Official translation Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 1049 of 4 September, 2000 Vilnius ON THE ESTABLISHMENT OF THE REGISTER OF FOREIGHERS AND THE APPROVAL OF THE REGISTER REGULATIONS Pursuant to 7 Article 17 of the Law of the Republic of Lithuania on the Legal Status of Foreigners (Official Gazette, 1998, No. 115-3236) and Article 6 of the Law of the Republic of Lithuania on the Public Registers (Official Gazette, 1996, No. 86-2043) the Government of the Republic of Lithuania has resolved:

  1. to establish the Register of Foreigners from 1 July
  2. to approve the Regulations of the Register of Foreigners (attached). Prime Minister Andrius Kubilius Minister of Internal Affairs Česlovas Blažys APPROVED by Resolution No. 1049 of 4 September 2000 of the Government of the Republic of Lithuania REGULATIONS OF THE REGISTER OF FOREIGNERS I. GENERAL PROVISIONS
  3. The Regulations shall regulate the purpose, the object, Register Management Offices, rights and duties of data suppliers, management, reorganization and liquidation of the Register of Foreigners (hereinafter referred to as the Register).
  4. This Register shall be the national Register.
  5. The purpose of the Register is to collect, accumulate, process, systematize, store, use and provide data about foreigners to public and local authorities, other legal and natural persons in accordance with the procedure established by laws and other legal acts of the Republic of Lithuania and these Regulations.
  6. Foreigners shall constitute the object of the Register. Persons who are not the citizens of the Republic of Lithuania irrespective whether they possess the citizenship of any foreign state or do not possess any citizenship shall be qualified as foreigners.
  7. The Register shall consist of the central database that is a computer database. The Register shall manage data about foreigners whose legal status is defined in accordance with the laws of the Republic of Lithuania.
  8. The Register shall be managed according to the Law on the Public Registers of the Republic of Lithuania and the Law on the Legal Protection of Personal Data of the Republic of Lithuania and in accordance with other legal acts and these Regulations. II. REGISTER MANAGEMENT OFFICES
  9. The leading Register Management Office shall be the Ministry of Internal Affairs. It shall coordinate, supervise methodically and control the activities of the Register Management Office.
  10. The Register Management Office shall be the institution authorized by the Ministry of Internal Affairs.
  11. The Register Management Office shall perform the following functions: 9.
  12. shall register foreigners and accumulate, process and systematize data about them and manage the database of the Register; 9.
  13. shall store data in the database of the Register; 9.
  14. shall ensure the protection of the Register database as well as the protection of the database and the document Archives; 9.
  15. shall provide Register data to legal and natural persons of the Republic of Lithuania; 9.
  16. shall ensure that the data entered into the database are consistent with the submitted data in the documents.
  17. Persons who take part in the processing of the documents must respect data confidentiality in accordance with the procedure specified by laws and other legal acts.
  18. Register data suppliers shall be public and local authorities, police Commissariats of cities and regions, other law enforcement Agencies, Courts and other natural and legal persons of the Republic of Lithuania. Data for the Register Management Office shall be submitted in writing or via computer networks.
  19. Register data suppliers must: 12.
  20. submit data about the registered foreigners to the Register Management Office in accordance with the procedure specified by the Ministry of Internal Affairs; 12.
  21. supply the Register Management Office with the modified data if the data about the foreigners have changed; 12.
  22. ensure that the submitted data are exact, comprehensive and correspond to the data in the documents or the data received from other institutions and are constantly updated;
  23. Register data suppliers shall have the right: 13.
  24. to access the data stored in the Register free of charge; 13.
  25. to require that false and inaccurate data are rectified, incomplete data are supplemented and unnecessary data are eliminated. III. REGISTRATION DATA
  26. The leading Register Management Office (The Ministry of Internal Affairs) shall establish the procedure of the identification code assignment and the Register object identification code structure.
  27. The Register shall manage the following data about foreigners: 15.
  28. personal code if it has been assigned to the foreigner according to the procedure specified by the Law on the Population Register of the Republic of Lithuania; 15.
  29. name (names); 15.
  30. surname (surnames); 15.
  31. citizenship (citizenships); 15.
  32. sex; 15.
  33. date of birth (year, month, day); 15.
  34. place of birth; 15.
  35. place of residence and the date of arrival to the place of residence; if the foreigner departs from Lithuania to live in a foreign country, destination country (state) and the date of departure; 15.
  36. name of the state from which the foreigner has arrived to the Republic of Lithuania; 15.
  37. marital status and the date of its change (year, month, day); 15.
  38. date of the foreigner’s application for the issue of the residence permit in the Republic of Lithuania, the date and the basis of the decision to issue (or not to issue) the residence permit; the date of issue and the number of the residence permit; 15.
  39. the date of the submission of the foreigner’s application to be granted the right to retain the citizenship of the Republic of Lithuania and to be issued a Certificate thereof, the date and the basis of the decision to issue (or not to issue) the relevant Certificate on the right to retain the citizenship of the Republic of Lithuania; the date of issue and the number of the Certificate; 15.
  40. the date of the foreigner’s application to be granted the citizenship of the Republic of Lithuania, the date and the basis of the decision to grant (or not to grant) the citizenship of the Republic of Lithuania, the date of issue and the number of the document confirming the citizenship; 15.
  41. the date of the foreigner’s application to be granted the refugee status, the date of the decision to grant (or not to grant) the refugee status, the legal act and its basis, the date of issue and the number of the document confirming the refugee status; 15.
