Official translation Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 29 ON THE NATIONAL PROGRAMME AGAINST THE COMMERCIAL SEXUAL EXPLOITATION AND SEXUAL ABUSE OF CHILDREN 11 January 2000 Vilnius In order to ensure the protection of the rights and legal interests of the child as well as to reduce the risk for children to become victims of sexual abuse and the commercial sexual exploitation, the Government of the Republic of Lithuania r e s o l v e s:
- to approve the National Programme against the commercial sexual exploitation and sexual abuse of children (attached);
- to authorize the Ministry of Social Security and Labour to set up a Coordination Commission to ensure the implementation of the programme under Article 1 of the programme in question;
- to approve the provision that a costs estimate to finance the programme is drawn up and approved annually by the Ministry of Social Security and Labour. GENERAL PROVISIONS
- Abuse, sexual abuse including, against children, the commercial sexual exploitation of children is a topical issue not only in Lithuania but also in other countries. It is viewed currently in Lithuania as a psychological, legal and social issue of the violation of the child’s rights.
- Article 19 of the United Nations Convention on the Rights of the Child (The Seimas of the Republic of Lithuania ratified it in 1995) provides that all States Parties to the Convention shall take all appropriate legislative, administrative, social and educational measures to protect children from abuse and sexual exploitation.
- The commercial sexual exploitation of children constitutes part of organized crime; therefore it is essential to undertake all actions to prevent children from being recruited by organized criminal groups.
- The current programme has been developed in accordance with the Declaration adopted at the World Congress against the commercial and sexual exploitation of children held in Stockholm in 1996 and the Plan of Action against the commercial and sexual exploitation of children. The participant states to the Congress committed themselves to take specialised local, national, regional and international measures to protect children from the commercial sexual exploitation and sexual abuse. The current programme has also been developed in accordance with the instruments adopted by the Council of Europe, the European Union, the Council of the Nordic States and the Council of the Baltic Sea States on the protection of child’s rights and planned joint projects and programmes in this field.
- The current programme is linked to existing and planned programmes in the area of the rights of the child and the protection of his legal interests: the National Health Programme for Children with Development Disorders, approved by the Governmental Resolution of the Republic of Lithuania No. 559 of 10 May 1996 (On the National Health Programme for Children with Development Disorders published in the Official Gazette No. 46-1122, in 1996); the National Crime Prevention Programme for Children and Minors which was approved by the Governmental Resolution No. 197 of 6 March 1997 (On the National Crime Prevention Programme for Children and Minors published in the Official Gazette No. 21-510, 1997) and the Organised Crime and Corruption Prevention Programme approved by the Governmental Resolution No. 62 of 15 January 1999 (On the Organised Crime and Corruption Prevention Programme published in the Official Gazette No. 10-220, 1999). The current programme should be related to the planned preventive and control programme on prostitution and trade in human beings.
- The programme has also been needed for carrying out a manifold analysis of crimes against children and to coordinate all the earlier adopted programmes, as well as to undertake complex schemes of actions (social, health care, psychological, educational and legal) to prevent the commercial sexual exploitation and sexual abuse against children and to ensure that all perpetrators who attempt to involve children into the illegal business of pornography or prostitution or sexual exploiters of children are properly punished. II. OVERVIEW OF THE SITUATION
- It is difficult to define the extent of abuse against children, as the abuser and the child are commonly very close. The data in Lithuania as well as the experience of other countries show that children most often are abused (sexually abused as well) within the family or in a close environment; only in one case out of ten children do not know the abuser. Children are afraid to reveal the abuse they have endured or are still suffering from, they generally keep silent and suffer. Consequently, the abuse experienced by children is not disclosed and offenders go unpunished. Children who have been subjected to sexual or other forms of abuse occurring in educational establishments often do not receive any pedagogical-psychological assistance or the assistance provided is not adequate. In Lithuania information on sexual abuse and the commercial sexual exploitation of children is accumulated and protected in their own areas of competence by the police, courts, personal health care institutions, regional (municipal) children’s rights protection agencies, various non-governmental organizations that are in charge of the protection of the child’s rights. The obtained data is very diverse and inaccurate; therefore it is essential to carry out research aimed at identifying the extent of the phenomenon, to adopt a proper national strategy in this area as well as to use the existing funds effectively and to raise public awareness towards the abused child.
- Abuse against children, the involvement of minors into the illegal pornography business and prostitution has been earlier criminalized and punishable by penalties, however, the greatest problem has been and still is the identification of abused children; the development of a preventive system to counter sexual exploitation of children and the method of its implementation; further enhancement of the legal system in this field; rehabilitation of abused children; treatment and rehabilitation of sexual offenders.
