreover, according to the Project Promoter: ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ - considering the recent energy and material costs crisis that have affected the global market, the Project Promoter has updated time by time the cost to take in duly consideration of such impact, - within 2023 they have obtained binding offers for construction, - third parties have compared the project costs with that of similar infrastructure and confirmed the offshore pipeline costs at 3mil.€/km and the onshore at 1.4mil.€/km. Through the FEED study and the abovementioned actions, it can be concluded that the Project Promoter has a good knowledge of the factors affecting expected costs and their ranges. The cost uncertainty range is at 15%, which is acceptable at this stage of the project. In the project-specific CBA, a reasonable assessment of the benefits has been provided. The assessment is based on the 2nd ENTSOG CBA methodology, fulfilling Annex I of the Regulation (EU) 347/2013. In Annex III of the Investment Request, a description of the assumptions, scenarios and sensitivity analysis are provided in the project-specific CBA which leads us to the conclusion that there is a reasonable knowledge of factors affecting benefits and their ranges, also with regard to different scenarios and sensitivity analyses. In addition, letters of acceptance by the competent bodies which prove the initiation of the permitting procedures in Cyprus and Greece were submitted. With regards to the commissioning, this is foreseen for 2027, which is within 60 months from the date of submission of the investment request. Considering the commissioning period, the availability of the vessels and construction tools due to the tight market, the assumptions made in the investment request are consistent with the ACER envisaged schedule, also taking into account the magnitude of the Project. Therefore, the NRAs consider Project 7.3.1 as sufficiently mature in order for a CBCA decision to be taken. 2.1.3. Demonstration that the efficient costs cannot be recovered by the tariffs As better described in the following section 2.3, the Investment Request reports the description of a market testing performed by the Promoter via: 1. A market assessment on the expected gas demand volumes in the relevant European markets, with the support of consultancy companies 2. A dedicated confidential meeting and data room on the Project with over 10 short-listed interested parties (companies in the global gas market). The market testing resulted in the estimation of a potential market interest in delivering 7.2 bcm/y of natural gas to Italy, 2.7 bcm/y to Greece and 0.45 bcm/y to Cyprus. The Promoter has also calculated a potential maximum tariff charge to be applied on the basis of the expected market price differentials as the maximum tariff the market participants may accept to pay to transport gas from the origin market to the destination ones (Italy and Greece) during the period 2027-2047, which resulted in the calculation of a maximum tariff charge of [business secret]. ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ The business plan provided in the Investment Request identifies a financial gap of [business secret], demonstrating that the project cannot be financed only by the application of a transport tariff. Therefore, the NRAs consider that the Promoter have provided sufficient evidence that the project costs cannot be entirely covered by applying a transport tariff on the basis of the results of the assessment of market interest to use the EastMed pipeline, 2.2. Completeness of the Investment Request The concerned NRAs have assessed the completeness of the investment request while taking particular note of the ACER Recommendation No 05/2015. The Agency has recommended that an investment request submitted by project promoters should provide the following information and, where appropriate, supporting evidence:
  8. a)a detailed technical description of the project;
  9. b)a detailed implementation plan of the project;
  10. c)a preliminary investment decision on the investment;
  11. d)a short description of the status of the project permitting process in all hosting countries, including a detailed schedule (in line with Annex VI
(2)of Regulation (EU) No 347/2013) and corresponding evidence;
  1. e)information about the sufficient maturity of the project (as per section 1.2 of the recommendation);
  2. f)information on TSO consultations and the results of the consultations.
