APPROVED APPROVED By Decision No. 1580 of the Board of the Seimas of the Republic of Lithuania, adopted on 19 May 1999 REGULATIONS OF THE OFFICE OF THE SEIMAS OF THE REPUBLIC OF LITHUANIA I. General Provisions
- The Seimas of the Republic of Lithuania shall have the Office (hereinafter referred to as the Office of the Seimas) which provides services to the Seimas.
- The Office of the Seimas shall act in compliance with the Constitution of the Republic of Lithuania, the Statute of the Seimas, laws of the Seimas, resolutions of the Seimas, resolutions of the Government, decisions of the Board of the Seimas, directives of the Chairman of the Seimas, and these Regulations.
- The Office of the Seimas shall be a legal person, having bank accounts in Litas and foreign exchange, and two round seals bearing the Lithuanian State Emblem and the name of the Office of the Seimas. The Head of the Office of the Seimas shall be responsible for the use of the said seals.
- The Board of the Seimas shall approve the structure, staff list and salary limits for the Office of the Seimas. Officials-employees of the Office of the Seimas shall be employed by competition or upon passing qualifications examinations. Other employees of the Office of the Seimas shall be employed and dismissed by order of the Head of the Office of the Seimas, after consultation with the head of an appropriate division.
- The Office of the Seimas shall be financed from the State Budget. II. Tasks and Functions of the Office of the Seimas
- The tasks of the Office of the Seimas shall be as follows: 1.
- to ensure smooth functioning of the Seimas; to provide to the Chairman of the Seimas, Deputy Chairmen of the Seimas, Chancellor of the Seimas, Members of the Seimas, Committees, Commissions and Parliamentary Groups of the Seimas necessary assistance, information, legal, financial, material, technical and other services to ensure parliamentary activities; 1.
- to prepare in a prescribed manner material for plenary sittings of the Seimas, to document legal acts adopted by the Seimas, directives of the Chairman of the Seimas, decisions of the Board of the Seimas, to transmit them to State institutions, enterprises, agencies and organisations, to publish them in the Valstybės žinios (Official Gazette) and in the press; 1.
- to create proper working conditions for the Members of the Seimas and employees of the Office of the Seimas; 1.
- to perform functions of the founders of State enterprises established by the Office of the Seimas; 1.
- the Office of the Seimas may have other tasks provided for in laws and other legal acts.
- When carrying out the tasks assigned to the Office of the Seimas, it shall perform the following functions: 2.
- assist the Seimas, Committees and Commissions of the Seimas, other institutions established by the Seimas in drafting laws, resolutions and other legal acts, carrying out parliamentary scrutiny and other functions; 2.
- draft laws, resolutions of the Seimas and other legal acts adopted by the Seimas; 2.
- register submitted drafts of laws, resolutions of the Seimas and other legal acts, as well as proposals, decrees of the President of the Republic, systematise and codify them, and provide information pertaining to the requirements for drafts submitted for registration; 2.
- consider drafts of legal acts, letters, official documents submitted by State institutions, enterprises, agencies, organisations and individuals to the Seimas, the Chairman of the Seimas, the Deputy Chairmen of the Seimas, the Chancellor of the Seimas or other Members of the Seimas, and, upon their instruction, prepare proposals and replies; 2.
- ensure publication of registered legal acts and legal acts adopted by the Seimas; 2.
- submit to the Seimas conclusions regarding drafts of laws, Seimas resolutions and other legal acts presented to the Seimas for consideration; 2.
- edit drafts of laws, other legal acts; prepare the originals of laws, resolutions of the Seimas, directives of the Chairman of the Seimas and other legal acts which are submitted to the President of the Republic, the Chairman of the Seimas for signing; 2.
- prepare verbatim records of sittings of the Seimas, reviews of legal acts and statistical data on publication of legal acts; 2.
- ensure translation of adopted legal acts and other documents into foreign languages, as well as interpreting at various meetings and events; 2.
- collect, prepare and process information necessary for Seimas activities, furnish it to the Seimas; 2.
