Short title, commencement and collective citation Acts Referred to Fisheries (Amendment) Act 1962 (No. 31) Inland Fisheries Act 2010 (No. 10) Inland Fisheries Acts 1959 to 2010 Number 16 of 2017 INLAND FISHERIES (AMENDMENT) ACT 2017 An Act to amend the Inland Fisheries Act 2010 to provide for Inland Fisheries Ireland to have power to bring summary proceedings for certain offences; to provide for certain penalties; and to provide for related matters. [6th July, 2017] Be it enacted by the Oireachtas as follows: Definitions 1. In this Act “Act of 2010” means the Inland Fisheries Act 2010 . Amendment of section 2 of Act of 2010 2. Section 2 of the Act of 2010 is amended by the insertion of the following definition: “ ‘Act of 1962’ means the Fisheries (Amendment) Act 1962 ;”. Amendment of section 77 of Act of 2010 3. Section 77 of the Act of 2010 is amended— (a) by the substitution of the following Part for Part 2 of the Table to the section— “PART 2 Reference Number (1) Section of Act of 1962 (2) Penalty (3) 1. 27. A fine not exceeding €500. 2. 28(1). A fine not exceeding €1,000 together with an amount not exceeding €250 for each salmon and €50 for each trout in respect of which the offence under that section is committed provided that the total amount of the fine shall not exceed €2,500. 3. 28(3), 28(5). A fine not exceeding €1,000. 4. 29. A fine not exceeding €2,000 or imprisonment for a term not exceeding 6 months or both. ”, and (b) by the substitution of “Section of Act of 1994” for “Section of Principal Act” in column 2 of Part 3 of the Table to the section. Summary proceedings 4. Part 4 of the Act of 2010 is amended by the insertion of the following section after section 80: “80A. Summary proceedings may be brought and prosecuted by IFI for an offence under the following Acts: (a) the Principal Act; (b) the Act of 1962; (c) the Act of 1994; (d) this Act.”. Short title, commencement and collective citation 5. (1) This Act may be cited as the Inland Fisheries (Amendment) Act 2017. (2) This Act shall come into operation on such day or days as the Minister for Communications, Climate Action and Environment may by order or orders appoint either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions. (3) The Inland Fisheries Acts 1959 to 2010 and this Act may be cited together as the Inland Fisheries Acts 1959 to 2017 and shall be construed together as one.
