GOVERNMENT OF THE REPUBLIC OF LITHUANIA Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 505 ON THE REORGANISATION OF THE MARKET SURVEILLANCE INSTITUTIONS 4 May 2000 Vilnius Pursuant to Articles 12 and 31 of the Law of the Republic of Lithuania on Product Safety and Article 13 of the Law of the Republic of Lithuania on Food, the Government of the Republic of Lithuania has resolved:

  1. To reorganise, as of 1 July 2000, the State Veterinary Service and the veterinary agencies subordinate to it (total staff 1379), the Lithuanian State Quality Inspectorate under the State Competition and Consumer Protection Service (hereinafter referred to as the Lithuanian State Quality Inspectorate) (total staff 285) and the State Hygiene Inspectorate under the State Public Health Care Service under the Ministry of Health Care (hereinafter referred to as the State Hygiene Inspectorate), its branches at the county public health centres, the subsidiaries of the centres in towns and districts (total staff 247) into the following central institutions of state administration, listed below (ensuring the implementation of the functions provided for by law of the institutions subjected to reorganisation and the taking over and continuity of international obligations), specifying for each one of them the maximum allowed number of staff: 1.
  2. the State Food and Veterinary Service under the Government of the Republic of Lithuania (hereinafter referred to as the State Food and Veterinary Service) - 1364; 1.2.the State Inspectorate for Non-food Products under the Government of the Republic of Lithuania (hereinafter referred to as the State Inspectorate for Non-food Products) -
  3. To task the Ministry of Agriculture to: 2.
  4. reorganise, as of 1 July 2000, the State Inspectorate for Seeds (total staff 186) and the State Inspectorate for Grain (total staff 17), establishing the State Service for Seeds and Grain under the Ministry of Agriculture (hereinafter referred to as the State Service for Seeds and Grain) and to fix the maximum allowed number of staff not in excess of 150; 2.
  5. perform the functions of the founder of the State Service for Seeds and Grain and to approve the regulations of the Service;
  6. To establish that as of 1 July 2000: 3.
  7. the main functions of the State Veterinary Service and the agencies subordinate to it, related to veterinary control of animal health and welfare, production and processing of animal products, control of veterinary medicinal products, identification and registration of animals, harmonisation of veterinary legislation with the EU legislation shall be transferred to the State Food and Veterinary Service (at the same time guaranteeing the taking over and continuity of international obligations in the veterinary sphere); 3.
  8. The functions of the State Hygiene Inspectorate, its branches at the county public health centres, subsidiaries of the centres in towns and districts as well as of the Lithuanian State Quality Inspectorate related to the control of quality of food and non-food products and services provided to consumers shall be transferred to the institutions specified in subparagraphs 1.

  10. - the State Food and Veterinary Service and the State Inspectorate for Non-food Products.
  11. To charge the working group formed by the Directive of the Prime Minister of the Republic of Lithuania of 11 February 2000 No. 27 “Regarding the Formation of the Working Group” (hereinafter referred to as the working group), together with Ministry of Health Care, Ministry of Agriculture, Ministry of Economy, Ministry of Public Administration Reforms and Local Government Affairs, State Veterinary Service and Lithuanian State Quality Inspectorate to draft and present in the established manner to the Government of the Republic of Lithuania by 17 May 2000: 4.
  12. draft regulations of the State Food and Veterinary Service; 4.
  13. draft regulations of the State Inspectorate for Non-food Products.
  14. To task the Ministry of Health Care together with the working group by 10 May 2000 to: 5.
  15. prepare the project for the reorganisation, in accordance with the provisions of paragraph 1, the State Hygiene Inspectorate, its branches at the county public health centres, subsidiaries of the centres in towns and districts; 5.
  16. submit to the Ministry of Finance estimates of financial needs related to the reorganisation of the State Hygiene Inspectorate and payments provided for by law to the employees working at the State Hygiene Inspectorate subjected to reorganisation, also in its branches at county public health centres and subsidiaries of the centres in towns and districts.
  17. To charge the Ministry of Agriculture together with the working group by 10 May 2000 to: 6.
  18. prepare the project for reorganising, according the provisions of paragraph 1, the State Veterinary Service and veterinary agencies subordinate to it; 6.
  19. prepare the project for reorganising, according the provisions of paragraph 2, the State Inspectorate for Grain; 6.
  20. prepare the project for reorganising, according the provisions of paragraph 2, the State Inspectorate for Seeds; 6.
  21. submit to the Ministry of Finance estimates of the financial needs, related to the reorganisation of the state institutions specified in paragraphs 6.1-6.
  22. and payments provided for by law to the employees working at the institutions subjected to reorganisation.
  23. To charge the Ministry of Economy together with the working group by 10 May 2000 to: 7.
  24. prepare the project for the reorganisation, according the provisions of paragraph 1, of the Lithuanian State Quality Inspectorate; 7.
  25. submit to the Ministry of Finance estimates of the financial needs, related to the reorganisation of the Lithuanian State Quality Inspectorate and payments provided for by law to the employees working at the Lithuanian State Quality Inspectorate subjected to reorganisation.
  26. To charge the Ministry of Finance, Ministry of Health Care, Ministry of Economy, Ministry of Agriculture together with the working group to submit to the Government of the Republic of Lithuania, by 17 May 2000, estimates of financial needs related to the establishment of the State Veterinary and Food Service and the State Inspectorate for Non-food Products as well as payments to the employees working at the state institutions subjected to reorganisation.
  27. To establish that the institutions specified in paragraphs 1.
  28. and 1.
  29. shall commence their activities from 1 July
  30. To charge the Ministry of Public Administration Reforms and Local Government Affairs to: 10.
  31. form the State Veterinary Service reorganisation commission for performing the reorganisation procedures; 10.
  32. form the Lithuanian State Quality Inspectorate reorganisation commission for performing the reorganisation procedures; 10.
  33. form a commission for reorganising the State Hygiene Inspectorate, its branches at county public health centres, subsidiaries of the centres in towns and districts for performing the reorganisation procedures.
  34. To charge the working group together with the Ministry of Health Care, Ministry of Agriculture, Ministry of Economy, Ministry of Justice, Ministry of Public Administration Reforms and Local Government Affairs, State Veterinary Service to draft amendments and supplements to the legal acts related to the reorganisation of the institutions specified in this Resolution and submit the same in the prescribed manner to the Government of the Republic of Lithuania by 20 May
  35. To amend the Resolution of the Government of the Republic of Lithuania of 13 January 1998 No. 34 “Regarding the Number of Staff at Ministries and Institutions of the Government of the Republic of Lithuania”, setting the date of entry into force - as of 1 July 2000: 12.
  36. to supplement paragraph 3 of the above Resolution with the following subparagraphs: “the State Food and Veterinary Service under the Government of the Republic of Lithuania - 1364; the State Inspectorate for Non-food Products under the Government of the Republic of Lithuania - 100”; 12.2 to repeal the following subparagraphs of paragraph 3: “the Quality Inspectorate under the State Competition and Consumer Protection Service - 285; the State Veterinary Service - 25”.