- examine material pertaining to the activities of the Office of the Seimas, which is provided by the mass media, submit proposals to the Board of the Seimas; 2.
- prepare and furnish to State institutions, local authorities, diplomatic missions, mass media reports of the Press Service regarding drafts of laws under preparation, adopted laws and other legal acts, as well as information provided by others, concerning Seimas activities; 2.
- accredit employees of the mass media, develop public relations; 2.
- ensure the functioning of information technology equipment in the Seimas buildings and other premises where events organised by the Seimas are held; 2.
- manage the Seimas information system and databases contained in it; 2.
- organise clerical work of the Seimas and the Office of the Seimas; 2.
- ensure acquisition, storage and use of archival records of the Seimas and the Office of the Seimas; 2.
- generalise information received from the residents in oral or written form. When necessary, it shall submit information and manners of resolution to the Board of the Seimas for consideration. 2.
- establish and maintain contacts with foreign parliaments and their institutions, international organisations; 2.
- organise competitions for officials, performance evaluation of officials, qualifications improvement, and carry out other requirements regarding personnel issues; 2.
- administer acceptance to work, transference and dismissal from work of employees of the Office of the Seimas, assistants-secretaries of the Seimas members, advisers to the parliamentary groups; form personal files of the Seimas members. 2.
- administer reporting and accounting, carry out financing of the Seimas and its institutions; 2.
- control activities of state enterprises established by the Office of the Seimas; 2.
- provide servicing of events organised in the Seimas buildings by the Seimas and other institutions; 2.
- provide proper working conditions for the Chairman of the Seimas, the Members of the Seimas and employees of the Office of the Seimas; 2.
- perform other functions laid down by laws and other legal acts.
- Tasks of the Office of the Seimas shall be implemented by the divisions of the Office of the Seimas. III. Rights of the Office of the Seimas
- The Office of the Seimas shall have the right: 1.
- to receive conclusions, proposals, information and material of databases, registers, as well as other information and material of the Seimas committees, commissions, parliamentary groups, as well as State institutions, State enterprises, agencies and organisations, which are necessary for the work of the Seimas and Seimas institutions; 1.
- to invite specialists of State institutions (with the consent of their heads), experts to take part in consideration of the issues related to the work of the Seimas and Seimas institutions, as well as residents’ proposals, requests and complaints; 1.
- to submit proposals to the Board of the Seimas regarding improvement of the structures of the Office of the Seimas; 1.
- to make contracts with natural, legal persons and enterprises which do not have the rights of a legal person; 1.
- in a prescribed manner, to establish, reorganise and liquidate State enterprises established by the Office of the Seimas.
- The Office of the Seimas shall enjoy other rights provided by laws and other legal acts. IV. Structure and Work Organisation of the Office of the Seimas. Duties and Rights of the Head of the Office of the Seimas
- By the advice of the Head of the Office of the Seimas, the Board of the Seimas shall approve the structure of the Office of the Seimas, staff list and salary limits.
- The Office of the Seimas shall be directed by the Head of the Office of the Seimas who is appointed and dismissed by the Board of the Seimas.
- The Head of the Office of the Seimas shall have deputies - Heads of the General Affairs Department and International Relations Department. The Board of the Seimas shall in a manner prescribed by laws appoint by competition and dismiss Deputy Heads of the Office of the Seimas.
- The Head of the Office of the Seimas shall: 4.
- be responsible for the operation of the Office of the Seimas, as well as for the activities of State enterprises established by the Office of the Seimas; 4.
- present the structure, staff list and salary rates of the Office of the Seimas to the Board of the Seimas for approval; 4.
- approve the order of business of the Office of the Seimas; 4.
- present to the Board of the Seimas for approval the procedure of work related to State secrets in the Office of the Seimas; 4.
- establish the fields of activities of Deputy Heads of the Office of the Seimas and divisions of the Office of the Seimas; 4.
- organise meetings of the heads of the divisions; 4.
- report to the Chairman of the Seimas and the Chancellor of the Seimas on the important documents received at the Office of the Seimas; 4.
- issue instructions to the heads of the divisions; 4.
