SCHEDULE Acts Referred to Electoral Act, 1992 1992, No. 23 Electoral Act, 1997 1997, No. 25 Electoral Acts, 1992 to 1998 Electoral (Amendment) Act, 1995 1995, No. 21 Electoral (Amendment) Act, 1996 1996, No. 43 Electoral (Amendment) Act, 1998 1998, No. 4 Number 19 of 1998 ELECTORAL (AMENDMENT) (NO. 2) ACT, 1998 AN ACT TO PROVIDE FOR THE NUMBER OF MEMBERS OF DÁIL ÉIREANN AND FOR THE REVISION OF CONSTITUENCIES AND TO AMEND THE LAW RELATING TO THE ELECTION OF SUCH MEMBERS. [16th June, 1998] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS: Interpretation. 1.—(1) In this Act “the Minister” means the Minister for the Environment and Local Government. (2) In this Act— (a) a reference to a former rural district shall be construed as a reference to that district as constituted immediately before the 1st day of October, 1925; and (b) a reference to a line drawn along any motorway, road, railway or pathway shall be construed as a reference to a line drawn along the centre of such motorway, road, railway or pathway. Number of members of Dáil Éireann. 2.—Dáil Éireann shall, after the dissolution thereof that next occurs after the passing of this Act, consist of 166 members. Constituencies. 3.—(1) The members of Dáil Éireann shall, after the dissolution of Dáil Éireann that next occurs after the passing of this Act, represent the constituencies specified in the Schedule to this Act. (2) An area specified in the Schedule to this Act shall be taken to be that area as constituted on the 1st day of January, 1998, but if any doubt arises as to the constituency in which any electoral division or part thereof, or any townland or part thereof, is included, the doubt shall, subject to section 1 (2) (b) of this Act, be determined by the Minister. Number of members to be returned for a constituency. 4.— A constituency specified in the Schedule to this Act shall return the number of members set out in respect thereof in the third column of that Schedule . Repeal. 5.—(1) The Electoral (Amendment) Act, 1995 , is hereby repealed. (2) Subsection (1) of this section shall come into operation on the dissolution of Dáil Éireann that next occurs after the passing of this Act. Short title, collective citation and construction. 6.—(1) This Act may be cited as the Electoral (Amendment) (No. 2) Act, 1998. (2) The Electoral Act, 1992 , the Electoral (Amendment) Act, 1996 , the Electoral Act, 1997 , the Electoral (Amendment) Act, 1998 , and this Act may be cited together as the Electoral Acts, 1992 to 1998, and shall be construed together as one Act.
