Official translation Official translation LAW ON FEEDINGSTUFFS 6 April 2000 No. VIII-1610 Vilnius CHAPTER ONE GENERAL PROVISIONS Article
(2)of this Article and compound feedingstuffs from feed materials containing harmful (undesirable) substances, products and vegetable admixtures shall comply with the regulations for the production, use and marketing of feed additives as well as with the mandatory feedingstuffs safety requirements approved by the Ministry of Agriculture.
- The feedingstuffs must be manufactured in the premises equipped according to veterinary and hygiene requirements and comply with the quality requirements indicated for them by legal acts, standards and methods.
- The Ministry of Agriculture shall establish, in conjunction with the State Food and Veterinary Service: 1) mandatory feedingstuffs safety and labelling requirements; 2) mandatory feedingstuffs quality declaration requirements; 3) veterinary and hygiene conditions requirements for premises; 4) the list of substances, feed materials and feed additives the use whereof is prohibited; 5) the highest permissible levels of harmful (undesirable) substances, products and feed additives in the manufactured feedingstuffs; 6) the procedure of manufacture and use and marketing of feed additives of . - Feedingstuffs Storage Conditions
- Feedingstuffs must be stored in packages or in bulk in warehouses and containers meeting the veterinary and hygiene requirements, in compliance with the regulations on feedingstuffs storage.
- The regulations of feedingstuffs storage shall be subject to the approval by the Ministry of Agriculture. Article
- Requirements of Use ,Transportation, Marketing of Feedingstuffs
- The feedingstuffs must correspond to the data submitted in the suppliers’ conformity declaration or labelling requisites, mandatory feedingstuffs safety and labelling requirements .
- Containers and vehicles used for feedingstuffs transportation must be equipped in such a manner as to ensure the of quality during the transportation of feedingstuffs.
- Feedingstuffs must be used for the purpose indicated in the requisites of product labelling (or in the suppliers’ conformity declarations) and before the expiry of the storage life period from the date of manufacture. Article
- Accountability The procedure of statistical accounting on the manufacture, marketing and stocks of feedingstuffs as well as the regularity of data presentation shall be established by the Department of Statistics under the Government of the Republic of Lithuania upon co-ordination with the Ministry of Agriculture. CHAPTER THREE EXPORT AND IMPORT OF FEEDINGSTUFFS Article
- Requirements of Feedingstuffs Export and Import
- Feedingstuffs shall be exported and imported in compliance with the provisions of this Law, the Customs Code, the Law on Veterinary, other laws and legal acts, and international agreements. The imported and exported feedingstuffs must be accompanied by conformity, veterinary and phytosanitary certificates.
- The State Food and Veterinary Service shall have the right to prohibit to import the feedingstuffs into the Republic of Lithuania if they do not comply with the mandatory requirements applied with respect to feedingstuffs.
- The procedure for registering the feed additives and premixes contained in the imported feedingstuffs and the procedure of conformity assessment thereof shall be laid down by the Ministry of Agriculture. CHAPTER FOUR REGULATIONS OF OFFICIAL STATE QUALITY CONTROL AND ADMINISTRATION OF FEEDINGSTUFFS Article
- Official State quality Control of Feedingstuffs State Control of manufacture, storage, transportation, use and marketing of feedingstuffs, also official state control of their quality and veterinary and hygiene conditions of the premises shall be carried out by the institution authorised by the Government according to the procedure laid down by the Ministry of Agriculture. Article
- Functions and Rights of the Institutions and Officers Carrying out Official State quality Control of Feedingstuffs
- The institutions which carry out official state quality control of feedingstuffs may: 1) control compliance with the requirements of manufacture, storage, transportation, use and marketing of feedingstuffs, also requirements of feedingstuffs quality and requirements for veterinary and hygiene conditions of premises; 2) suspend or prohibit the manufacture and marketing of unsafe feedingstuffs where prohibited substances and feed materials are used in the manufacture thereof or where the amount of harmful (undesirable) substances, products, vegetable admixtures or feed additives contained in the feedingstuffs exceeds the permissible level.
- The officers who carry out official state quality control of feedingstuffs shall have the right to: 1) unrestrictedly enter the premises of the economic entities manufacturing, storing, using or trading in feedingstuffs; 2) obtain all documents required for the official state quality control of feedingstuffs from the economic entities manufacturing, storing, using or trading in feedingstuffs; 3) as necessary, enlist the assistance of police force; 4) take samples of feedingstuffs, cleaning substances, disinfectants and other substances used in the manufacture of feedingstuffs which could affect the quality of feedingstuffs, and samples for laboratory tests.
- Feedingstuffs, which the institution authorised by the Government has declared to constitute danger to human or animal health or the environment shall be decontaminated or destroyed according to the procedure established by the Ministry of Agriculture. Article
- Liability of Officers who Carry out Official State Quality Control of Feedingstuffs
- Officers who carry out official state quality control of feedingstuffs must keep the technological and commercial secrets of production of feedingstuffs confidential.
- The actions of the officers who carry out official state quality control of feedingstuffs and the decisions of the institutions carrying out the control as well as of their officers may be appealed against according to the procedure established by law. Article
- Liability of Economic Entities Manufacturing, Storing, Transporting and Trading in Feedingstuffs Economic entities who violate the requirements of this Law and inflict harm on another economic entity shall be held liable and compensate the damages according to the procedure prescribed by law. CHAPTER FIVE FINAL PROVISIONS Article
- Implementation of the Law Responsibility for the implementation of this Law shall rest with the Ministry of Agriculture. Article
- Proposals to the Government The Government or the institution authorised by it shall establish the priority and time limits of drawing up legal acts necessary for the implementation of this Law.
