Hungary and the Government
Mongolia, hereinafter referred to as „the Parties”. Desiring to promote friendly relations
the two countries through the co-operation in the Customs field; Desiring to promote and facilitate the flow
goods and passengers between the two countries through the co-operation
their Customs Authorities; Considering that
fences against customs legislation are prejudicial to the social, economic, commercial and fiscal interests
their respective countries as well as to the legitimate interests
trade; Considering that illicit trafficking in narcotic drugs and psychotrophic substances constitutes a danger to public health and to society; Considering the importance
assuring the accurate assessment and collection
customs duties, taxes and any other charges on the importation or exportation
goods as well as the proper implementation
the provisions
prohibition, restriction and control; Convinced that efforts to prevent
fences against customs legislation and efforts to ensure accurate collection
import and export duties and taxes can be rendered more effective through co-operation between their Customs Authorities; Have agreed as follows: DEFINITIONS Article 1 For the purpose
this Agreement: 1. „Customs legislation” means provisions laid down by laws and regulations concerning the importation, exportation and transit
goods and means
payment, as well as customs duties, taxes and other charges, or measures
prohibition, restriction or control, administered by the Customs Authorities. 2. „
fence” means any violation or attempted violation
customs legislation. 3. „Customs Authority” means in the Republic
Hungary, the Customs and Finance Guard, and in Mongolia, the Customs General Administration. SCOPE
AGREEMENT Article 2 1. The Parties, through their Customs Authorities, shall in accordance with the provisions set out in this Agreement: a) undertake measures in order to facilitate and expedite movement
goods; b) co-operate and assist each other in prevention, investigation and repression
fences against customs legislation;
new customs procedures, in the training and exchange
personnel and in other matters that may require their joint efforts; and e) strive for harmonization and simplification
customs procedures. 2. Assistance mentioned in subparagraphs b) and c)
the present Article can be provided for use in all proceedings, whether judicial; administrative or others. 3. Mutual assistance within the framework
this Agreement shall be rendered in accordance with the legislation in force in the territory
the State
the requested Party and within the competence and ressources ot the requested Customs Authority. If necessary, the requested Customs Authority may arrange for assistance to be provided by another competent authority in accordance with the legislation in force in the territory
the State
the requested Party. 4. When the provisions
this Agreement differ from those found in the Agreement between the Republic
Hungary and Mongolia on Legal Assistance in the Civil and Criminal Matters the Latter shall previal. SIMPLIFICATION
CUSTOMS PROCEDURES Article 3 The Customs Authorities shall, upon mutual consent, undertake necessary measures to simplify customs procedures in order to facilitate and expedite movement
goods between the territories
the States
both Parties. FORMS
COOPERATON AND MUTUAL ASSISTANCE Article 4 1. The Customs Authorities provide each other, on their own initiative or upon request, with all necessary information in accordance with the provisions
this Agreement. 2. The Customs Authorities shall: a) exchange the experience relating to their activities and customs technique, the information about new means and methods
committing
fences against customs legislation which might be useful for each other; b) inform each other about substantial changes in their customs legislation, as well as on application
advanced customs control equipment and also discuss other matters
mutual interest. Article 5 1. The Customs Authorities shall, on their own initiative or upon request, supply each other with all information which may help to ensure accuracy in: a) the colection
customs duties, taxes and other charges levied by the Customs Authorities and, in particular, information which may help to assess the value
goods for customs purposes and to establish their tariff classification; b) the implementation
import, export and transit prohibitions and restrictions or reliefs from customs duties, taxes and other charges; c) the application
rules
origin. 2. If the requested Customs Authority does not have the information asked for, it shall seek that information as if acting on its own behalf in accordance with the legislation in force in the territory
the State
the requested Customs Authority. Article 6 The Customs Authorities may co-operate and provide assistance in enforcing claims for collection
customs duty, taxes and other charges. SURVEILLANCE
PERSONS, GOODS AND MEANS
TRANSPORT Article 7 The Customs Authority
one Party shall, on its own initiative or upon request