- issue orders on the issues of activities of the Office of the Seimas, supervise their enforcement; 4.
- conclude employment contracts with employees of the Office of the Seimas, employ, transfer and dismiss employees of the Office of the Seimas and heads of State enterprises established by the Office of the Seimas; 4.
- grant permits to employees of law enforcement bodies, ministries, Government institutions, county governors’ administrations, local authority institutions, enterprises, agencies and organisations as well as to other persons for access to Seimas documents which are preserved in the archives of the Office of the Seimas; 4.
- establish and maintain relations with parliaments of foreign countries and international organisations; 4.
- on the advice of the head of the division, give incentives to employees of the Office of the Seimas and apply disciplinary sanctions to them; 4.
- establish official salaries and extra pays of employees of the Office of the Seimas without exceeding the approved wage fund; 4.
- have care of improvement of the structure of the Office of the Seimas as well as working conditions of the Members of the Seimas and employees of the Office of the Seimas; 4.
- solve issues regarding business trips and internships (qualifications improvement); 4.
- approve the holiday schedule of employees of the Office of the Seimas; 4.
- be a manager of budgetary allocations assigned to the Office of the Seimas, in a manner prescribed by laws manage and use the property entrusted to the Office of the Seimas and dispose it; 4.
- be a keeper of the Seimas seals and be responsible for the use thereof; 4.
- discharge other powers assigned by laws, the Chairman of the Seimas, the Board of the Seimas, as well as execute assignments given by the Seimas, the Chairman of the Seimas and the Board of the Seimas.
- If the Head of the Office of the Seimas is away, has been taken ill or is unable to discharge the duties of his office due to other reasons, the Office of the Seimas shall be temporarily directed by the deputy Head of the Office of the Seimas - Head of the General Affairs Department. V. Duties and Rights of the Heads of the Divisions of the Office of the Seimas
- The heads of the divisions of the Office of the Seimas and their deputies shall be appointed by competition and dismissed by the Board of the Seimas in accordance with the procedure established by laws. Salaries of the heads of the divisions of the Office of the Seimas shall be approved by the Board of the Seimas.
- The heads of the divisions of the Office of the Seimas shall be accountable and responsible to the Head of the Office of the Seimas.
- If the head of a division of the Office of the Seimas is away, has been taken ill or is unable to discharge the duties of his office, the division shall upon the instruction of the Head of the Office of the Seimas be temporarily directed by the deputy head of the division or another employee.
- The heads of the divisions of the Office of the Seimas shall: 4.
- discharge functions provided for in regulations of the divisions approved by the Board of the Seimas, or assigned by the Head of the Office of the Seimas; 4.
- direct the activities of the divisions or subordinate employees and be responsible for the fulfilment of the functions assigned to them; 4.
- assign duties to subordinate employees, ensure appropriate organisation of work, discipline and proper record keeping; 4.
- analyse the state of affairs and main problems related to the fields assigned to him, organise the preparation of appropriate conclusions and proposals; 4.
- attend meetings of the Board of the Seimas and meetings of the commissions (working groups) established by the Board of the Seimas, meetings of the Seimas committees, commissions, discussions when the issues within their competence are being solved; 4.
- within the competence endorse draft decisions, other documents submitted to the Board of the Seimas; 4.
- in a prescribed manner report to the Head of the Office of the Seimas on the documents received by the Office of the Seimas; 4.
- sign official documents themselves (in their absence, this is done by the persons deputising for them), return (forward) the documents received not according to their jurisdiction, send certain documents or material for familiarisation purposes, conduct a correspondence regarding solution of the issues raised in individuals’ letters; 4.
- make proposals to the Head of the Office of the Seimas regarding the amount of salaries, application of incentives and disciplinary sanctions to employees of the divisions; 4.
- carry out other instructions and directions of the Board of the Seimas, the Chancellor of the Seimas and the Head of the Office of the Seimas. VI. Responsibility of Employees of the Office of the Seimas The Head of the Office of the Seimas, his Deputies, the heads of the divisions of the Office of the Seimas, and the employees of the Office of the Seimas shall be responsible for the proper performance of the duties assigned to them.