  3. g)a project-specific CBA;
  4. h)a business plan including a description of the chosen financing solution; and
  5. i)a substantiated proposal for cross-border cost allocation. The Project Promoter does not propose any costs to be allocated to the systems of the relevant countries. It should be noted that a preliminary investment request is not available, however is not necessary as per ACER’s Recommendation No. 05/2015. The concerned NRAs find that the investment request is complete and include all the above-mentioned information and, where appropriate, all supporting evidence. 2.3.Assessment of the project specific Cost Benefit Analysis A project-specific CBA for the EastMed Pipeline has been performed by the Project Promoter and included in the Investment Request. The overall approach to the project-specific CBA appears to be consistent with the methodology drawn up pursuant to (now repealed) Article 11 of Regulation (EU) No 347/2013 and taking into account benefits beyond the borders of the ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Member State concerned being in line with ENTSOG’s 2nd Cost-Benefit Analysis (CBA) Methodology for gas infrastructure projects, including the time horizon for the assessment period and the use of a 4% real discount rate for both the economic and financial analyses. Regarding the project benefits, the Project Promoter has assessed them in line with the TEN-E Regulation in terms of: a. Market integration: benefits stemming from connecting the islands of Cyprus and Crete to the EU natural gas networks, thus ending their energy isolation. b. Security of supply: benefits related to the reduction of dependence from other gas sources both at the concerned Member States and at European level. The scenarios that were considered to quantify the security of supply benefits are in line with the relevant European Regulations and the detailed results per country are reported by the Project Promoter as follows: Country Austria Belgium Bulgaria Croatia Czech Republic Denmark Estonia Finland France Germany Hungary Ireland Latvia Lithuania Netherlands Poland Portugal Romania Slovakia Slovenia Spain Italy Greece Cyprus EU-Wide Security of supply benefits (mil. €) 4 10 2 2 5 2 0 1 11 19 7 1 1 1 11 14 2 6 3 0 10 3,719 524 The benefits for the country are not strictly related to the SoS because it considers the gasification of the island and not the introduction of a new supply route (as per other countries). For this reason, the SoS are not quantified 4,358 c. Sustainability: benefits related – to a big extent - to the substitution of oil products with natural gas resulting from the gasification of Cyprus and Crete. However, the NRA point out that the oil-fired power plants of Crete will stop operation in any case, when the full electrical interconnection of the island to the mainland Greek system is achieved in 2024 (Phase II – Crete-Attica interconnection). The sustainability benefits are not allocated to a specific country. d. Supply cost saving: benefits arising from improving market competitiveness since a new significant gas source will reach Europe. The supply cost savings are not allocated to a specific country. This position of the project promoter is deemed compatible with the ENTSOG CBA methodology and the ACER recommendation, as they do not provide ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ concrete and specific guidance on how to allocate benefits which may accrue to gas shippers. To this respect, the Project Promoter has reported performing from September 2022 a survey to assess the potential interest in the transmission capacity of the Pipeline both via a desktop assessment and via a market testing with identified list of market players. As stated by the Project Promoter the first phase of the market test process, namely market testing, has been performed in two stages, firstly via an assessment on the expected gas volumes demand in the European markets, with the support of a marketleading consultancy companies, and then via dedicated confidential meetings and data room on the Project with short listed interested parties, leading companies operating along the whole energy supply chain in the global market. The market testing allowed the Project Promoter to collect non-binding preliminary interest on the Project transmission capacity and first feedback on interconnection points and commercial products to be considered in the following phases of the market test process. The entire market test has been designed as a funnelling process that after the market testing phase, will foresee a non-binding expression of interest to be performed in the first half of 2024 via an open season phase. Then, a binding phase for the allocation of the transmission capacity products and the execution of gas transportation agreements will be performed in parallel with the finalization and execution of gas sales and purchase deals between interested parties operating in the European markets and East Mediterranean gas production areas. The above mentioned market testing, allowed the Project Promoter to collect several letters of interest in the transportation capacity of the EastMed Pipeline Project covering a significant capacity over the operational lifetime of the pipeline, in line with the existing regulation constraints (15+5 years contract length) and the financial assumptions considered in the Annex 2 of the Investment Request. The Project Promoter will continue the market testing in order to substantiate the already received interest in the offered transportation capacity with the collection of new expression of interest by third parties. In conclusion, the NRAs concerned agree that the CBA is in line with the principles of ENTSOG methodology and they endorse the Promoter’s conclusion that there would be benefits in EUwide level in terms of security of supply, market integration, sustainability and competition. 2.4.Assessment of the Business Plan and Financing Strategy Article 12
(3)(b) of Regulation (EU) No 347/2013 and Article 16
