JOHNSTOWN CASTLE AGRICULTURAL COLLEGE (AMENDMENT) ACT 2014
An Act to amend the
Johnstown Castle Agricultural College (Amendment) Act 1959
and the
Agriculture (Research, Training and Advice) Act 1988
, and to provide for related matters. [22 nd June, 2014]
Be it enacted by the Oireachtas as follows:
Definition
1. In this Act âAct of 1959â means the
Johnstown Castle Agricultural College (Amendment) Act 1959
.
Amendment of section 1 of Act of 1959
2. Section 1 of the Act of 1959 is amended by the insertion of the following definitions:
â âthe Act of 1988â means the
Agriculture (Research, Training and Advice) Act 1988
;
âthe relevant mapâ means the map deposited for the purposes of the Act of the Oireachtas passed in 2014 entitled âAn Act to amend the
Johnstown Castle Agricultural College (Amendment) Act 1959
and the
Agriculture (Research, Training and Advice) Act 1988
, and to provide for related mattersâ by, or on behalf of, the Minister at the principal office of Ordnance Survey Ireland on 12 May 2014, and thatâ
(a) is sealed with the Official Seal of the Minister, and
(b) contains a statement that it has been deposited for those purposes;
âTeagascâ means the body established by section 3 of the Act of 1988;â.
Amendment of section 3 of Act of 1959
3. Section 3 (amended by
section 1
of the
Johnstown Castle Agricultural College (Amendment) Act 1996
) of the Act of 1959 is amended by the substitution of the following for subsections (2) and (3) :
â(2) Notwithstanding section 27 of the Act of 1988, Teagasc mayâ
(a) dispose of such part of the Estate as it may determine, but not exceeding 5 per cent of the land that, on the passing of the
Johnstown Castle Agricultural College (Amendment) Act 1996
, was comprised therein, for one or more of the following purposes, namely, for use as a burial ground or use for environmental, heritage, amenity or recreational purposes,
(b) use such part of the Estate as is delineated on the relevant map in red (or any portion of that part) for heritage, tourism, amenity or recreational purposes,
(c) subject to the consent of the Minister, lease such part of the Estate as is referred to in paragraph (b) (or any portion of that part) for the purposes specified in that paragraph, and
(d) lease such part of the Estate, as it may determine, to the Environmental Protection Agency for use by the Agency for the Agencyâs purposes.
(3) Where a part of the Estate is disposed of under paragraph (a), used under paragraph (b) or leased under paragraph (c) or (d), of subsection (2), that part of the Estate may not be used for a purpose other than a purpose specified in the relevant paragraph.â.
Relevant map
4. The Act of 1959 is amended by the insertion of the following section after section 3:
â3A. (1) As soon as practicable after the passing of the Johnstown Castle Agricultural College (Amendment) Act 2014 the Minister shall cause a copy of the relevant map to be deposited in the Central Office of the High Court and the Circuit Court Office for the county of Wexford.
(2) The relevant map shall be retained in the principal office of Ordnance Survey Ireland and the copies of the relevant map referred to in subsection (1) shall be retained in the offices referred to in that subsection.
(3) The relevant map and copies of it deposited under subsection (1) shall be available for inspection free of charge at all reasonable times at the offices in which they are deposited.
(4) Ordnance Survey Irelandâ
(a) shall, on the written request by a person, supply to the person a copy of the relevant map or any particular part of it, and
(b) may charge for any such copy such sum (not exceeding the reasonable cost of making the copy) as he or she may determine.
(5) A copy of the relevant map, or any particular part of it, that has endorsed on it a certificate that is purported to be signed by an officer of Ordnance Survey Ireland (authorised in that behalf by the chief executive officer of Ordnance Survey Ireland) stating that the copy is a true copy of the map, or any particular part of it, may without proof of signature of that officer, be produced in any court and in all legal proceedings and is evidence, unless the contrary is shown, of the map, or any particular part of it.â.
Amendment of section 4 of Agriculture (Research, Training and Advice) Act 1988
5. Section 4 of the
Agriculture (Research, Training and Advice) Act 1988
is amended by the insertion of the following subsection after subsection (8) :
â(9) Teagasc may develop and operate that part of the land the subject of the gift to the Nation, referred to in section 3(2) (b) (amended by
section 3
of the Johnstown Castle Agricultural College (Amendment) Act 2014) of the
Johnstown Castle Agricultural College (Amendment) Act 1959
, for heritage, tourism, amenity or recreational purposes.â.
Short title and collective citation
6. (1) This Act may be cited as the Johnstown Castle Agricultural College (Amendment) Act 2014.
(2) The Johnstown Castle Agricultural College Acts 1945 to 1996 and this Act may be cited together as the Johnstown Castle Agricultural College Acts 1945 to 2014.
