- No. VIII - 1184 Vilnius CHAPTER I PUBLICATION AND COMING INTO FORCE OF REPUBLIC OF LITHUANIA LAWS AND OTHER LEGAL ACTS ARTICLE
- Publication of the laws and other legal acts in the “Official Gazette” shall constitute their official publication. The date of their publication in the “Official Gazette, which is indicated on the first page of every publication, shall be the day of their release. An official text of the law or another legal act shall be that which shall be signed by an official, who has this right in accordance with the laws. ARTICLE
- According to this Law the following must be published in the “Official Gazette:” 1) the laws of the Republic of Lithuania; 2) the international agreements ratified by the Republic of Lithuania Seimas; 3) decrees of the President of the Republic; 4) the resolutions of the Republic of Lithuania Government; 5) resolutions, conclusions and also decisions of the Constitutional Court to accept for deliberation requests or proposals stipulated in the Constitution. The other legal acts passed by the Republic of Lithuania Seimas, orders by ministers, heads of Government institutions and other state governing institutions and other normative and legal acts, confirmed by orders and decisions as well as resolutions of the Bank of Lithuania Board in which legal norms shall be established, amended or acknowledged as no longer valid. Must be published in the “Official Gazette” as well. (Amended 18 May 1999) The laws and other legal acts indicated in this Article, shall be officially published by the officials who signed them. ARTICLE
- Legal acts passed by the Republic of Lithuania Seimas, excepting the laws, decrees of the Republic President, Republic of Lithuania Government resolutions and resolutions by the Bank of Lithuania authorities, in which legal normative acts are not established, amended or acknowledged as no longer valid, Constitutional Court decisions of no general significance in the estimation of the persons who have signed them, may remain unpublished in the “Official Gazette.” Regardless of whether or not these acts are published in the “Official Gazette,” they must be sent out to the state institutions, enterprises, and organisations, legal and natural persons mentioned in them. The orders of ministers, heads of and other Government institutions and other state governing institutions and other legal acts confirmed by orders, which do not establish, amend or acknowledge legal norms as no longer valid, in the estimation of the persons who signed them, may be published in the “Official Gazette” annex, the “Information Bulletin.” Legal acts, which contain some information containing state or official secrets, shall not be published in the “Official Gazette.” These acts must be sent to those institutions, which according to the procedure established by laws, may issue information comprising State or official secrets. - The laws of the Republic of Lithuania shall come into force upon their signing and official publication in the “Official Gazette,” by the Republic President, provided a later date of coming into force is not stipulated in the same laws. If the Republic President does not return the law passed by Seimas back to the Seimas for repeat deliberation, according to the first paragraph of Article 71 of the Republic of Lithuania and fail to sign it, this type of law shall come into force after it is signed and published in the “Official Gazette” by the chairman of Seimas. A law or other legal act adopted by referendum, shall come into force, when the Republic President signs it and publishes it formally in the “Official Gazette.” If the Republic President fails to sign such a law within the period of time stipulated in paragraph four of Article 71 of the Constitution of Republic of Lithuania and does not publish it in the “Official Gazette,” the law shall come into force following its signing by the Chairman of Seimas and publication in the “Official Gazette.” ARTICLE
- Legal acts passed by Republic of Lithuania Seimas, with the exception of laws, shall come into force the day following their publication in the “Official Gazette,” provided the procedure of coming into force, shall not be established in the acts themselves. ARTICLE
- Decrees of the Republic President shall come into force the day after their publication in the “Official Gazette,” if another date is not established by the decrees themselves. ARTICLE

- The decisions by the Government of the Republic of Lithuania, by which legal norms are established, amended or acknowledged as no longer valid, shall come into force following the day, when signed by the Prime Minister or the appropriate minister, they shall be published in the “Official Gazette,” provided a later coming into force date has not been established by the decision itself. The decisions by the Government of the Republic of Lithuania. By which legal norms are not established, amended or acknowledged as no longer valid, also the Prime Minister’s decrees shall come into force on the day of their signing even though, they have been published in the “Official Gazette,” provided the later date of their coming into force has not been established in the resolutions and orders themselves. (Amended 18 May 1999) ARTICLE
- A decision by the Constitutional Court to accept for consideration a recommendation by the Republic President, regarding whether a Government Act is in compliance with the Constitution, or whether a decision to accept for consideration a decision by the Seimas, which requests consideration, or a Republic President Act or Government Act, corresponds to the Constitution, shall come into force, from the day of publication of a formal decision by the Constitutional Court, in the “Official Gazette.” A decision adopted by the Constitutional Court, to the effect that the disputed act is not contrary to the Constitution, and shall come into effect on the day when it was published in the “Official Gazette.” ARTICLE
- Orders by ministers, heads of Government institutions, other state governing institution heads and other legal acts and decisions by the Bank of Lithuania Board, by which legal norms are established, amended or acknowledged as having become invalid, shall be amended, shall come into force on the day following the publication thereof in the “Official Gazette,” provided that a later date for their coming into force shall not be stipulated by the legal acts themselves. The orders of state institution heads indicated in this Article and other legal acts confirmed by orders and also, resolutions by Bank of Lithuania Board shall not come into force until such time as they shall be published in the “Official Gazette.” ARTICLE 10 1 The legal acts indicated in Article 2 of this Law must appear in the Internet pages of Seimas as well as of the institution which has adopted them, within three days of their formal publication in the “Official Gazette.” Legal acts included in paragraph 1 of Article 3 of this Law, must be published in the Internet pages of the institution which has adopted them, within 3 days of the coming into force thereof. Legal acts, which contain information comprising State or official secrets, shall not be published in the Internet. ARTICLE
