  1. Revised Version of the Law of the Republic of Lithuania on Sugar The Law of the Republic of Lithuania on Sugar shall be amended to read as follows: “REPUBLIC OF LITHUANIA LAW ON SUGAR Article
  2. Purpose of the Law The purpose of this Law is to establish the relations of participants in the sugar market and public authorities. Article
  3. Main Definitions
  4. “Sugar” means a sweet crystalline or liquid product processed from raw materials.
  5. “White sugar” means sugar not flavoured or coloured or containing any other added substances.
  6. “Minimum State price of sugar” means a minimum price, fixed by the Government of the Republic of Lithuania or an institution authorised by it, on sugar produced in accordance with a quota for white sugar.
  7. “Raw material” means sugar beet, raw sugar (a product of the unfinished sugar production which is obtained upon processing sugary plants), molasses.
  8. “Sugar regime” means the totality of regulatory measures approved by the Government of the Republic of Lithuania or a body authorised by it, in respect to sugar beet growing, raw material import, processing, sugar market.
  9. “Products to which the sugar regime is applicable” means a list of products whose production, import and export may influence a total balance of sugar production in Lithuania; the said list is approved by the Government of the Republic of Lithuania or a body authorised by it.
  10. “Sugar market” means the sphere of exchange comprising the purchase and sale, import and export of sugar, raw material, and the products to which the sugar regime is applicable.
  11. “Participants in the sugar market” means sugar beet growers, producers, importers, traders, and users of sugar, raw material and sugar containing products to which the sugar regime is applicable.
  12. “Quota for sugar beet growing, purchase and processing” means a quantity of sugar beet which the sugar industry must purchase and process.
  13. “Quota for the production of white sugar” means the amount of white sugar designated for sugar producers and sugar beet growers to produce in order to satisfy the national needs. Article
  14. State Sugar Policy The State shall provide necessary conditions of growing and processing of local raw material - sugar beet, promote the development of the said sphere, ensure that the sugar beet growing in the regions of the present zones of growing (Kėdainiai, Marijampolė, Panevėžys and Pavenčiai) shall be preserved. Article
  15. State Regulatory Measures
  16. In the Republic of Lithuania sugar beet growing and processing, purchase and sale of locally-produced sugar, import and export of sugar, raw material, products to which the sugar regime is applicable shall be regulated by the State and carried out in accordance with the sugar regime approved by the Government of the Republic of Lithuania or a body authorised by it. The regime shall comprise the following: 1) procedure of formation of the balance for sugar; 2) procedure of determining an annual amount of sugar needed by the market; 3) rules related to the establishment of sugar beet amount corresponding to a quota for white sugar production, and to the determination of minimum marginal sugar beet prices; 4) list of sugar, raw material and products to which the sugar regime is applicable, regulation and control of the import thereof; 5) control of the production and sale of sugar, routine licensing of the import and export of sugar, raw material; 6) rules related to the allocation of quotas for white sugar production to sugar producers and sugar beet growers; 7) procedure of fixing of a minimum State price of sugar.
  17. The Government of the Republic of Lithuania or a body authorised by it may apply other regulatory measures of the sugar market, which protect the interests of sugar beet growers, sugar producers and user.
  18. Where, as a result of natural disasters or poor crop, sugar produced from sugar beet is in short supply in the domestic market, import of raw material or sugar shall be regulated by the Government of the Republic of Lithuania or a body authorised by it. Article
  19. Sugar Sale, Storage and Transportation Requirements In the Republic of Lithuania, undertakings shall be prohibited from selling, storing and importing sugar without accounting documents having a legal power. The procedure for sugar storage and transportation shall be established to natural persons by the Government of the Republic of Lithuania. Article
  20. Sugar Beet Growing, Purchasing and Processing
  21. White sugar production quotas shall apply to the production of sugar from sugar beet. A necessary amount of sugar beet to be purchased shall be computed in order to fulfil such quotas.
  22. The State shall guarantee economic safety of the national white sugar market.
  23. The quota for sugar production may not be less than the quantity of sugar consumed within the country during the last year. 4.The Government of the Republic of Lithuania shall fix an annual quota for white sugar production. The Government or an institution authorised by it shall allocate white sugar quotas to sugar producers. Sugar producers shall transfer white sugar production quotas into an amount of sugar beet necessary for the fulfilment of the quotas. Quotas shall be allocated to sugar beet growers in accordance with the procedure established by the Agricultural Chamber.
  24. The Agricultural Chamber shall settle disputes arising between the growers regarding the quotas.
  25. After a grower stops sugar beet growing, the quota held by the grower shall be allocated to other sugar beet growers of the regions of the same zone in accordance with the procedure established by the Agricultural Chamber.
  26. When changing the national white sugar production quota it shall be raised or reduced proportionately for all quota holders, and the amount of purchased sugar beets necessary for the fulfilment of quotas shall be increased or decreased appropriately. If a sugar producer does not fulfil a production quota it shall be proportionately allocated to other sugar producers.
  27. In the case of increase of the national white sugar production quota, 5 per cent of the increased part of the amount of sugar beet necessary for the fulfilment of quotas shall be allocated to new sugar beet growers from that zone.
  28. Actual costs of the delivery of the amount of sugar beet purchased in accordance with white sugar production quotas, from growers’ temporary storage sites to sugar producers shall be compensated from the funds of sugar producers.” I hereby promulgate this Law passed by the Seimas of the Republic of Lithuania.