the other Party, maintain surveillance over: a) the movements, particularly entry into and exit from the territory
its State
persons known or suspected
committing
fences against customs legislation in force in the territory
the State
the other Party; b) the movements
goods and means
payment which are reported by the Customs Authority
the other Party as becoming substantial illicit traffic into or from the territory
the State
the other Party or are suspicious thereof; c) any means
transport known to be, or suspected
being, used for committing
fences against customs legislation in force in the territory
the State
the other Party; d) places used for storing goods which may cause substantial illicit traffic into the territory
the State
the other Party. CONTROLLED DELIVERY Article 8 1. The Customs Authorities may by mutual agreement carry out the method
controlled delivery
unlawful goods and items with the aim
bringing to light persons involved in the illicit trafficing
those goods and items. 2. Unlawful goods and items in respect
which controlled delivery is carried out in accordance with the arrangements made, may, with the agreement
both Customs Authorities, be intercepted and left for onward transportation with the unlawful goods and items intact or removed, or wholly or partially replaced. 3. Decision concerning the use
controlled delivery is to be taken on a case-by-case basis and may, if necessary, take into account financial arrangements and understandings reached by both Customs Authorities as regards its implementation. ACTION AGAINST ILLICIT TRAFFIC IN SENSITIVE GOODS Article 9 The Customs Authorities shall, on their own initiative or upon request and without delay, supply each other with all relevant information on activities, detected or planned, which constitute or appear to constitute an
fence against the customs legislation in force in the territory
the State
any Party in the field
: a) movements
arms, ammunition, explosives and explosive devices; b) movement
objects
ait and antiquity, which represent significant historical, cultural or archaeological value for any Party; c) movement
poisonous goods as well as the substances dangerous for the environment and the public health; d) movement
goods subject to high rate customs duties or taxes; e) movement
sensitive and strategic goods subject to non-tariff limitations in accordance with the lists agreed upon by the Customs Authorities. Article 10 The Customs Authority
one Party shall, on its own initiative or upon request, supply the Customs Authority
the other Party with the following information: a) whether goods imported into the territory
the State
the requesting Party have been lawfully exported from the territory
the State
the other Party; b) whether goods exported from the territory
the State
the requesting Party have been lawfully imported into the territory
the State
the other Party, and what kind
customs procedure, if any, the goods were subjected to. Article 11 The Customs Authority
one Party shall, on its own initiative or upon request, supply the Customs Authority
the other Party with all information on
fences which probably may affect the other Party, with special regard to the following: a) natural or legal persons known to be, or suspected
, committing
fences against customs legislation in force in the territory
the other Party; b) goods known to be, or suspected
being, the subject
substantial illicit traffic; c) means
transport known to be, or suspected
being, used in committing
fences against customs legislation in force in the tenitory
the other Party. Article 12 The Customs Authority
one Party shall, on its own initiative or upon request supply the Customs Authority
the other Party with documents or certified copies thereof or other evidence giving all available information on activities, completed or planned, which constitute or appear to constitute an
fence against the customs legislation in force in the tenitory
the State
that Party. Article 13 The documents provided for in this Agreement may be replaced by computerised information produced in any form for the same purpose. Any relevant information for the interpretation or utilization
the material should be supplied at the same time. Article 14
the other Party shall be returned at the earliest opportunity. INQUIRIES Article 15 1. If the Customs Authority
one Party so requests, the Customs Authority
the other Party shall initiate all
ficial inquiries conceming operations which are, or appear to be, against the customs legislation in force in the territory

the requesting Customs Authority. It shall communicate the results
such inquiries to the requesting Customs Authority. 2. These inquiries shall be conducted under the legislation in force in the territory

the requested Customs Authority. The requested Customs Authority shall proceed as if it were acting on its own behalf. 3. The

one Party may, in particular cases, with the agreement

inquiries provided for under this Article. ARRANGEMENTS FOR VISITING
FICIALS Article 16 When, in the circumstances provided for under this Agreement,

ficial capacity. EXPERTS AND WITNESSES Article 17 1. If the judicial or the administrative authorities
one Party so request in connection with