- Legal acts passed by higher administrative units of governing institutions, municipalities and their executive bodies, in which the legal norms are established amended or acknowledged as having become invalid, shall come into force on the day following their publication in the local press, provided a later date for coming into force thereof has not been stipulated there. CHAPTER II “OFFICIAL GAZETTE” ARTICLE
- The “Official Gazette” shall be published in place of “Republic of Lithuania Seimas and Government News.” ARTICLE
- The “Official Gazette” in the Lithuanian language shall be published no less frequently than twice a week (8 times a month). According to need, the “ Official Gazette” may be published more frequently, as well. The “Official Gazette” may be published in other languages to publicise legal acts. A legal act published in other than Lithuanian language shall indicate that it is a translation from Lithuanian. ARTICLE
- An index of the published legal acts shall be published annually as an annex to the “Official Gazette” and an index of the laws currently in force in the Republic of Lithuania, compiled by the Ministry of Justice. The “Official Gazette shall be published by the state enterprise Seimas publishing house, “Official Gazette.” ARTICLE
- The “Official Gazette” includes the following chapters: 1) “Chapter I. The Laws of the Republic of Lithuania;” 2) “Chapter II. The International Agreements of the Republic of Lithuania;” 3) “Chapter III. Other Legal Acts Passed by the Republic of Lithuania Seimas; 4) “Chapter IV. The Decrees of the President of the Republic of Lithuania;” 5) “Chapter V. Government Resolutions of the Republic of Lithuania;” 6) “Chapter VI. The Decisions and Resolutions and Conclusions of the Constitutional Court.” 7) “Chapter VII. The Orders and Other Normative Legal Acts of Ministers, heads of Government Institutions and Heads of Other State Governing Institutions and other Normative Acts Confirmed by Laws, and the Decisions by the Bank of Lithuania Board.” ARTICLE
- The editorial office of the “Official Gazette,” shall publish in separate issues, “Information Reports.” an annex to “Official Gazette.” Published in this publication: 1) individual legal acts of ministers, Government institutions, other State governing institutions i.e., single acts of application of law intended for a specific entity or a group of entities characterised by individually defined group of entities; 2) information and reports, the publication whereof in the “Official Gazette,” shall be established by Republic of Lithuania laws and Government resolutions; 3) decisions and reports by the Central Electoral Committee; 4) draft laws and legal acts, which per decision of Seimas are published for public deliberation; 5) information bulletins regarding more significant events taking place in the Seimas and its committees such as, sessions, reception of delegations and visits. ARTICLE
- The following shall be published in the “Official Gazette:” 1) in Chapter I, all of the constitutional laws of Republic of Lithuania, other laws, also resolutions on the procedure of coming into force of laws, the Statute of the Republic of Lithuania and composite parts thereof; 2) in Chapter II, international agreements of the Republic of Lithuania ratified by the Republic of Lithuania Seimas; 3) in Chapter III, legal acts passed by Republic of Lithuania, excepting laws, resolutions, statements, appeals and other documents; 4) in Chapter IV: decrees of the Republic President; 5) in Chapter V: normative acts of the Republic of Lithuania Government and, if needed, orders of the Prime Minister; 6) in Chapter VI: decisions and conclusions, decisions of the Constitutional Court to accept for deliberation the requests and recommendations indicated in the Constitution; 7) in Chapter VII: orders by ministers, heads of Government institutions and other institutions and other normative legal acts approved by orders, and resolutions by the Bank of Lithuania Board. ARTICLE
- A consecutive number shall be attached to legal acts published in the “Official State Gazette.” ARTICLE
- The Bank of Lithuania, ministries, departments and Government institutions and other State Governing institutions, courts and other law protection institutions, district and city boards, higher administrative unit governing institutions, other legal persons belonging to the state regulation area must subscribe and keep on file issues of “Official Gazette.” State communication services must guarantee that the “Official Gazette” shall be furnished to the subscribers indicated in paragraph 1 of this Article and others, no later than the day after the publication thereof. ARTICLE
- Official collections of legal acts may be published in the “Official Gazette,” on the basis of published legal acts. These collections may be published by the services of Republic of Lithuania Seimas, Lithuanian Republic Government, Republic of Lithuania Ministry of Justice and also, by the “Official Gazette.” ARTICLE
- Services of the Republic of Lithuania Seimas, Republic President, Republic of Lithuania Government, Bank of Lithuania, ministries, departments and state institutions as well as, of other state governing institutions, must guarantee that the signed laws and other legal acts will be submitted to the “Official Gazette” editorial office no later than within 3 days of the signing thereof. Legal acts submitted to the editorial office must be edited. Legal acts submitted for publication shall not be edited by the “Official Gazette” editorial office. ARTICLE
- To acknowledge as no longer valid: 1) the Supreme Council Presidium of the Lithuanian SSR and the Council of Ministers of the Lithuanian SSR Resolution of September 24, 1980, “On Lithuanian SSR Supreme Council and Government Gazette.” 2) the Supreme Council Presidium of the Lithuanian SSR Order of October 29, 1980, “On the Procedure of Publication and Coming into Force of Lithuanian SSR Laws, Lithuanian SSR Supreme Council Resolutions and Other Acts, Lithuanian SSR Supreme Council Presidium Orders and Resolutions.” ARTICLE
- This Law shall come into force upon expiration of 30 days from the signing thereof by the Republic President. I promulgate this Law passed by the Seimas of the Republic of Lithuania. PRESIDENT OF THE REPUBLIC ALGIRDAS BRAZAUSKAS