- Commercial sexual exploitation may cause serious all life-long impact and life-threatening consequences for the child’s physical, emotional and social development. The abused child may have difficulties in conceiving a child, die at childbirth, feel both physical and emotional incapacity due to the experienced abuse and fail to live a full-fledged life. Up to now most often the abused child is separated from the family and placed at the guardian institution, though existing qualified assistance at the institution is not sufficient enough.
- The Code of Administrative Law Violations of the Republic of Lithuania provides for administrative liability for the engagement in prostitution. However, current punitive norms are oriented primarily towards penalties and the formal criminal procedure, consequently, the child is made to testify repeatedly during the trial and tell several times about the suffered abuse and is forced to relive the unpleasant and distressing events and the experienced abuse. It is essential to safeguard the rights of the child who is a participant of the criminal procedure in commercial sexual abuse cases. The existing norms of the protection of the child’s rights in the Code of the Criminal Procedure have major weaknesses that should be eliminated in the context of reforming the juvenile system of criminal justice. It is necessary to safeguard the rights of the child at interrogations, to ensure the participation of the legal counsel and other persons during the interrogation, to shorten criminal procedure and try to reduce the number of interrogations.
- The data of the Ministry of Internal Affairs show that in 1998 there were 317 crimes where adults abused children (in 1997 – 377 crimes); out of which five crimes deal with the involment into prostitution (in 1997 there were no such crimes). Crime analysis of 1998 demonstrates that 96 criminal offences were committed with the intent of sexual abuse: 71 rape cases were detected in 1998 (in 1995 – 84, in 1996 – 83, in 1997 – 80), five cases of a sexual intercourse with a juvenile (in 1995 – 9, 1996 – 5, 1997 – 2), as well as 14 cases of a sexual intercourse between two men (in 1995 –10, 1996 and 1997 – 8 cases each year respectively). Violence and abuse against children provoke violence. Abused children themselves become ruthless towards others. According to the Ministry of Internal Affairs not a few similar crimes have been committed by children themselves. 21 rape cases were detected in 1998 (in 1995 – 33, 1996 – 29, 1997 – 16). In 1998 there were no solved cases of sexual acts performed with juveniles and homosexual acts; while both in 1995 and in 1996 there was one case registered each year of a sexual act performed with a juvenile as well as 6 cases when minor boys had a homosexual act in 1996 and two cases in 1997 (Article 122 of the Criminal Code of the Republic of Lithuania).
- The commercial sexual exploitation of children is associated with organized crime, i. e. to the involvement of children into the prostitution and pornography business. International cooperation of police officers is a key factor in the prevention of such criminal activities. Since 1991 Lithuanian has been a full member of the International Criminal Police Organisation (Interpol) with the National Bureau of Interpol representing Lithuania in this organization. As of 1998 the National Bureau has appointed one officer in charge of issues related to child abuse. III. MAJOR PROGRAMME OBJECTIVES
- The current programme includes educational, legal, social, medical, organizational, and information measures for the achievement of its strategic and tactical aims: to create conditions for combating the commercial sexual exploitation and sexual abuse of children and to foresee the combat methods for the future.
- In order to achieve the strategic, tactical and other programme objectives it is necessary:
- to create an effective preventive programme against sexual abuse and the commercial exploitation of children. The programme should curb the negative impact of social environment and various socially negative phenomena leading to sexual abuse against children and related breaches of the child’s personality; it is necessary to enhance public intolerance towards abusers and organized criminal groups that foster criminal intentions to violate the rights of the child and his legal interests; 14.
- to elaborate the legal basis by creating legal and organizational conditions to protect children from sexual abuse and the commercial sexual exploitation, to protect the rights of the child and his legal interests during the trial; 14.
- to facilitate the cooperation among national and municipal institutions and non-governmental organizations assisting the implementation of the current programme; 14.
- to seek effective bilateral, regional and international cooperation, to maintain close contacts with various international organizations assisting in combating the commercial sexual exploitation and sexual abuse of children.
- Major programme objectives are to fulfill: 15.
- its strategic aim - to create a preventive system of measures against sexual abuse and the commercial sexual exploitation of children; 15.
- its tactical aim - to define major reasons for sexual abuse and the commercial exploitation of children; to envisage ways of their elimination, to select the most appropriate procedures for the implementation of its strategic aim and to set up its implementation stages; 15.