  42. the date and the reasons for the apprehension of the foreigner who has been apprehended for the illegal entry to the Republic of Lithuania or for the illegal stay in the Republic of Lithuania, or on the suspicion for committing the crime; the Article of the Code of Administrative Violations of the Republic of Lithuania based on which the Administrative Law violation report has been filed; the name of the institution that has taken the decision to apprehend the foreigner; the apprehension period, the date and the reasons for the release of the foreigner; 15.
  43. the date of the decision obliging the foreigner to leave the Republic of Lithuania or to deport him/her from the Republic of Lithuania, the date of departure (deportation) notified to the foreigner; the name of the institution that has taken the said decision, the actual date of departure and the name of the state the foreigner has departed to. 15.
  44. the fine (penalty) imposed to the foreigner or the sanction applied according to laws; 15.
  45. the date and the reasons for the inclusion to the data bank the name of the foreigner who has been forbidden to enter the Republic of Lithuania; the name of the institution that has taken a decision on the prohibition to enter the Republic of Lithuania; the duration of prohibition to enter the country, the date and the reasons for its cancellation. 15.
  46. the date of death. IV. REGISTRATION OF FOREIGNERS
  47. In supplying data according to paragraph 15 of the Regulations, the Register data suppliers shall rely on the documents presented by the foreigner or the data contributed by natural or legal persons of the Republic of Lithuania.
  48. The list of registration documents constituting the basis for the inclusion of data into the Register as well as the procedure of data submission for the Register Management Office, data input and data protection procedure shall be established by the Ministry of Internal Affairs.
  49. The Register Management Office shall assign each foreigner the identification code and shall enter it into the Register computer database.
  50. Received data must be registered within three working days, while the data about foreigners specified in the subparagraph 15.
  51. of the Regulations must be registered immediately.
  52. Data to be entered into the Register shall be submitted to the Register Management Office.
  53. The Register data shall not be modified; data are only rectified provided they are incorrect.
  54. The foreigner shall be considered to be registered when the Register Management Office in accordance with the established procedure takes a decision to register and enters the data into the Register database.
  55. Having established that the data submitted for the Register are incorrect the Register Management Office must without any delay notify the Register data supplier and demand rectification of the mistake immediately.
  56. Upon establishment that incorrect data have been entered into the Register database through the fault of the Register Management Office, the Register Management Office must without any delay rectify the mistake and notify the users of the Register database to whom the data have been transferred thereof.
  57. The foreigner shall be removed from the Register if: 25.
  58. he/she becomes a citizen of the Republic of Lithuania; 25.
  59. he/she departs to live in a foreign country; 25.
  60. he/she has died; 25.
  61. the data protection time about the foreigner has expired.
  62. The Register Management Office shall adopt the decision to remove the foreigner from the Register; the Register Management Office then shall enter the data into the Register database and shall transfer the data to the database Archives.
  63. Foreigner registration documents at the Register Management Office shall be kept for two years. The documents in the Archives of the central Register database shall be kept for five years unless otherwise established by other legal acts. V. INTERACTION WITH OTHER REGISTERS
  64. The Register shall be linked to the Population Register of the Republic of Lithuania through the personal code assigned in accordance to the Law on the Population Register of the Republic of Lithuania.
  65. The Register shall provide data about foreigners to the Population Register of the Republic of Lithuania in accordance with Article 5 of the Law on the Population Register of the Republic of Lithuania. VI. USE OF THE REGISTER DATA
  66. Register data suppliers upon application shall have the right to access the stored data they have submitted to the Register.
  67. Register data may be used and disclosed in accordance with the procedure established by laws and other legal acts of the Republic of Lithuania.
  68. Register data shall be transferred free of charge: 32.
  69. to the divisions of the Ministry of Internal Affairs; the list of divisions is approved by the Minister of Internal Affairs; 32.
  70. to the Department of Statistics under the Government of the Republic of Lithuania; 32.
  71. to the public and local authorities if their functions are linked to issues related to the legal status of foreigners in the Republic of Lithuania; 32.
  72. to foreigners whose data are the subject of the Register; 32.
  73. to other users provided this does not contradict the existing legal acts of the Republic of Lithuania.
  74. For persons who have submitted an application the data shall be transferred for a fee, which is regulated by the procedure established by the Government of the Republic of Lithuania.
  75. The Ministry of Internal Affairs may impose user restrictions on the right to access Register data; the Ministry shall also define the list of data accessible by computer networks.
  76. Personal data provision agreements shall be concluded with users receiving data in accordance with the form established by the State Data Protection Inspectorate under the Ministry of Public Administration Reforms and Local Authorities of the Republic of Lithuania. VII. PROTECTION OF THE REGISTER DATA
  77. The leading Register Management Office shall establish the Register data protection procedure in accordance with general data protection requirements and administrative measures for Register protection.
  78. The Register Management Office shall guarantee technical, software and other means protecting the Register from illegal data destruction, modification and use. VIII. TRANSFER OF THE REGISTER DATA TO FOREIGN COUNTRIES
  79. Register data may be transferred to foreign countries only in cases provided for by the laws, other legal acts and international treaties of the Republic of Lithuania.
  80. Register data may be provided to the international computer networks only in cases provided for by the laws, other legal acts and international treaties of the Republic of Lithuania. IX. REGISTER FINANCING
  81. The register shall be financed from the funds of the National Budget of the Republic of Lithuania as well as from fees for the services provided. X. REORGANISATION AND LIQUIDATION OF THE REGISTER
  82. The Register shall be reorganized and liquidated in accordance with the procedure established by the Government of the Republic of Lithuania.
  83. Data of Register under liquidation shall be transferred to another Register, the State Archives or shall be destroyed in accordance with the procedure established by laws and other legal acts of the Republic of Lithuania.