ficials to appear as experts or witnesses before those judicial or administrative authorities. Such
ficials shall give evidence regarding facts established by them in the course
their duties. The request for the appearance must clearly indicate, in what case and in what capacity the
ficial is to appear. 2. The
ficial requested to appear as witness or expert has the privilege to refuse to give an evidence or a statement, if the
ficial is entitled or obliged to do so by virtue
the law
his own state or that
the requesting Party. USE
INFORMATION AND DOCUMENTS Article 18 1. Information, communications and documents received under this Agreement shall be used solely for the purposes
this Agreement. They shall not be communicated or used for any other purposes unless the requested Customs Authority expressly approves it in writing. 2. The provisions
paragraph 1
this Article are not applicable to information concerning
fences relating to narcotic drugs and psychotropic substances. Such information may be communicated to other authorities directly involved in the combat
illicit drug traffic. 3. Requests, information, reports
experts and other communications received by the Customs Authority
one
the Parties in whatever form pursuant to this Agreement shall be afforded the same protection by the receiving Customs Authority as is afforded to documents and information
the same kind under the national legislation
the State
that Party. Article 19 The Customs Authorities may, in accordance with the purposes and within the scope
this Agreement, in their records
evidence, documents and testimonies, and in proceedings brought before courts or the administrative authorities, use as evidence information and documents received in accordance with this Agreement. The use made
such information and documents as evidence in courts and the weight to be attached there to shall be determined in accordance with national law. COMMUNICATION AND USE
INFORMATION ON NATURAL PERSONS Article 20 In accordance with the legislation
the Parties, the protection
the information on natural persons shall be subject to the following conditions: 1. The requesting Party may use the information only for the purposes and subject to the conditions stated by the requested Party, and if the latter so requests, report on that
the results. 2. The information on natural persons can be forwarded to the authorities other than law enforcement only with the preliminaty consent
the requested Party. 3. If public interest so requires, the Parties may not advise the affected person on planned use
the information and the legislation
the requesting Party shall prevail in this case. 4. The requested Party must ascertain the validity and conectness
the information to be transferred. In case the requested Party finds it either invalid or incorrect or restricted information have been transferred, it must immediately inform the requesting Party
this fact. The requesting Party must correct the information or destroy it, if so required. 5. The Parties shall keep a register on the supply and reception
the information on the natural persons and effectively protect the information on natural persons against unauthorized access, modification, publication, damage or destruction and shall destroy the infoimation if it is no longer in use. EXCEPTIONS FROM THE LIABILITY TO RENDER ASSISTANCE Article 21 1. If the Customs Authority
one Party considers that compliance with the request would be prejudicial to the sovereignty, security, public order or any other essential interest
the State
that Party, it may refuse to provide the assistance requested under this Agreement, wholly or partially, or provide it subject to certain conditions or requirements.

the Parties requests assistance which it would not itself be able to provide, it shall draw attention to that fact in the request. Compliance with such a request shall be within the descretion
the requested Customs Authority. FORM AND SUBSTANCE
REQUESTS FOR ASSISTANCE Article 22 1. Requests pursuant to the present Agreement shall be made in writing. Documents necessary for the execution
such requests shall accompany the request. When required because
the urgency
the situation, oral request may be accepted, but must be confirmed in writing immediately. 2. Requests pursuant to paragraph 1
this Article shall include the following information:
and the reason for the request;
the investigations; f) a summary
the relevant facts. 3. Requests shall be submitted in the
ficial language
the State
therequested Customs Authority, in English or in another language acceptable to the requested Customs Authority. 4. If a request does not meet the formal requirements, its conection or completionmay be demanded, but this will not delay any measure which must be taken immediately. TECHNICAL ASSISTANCE Article 23 Customs Authorities shall provide each other technical assistance including: a) exchange
customs
ficers when mutually beneficial for the purpose
advancing the understanding
each other’s techniques; b) training and assistance in developping specialized skills
the customs
ficers; c) exchange
information and experience in the usage
the interdiction and detection equipment; d) exchange
experts knowledgeable in the field
customs matters. COSTS Article 24 The Parties shall normally waive all claims for reimbursement
costs incurred in the implementation
this Agreement except for the expenses
witnesses, experts and interpreters other than government employees. Reimbursement
expenses incurred in the execution
IMPLEMENTATION Article 25
Customs Authorities shall meet in case
neccessity but not less than one time a year, alternately in the Republic
Hungary or in Mongolia for the overview
the implementation
this Agreement and for resolving other practical matters
co-operation
Customs Authorities
the Parties. 3. The Customs Authorities may arrange for their central and local enforcement, investigation and other services to be in direct communication with each other. TERRITORIAL APPLICABILITY Article 26 The provisions
this Agreement shall be applicable in the territories
the States
both Parties. ENTRY INTO FORCE AND TERMINATION Article 27 1. This Agreement shall enter into force on the thirtieth day from the date
the last written notitication that all national legal procedures necessary for its entry into force have been completed by the Parties. 2. This Agreement may be amended by mutual written consent
both Parties. 3. This Agreement is concluded for an indefinite period and shall remain in force six months after the date
a written notification

the Parties about its intention to terminate the Agreement. Done at Budapest, on 22nd September 1995, in duplicate, in the Hungarian, Mongolian and English languages, all texts being equally authentic. In case