- to attain other objectives:
- to create and develop a system of laws and other legal acts and the procedure of their implementation; to reinforce criminal liability for persons who have committed crimes (sexual including) against children and to develop rehabilitation measures for the victims of sexual abuse or the commercial sexual exploitation. It is equally important not only to elaborate norms of both criminal law and criminal procedure but also to consider whether social and health care services are accessible to children who are victims of sexual abuse and their families (psychological counseling, assistance in cases of a crisis, etc.). It is also required to consider legal regulation of crime prevention, information gathering and processing and harmonization of laws with international instruments;
- to set up a balanced system of institutions and individual groups active in the area of the protection of the child’s rights and clearly define their functions; to facilitate cooperation at the local, national and international level;
- to establish an information analytical and research methodological system aimed at creating conditions for the accumulation and analysis of data to reveal and predict tendencies of the commercial sexual exploitation and sexual abuse of children;
- Programme management and coordination is one of the principal conditions for programme implementation and for its positive outcome. It is so crucial due to the fact that the current programme constitutes part of other programmes in combating organized crime. IV. DEVELOPMENT OF THE PREVENTIVE SYSTEM AGAINST THE COMMERCIAL EXPLOITATION AND SEXUAL ABUSE OF CHILDREN
- Two major programme implementation stages are established: 17.
- Stage I covers the period of 2000-
- It is essential to determine the extent of sexual exploitation and sexual abuse against children and to consider strengthening control and preventive actions as well as to ensure the implementation of other related programmes; 17.
- Stage II covers the period of 2002-
- The essential principles of the control and preventive system should be created: the elaboration of a legal regulatory basis; the development of the system of preventive and control entities as well as the system of legal, economic, social, organizational and information analytical measures allowing to monitor the extent of the commercial sexual exploitation and sexual abuse of children. In parallel, the implementation of Stage I of the programme should be assessed and, if necessary, the objectives of the Stage II should be redefined and further objectives should be set taking into consideration potential changes and situation in general.
- The development of a preventive system against the commercial sexual exploitation and sexual abuse of children is linked to legal, economic, social, information, analytical, organizational and other measures covered by this programme (in accordance with Annex 1).
- It is anticipated that the implementation of the programme will bring about essential changes in the following areas: 19.
- the development of the legal system: 19.1.
- in Stage I up to
- It is necessary to draft amendments to laws dealing directly with sexual abuse and the commercial sexual exploitation of children; to get ready to enforce new legal norms ensuring the protection of the rights of the child and his legal interests as well as to ensure that all the measures provided in the National Crime Prevention Programme for Children and Minors and the Juvenile Criminal Justice Reform Programme which aims at developing an effective system of criminal justice for minors safeguarding the rights of the participants of the process are implemented. Following legal provisions and the UN Convention on the Rights of the Child this stage should include further development of the drafts of the Criminal Code, the Criminal Procedure Code, the Administrative Code and the Civil Code of the Republic of Lithuania (particularly Family Law) and the Civil Procedure Code in order to set the priority of the protection of the rights of the child and his legal interests. 19.1.2 Stage II - up to 2004 - should further consolidate legal principal elements of the control and preventive system against sexual exploitation and sexual abuse of children. The legal regulation gaps should be eliminated and drawbacks of health care, social security, education, information gathering and processing, international cooperation, and justice enforcement systems should be removed; 19.2 education. Within the context of the implementation of programme objectives and its tasks it is necessary to: 19.2.
- in Stage I: 19.2.1.
- to provide more information to teachers on gender, sexual harassment and exploitation, respect for the child’s dignity and responsibility, the ability of children to solve conflicts and to develop the skill of teachers to identify the abused child. To this end the system of teacher training and in-service training should be outlined allowing teachers to acquire knowledge in the above areas; 19.2.1.
- each educational establishment should in its inner rules set up obligations, rights and responsibilities of teachers and pupils in cases of sexual abuse against children; to authorize teachers and pupils to provide information in written form to the School Headmaster on suspicion of possible violence or sexual abuse; 19.2.1.
- to pay much greater attention to the adoption of the approach of teachers towards children as equal partners with the focus on children equality and the importance of their interests; to disseminate information on the UN Convention on the Rights of the Child in order to acquaint children with their rights and obligations; to facilitate better cooperation between teachers and families especially on suspicion of the child abuse; to enhance the role of school social educators; 19.2.
- in Stage II: 19.2.2.
- to organize courses and seminars for teachers at the in-service training establishments; to hold discussions about sexual violence, abuse and sexual exploitation of children and the prevention of this phenomenon; 19.2.2.
- to introduce instruction on the rights and obligations of the child, gender-sensitive training, dangers of sexual abuse as well as prevention issues of abuse of children against other children into formal and informal education; 19.
- design of methodological material. In order to implement programme objectives in this area it is necessary to: 19.3.1.
- in Stage I: 19.3.1.