(3)(b) of the Regulation (EU) 2022/869 requires that the Investment Request be accompanied by a Business Plan evaluating the financial viability of the project. ACER recommends that the Business Plan includes ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ information about the financing solution. Also, according to the same articles, a Business Plan shall evaluate the financial viability of the PCI, including the chosen financing solution, and the results of market testing. The concerned NRAs have evaluated and assessed the Business Plan, including the description of the chosen financing solution (as well as tariffs) and information on awarded, applied for and expected grants and loans, also differentiating on national or European and other sources, as well as on the estimated financing costs (including an estimation of the part of financing costs to be incurred until commissioning of the project). The chosen financing solution was outlined by the Project Promoter’s Investment Request. With respect to project financing, the Project Promoter considers applying for [business secret] grants for works under the Connecting Europe Facility (CEF)E. The financial analysis assumes that the project can recover costs through tariffs set in line with the regulatory regime. To finance the €6,039 million construction costs, the Project Promoter plans to use a combination of three sources of finance:  Equity of up to [business secret];  Debt of up to [business secret]; and  A [business secret] grant of up to [business secret]. The Project Promoter provides a comprehensive analysis of the financing plan. 2.5.Impact on Network Tariffs Given that no net cost bearer can be identified for the EastMed Project, since the level of benefits enjoyed by Cyprus, Greece and Italy falls below the 10% significance threshold of total net benefits, as specified by ACER in its Recommendation 5/2015, there will be no CBCA compensation by any of the involved countries, namely Greece, Cyprus and Italy. Therefore, as set out in the Investment Request and the accompanying proposal for a cross border cost allocation (CBCA proposal), National tariffs will not be affected in any of the involved countries, namely Greece, Cyprus and Italy. 2.6.Regional and EU-Wide Positive Externalities of the Project The project generates positive externalities in terms of security of supply, enhancement of competition, market integration and sustainability and contributes to the European energy policy goals. 2.7.Cross-Border Cost Allocation Pursuant to Article 12
(3)(c) of Regulation (EU) No 347/2013, the Project Promoter accompanied its investment request with a substantiated proposal for a cross border cost allocation. According to the CBCA proposal of the Project Promoter, there is no Member State which could be the beneficiary of a potential CBCA compensation given that no net cost bearers may identified. In particular, taking into account that the resulting net benefits of the project for ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Greece, Cyprus and Italy respectively fall below the 10% threshold of total net benefits specified by ACER’s Recommendation No 05-2015, there are no compensations required and no costs concerning this PCI project are to be allocated to Greece, Cyprus and Italy, based on the outcome of the submitted Investment Request. The NRAs of Greece, Cyprus and Italy do not see reasons to deviate from the cross border cost allocation proposal of the Project Promoter. Furthermore, the involved NRAs agree that no cost coverage or other incentives will be provided by the national systems in the future at any stage of the project implementation.
  1. SPECIAL TERMS AND CONDITIONS – OBLIGATIONS OF THE PROJECT PROMOTER 3.1.Project Availability The Promoter guarantees that the Project is constructed according to internationally approved standards and certifications adopting the “n+1” design philosophy where applicable, in order to maximise infrastructure availability. 3.
  2. Schedule of Implementation The Promoter shall complete the Project within the timeframe provided by the Investment Request. In case that the observation of the deadlines of the Project is objectively impossible, the Promoter must inform the competent NRAs, without delay, requesting an extension of the time period during which the force majeure is occurred. The request shall be submitted at least ten
(10)days following the occurrence of the said force majeure. 3.3.Assignment of Rights The Promoter shall not assign the rights and obligations arising from the present Agreement, without a prior approval by the competent NRAs.
  1. COORDINATED DECISION The Regulatory Authority for Energy Water and Waste (RAEWW), the Cyprus Energy Regulatory Authority (CERA) and the Italian Regulatory Authority for Energy, Networks and Environment (ARERA) have agreed to adopt the following in their coordinated National Decisions: Article 1 – Decision on the allocation of investment costs The efficiently incurred investment costs related to the project of common interest 7.3.1 “Pipeline from the East Mediterranean gas reserves to Greece mainland via Cyprus and Crete [currently known as “EastMed Pipeline”], with metering and regulating station at Megalopoli”, according to the perimeter of costs identified in the preamble to the present Decision, shall be borne by the project promoter IGI Poseidon S.A.. No compensations are required from transmission system operators of Cyprus, Greece, or Italy and no costs concerning PCI 7.3.1 are to be allocated to Cyprus, Greece, and Italy. ΑΔΑ: 97ΧΞΙΔΞ-ΖΣΜ Article 2 – Reflection of investment costs in tariffs Based on the cross-border cost allocation defined in article 1 of the present Decision, no costs of PCI 7.3.1 are to be included in the national tariffs of Cyprus, Greece or Italy. Article 3 – Reporting by project promoter to National Regulatory Authorities The project promoter IGI Poseidon S.A. shall keep the national regulatory authorities RAEWW, CERA and ARERA, twice per year, regularly informed of the progress of PCI 7.3.
  2. and the identification of costs and the impact associated with it. The information is due by the same date the project promoter is due to submit the PCI annual report pursuant to Article 5
(4)of Regulation (EU) No 347/2013 and to Article 5
(4)of Regulation (EU) 2022/869, as applicable depending on the adoption of the first PCI list under Regulation (EU) 2022/869. That information shall include at least the PCI 7.3.1 annual report. Afterwards, updated information is due within six months from the due date of submission of the PCI annual report.