- to carry out a scientific methodological analysis on the extent of sexual abuse against children; 19.3.1.
- to produce methodological material for teachers, social workers, police officers and medical personnel on the sexuality of children, sexual harassment and exploitation, sexual abuse and the commercial sexual exploitation of children and on the identification of the sexually abused child; 19.3.
- in stage II; 19.3.2.
- to produce methodological recommendations for professionals how to recognize features of sexual abuse against children; 19.3.2.
- to design methodology for medical establishments on the treatment and rehabilitation of sexually abused children (and their family members); 19.
- training of specialists. Currently only some training establishments offer comprehensive courses on the rights of the child and their protection in Lithuania. No single training establishment offers a specialized course on abuse and violence against children, sexual exploitation of children and its effect on the health and social welfare of the child. No information is provided on the possibilities to apply rehabilitation measures for abusers and exploiters. Would-be professionals, teachers, social educators, social workers and nurses, in particular, are not instructed how to recognize the child who has experienced violence, has been abused or sexually exploited. Training of specialists, their educational and in-service training should be organized in two stages. In the first stage in the year 2000 a voluntary National Expert Group should be set up. The composition of the group is to be approved by the Ministry of Social Security and Labour. The National Expert Group will be also authorized to prepare general and specialized training modules for specialists working with the child victims (sexual abuse victims as well) on how to recognize the abused child, to determine the type of abuse and the type of assistance to be provided; Specialized training and in-service training for officers of the police forces and the Prosecutor’s Office as well as for judges in the area of children’s rights and the interrogation of the child victims of sexual abuse is of utmost importance. At the same time teachers, personal health care staff, social workers, psychologists should also receive appropriate training and instruction. Specialized training and instruction could be provided at the educational establishments: specialized training courses or specialized training modules could be offered for professionals working with children. In the second stage, training of specialists based on specialized training modules prepared in the first stage should be carried out. Various specialist training and education centers should provide their assistance too. International training and educational programmes, courses and workshops for professionals working with abused children and their family members could also assist in this work; Annex 2 outlines principal requirements for specialists working with sexually abused children; 19.
- the development of rehabilitation and reintegration system for sexually abused children. Some conditions for partial implementation of the programme provisions in Lithuania have been already established. In some cities and towns the system of psychological helpline is active; crisis management centers for children who found themselves in a critical situation due to violence they have experienced or are still experiencing have been opened in some Lithuanian cities, however, no comprehensive rehabilitation system allowing proper application of the resources has been created. It is advisable to apply psychological counseling and other rehabilitation procedure for perpetrators since currently only strict punitive measures are administered in Lithuania. Within the framework of creating the rehabilitation and reintegration system for sexually abused children as well the rehabilitation system for persons who have committed those crimes, the perpetrators, it is necessary to: in the first stage - to create a database on the extent of sexual abuse and the commercial exploitation of children; to set up and to implement the system on reporting about the sexually abused or exploited child; to design a system of interdepartmental cooperation; to create the interrogation mechanism for the child who has experienced sexual abuse (or has been its victim) and to draft methodological recommendations for the conduction of such interrogations. In the second stage: to create a model of the system on the psychological-social rehabilitation of the sexually abused child and his immediate family members; to create the psychological-social rehabilitation system model for abusers and exploiters who are either in detention or at large; 19.
- international cooperation. International cooperation in adopting a unified approach of specialists from various countries towards sexual abuse against children and in seeking to render appropriate assistance for the child victims of sexual abuse and their families should be very beneficial for the successful implementation of this programme. Following the recommendations of the Council of the Baltic Sea States it is necessary to hold seminars: For the local authority personnel (for the personnel of day care centers, child care establishments, social workers, personal health care establishments, agencies for the protection of the rights of the child, teachers and others) and for the officers of police forces and from the Prosecutor’s Office. Seminars will be aimed at instructing participants how to recognize the sexually abused child, how to provide him immediate help and to promote cooperation of specialists from various state institutions; Seminars for public servants of state institutions. The aim of these seminars is to discuss preventive measures against sexual exploitation of children, and to promote awareness on criminal and procedural legal norms. Seminars will focus on gap analysis of laws in various States regulating legal liability for the sexual commercial exploitation of children. State institutions and non-governmental organizations should actively assist the implementation of international projects against sexual exploitation of children in Stage II. The effectiveness of international projects in this field should be assessed at this stage as well. V. PROGRAMME COORDINATION
- The programme Coordination Commission is to be set up for its implementation, coordination of interdepartmental activities and international cooperation. The Ministry of Social Security and Labour is to approve the composition and guidelines of the Commission. Annex
