- of the Law on Legal Protection of Personal Data (Valstybės Žinios, 1996, No. 63-1479), the Government of the Republic of Lithuania h a s r e s o l v e d:

- This procedure shall regulate the payment for disclosing data to a data subject where the data controller or data processor (hereinafter referred to as the “data controller”) discloses the data to a data subject more than once per calendar year in accordance with Article 17 para. 2 of the Law on Legal Protection of Personal Data of the Republic of Lithuania.
- This procedure shall not be applied where the data are processed in a non-automated way by state and municipal institutions. The procedure of payment for disclosing data, where the data are processed in a non-automated way by state and municipal institutions, is determined by the Law on Entitlement to Receive Information from State and Municipal Institutions (Valstybės Žinios, 2000, No. 10-236) and Government Resolution No. 1039 of 1 September 2000 on the approval of the procedure for the payment of costs of drawing up document copies (Valstybės Žinios, 2000, No. 75-2294).
- The data controller shall provide the information specified in Article 17 para. 1 of the Law on Legal Protection of Personal Data free of charge once per calendar year. The fee for disclosing data more than once per year shall not exceed the expenses of data disclosure. The fee for data disclosure shall be established and approved by the data controller subject to the expenses incurred.
- Upon receiving an enquiry from the data subject concerning the processing of his/her personal data, the data controller must immediately reply whether the personal data concerned are processed, and inform the data subject about the procedure of payment for data disclosure and related fees broken down by type of expenses. Where the data subject submits the request indirectly by mail, courier or in any other way, the data controller shall reply within three business days whether the personal data concerned are processed, and inform the data subject about the procedure of payment for data disclosure and itemised fees.
- The data controller shall provide information only to the data subject who has paid in advance for the service to be rendered.
- The data subject shall pay for the disclosure of data to the data controller’s cashier or transfer the payment to a specified settlement account.
- Where the fee is paid to the data controller’s cashier, the data subject shall get a receipt for the money. APPROVED by Resolution No. 228 of 28 February 2001 of the Government of the Republic of Lithuania PROCEDURE OF PAYMENT FOR COLLECTING DATA FROM REGISTERED DATA CONTROLLERS
- This procedure shall regulate the payment for a service rendered to a data subject where an institution authorised by the Government of the Republic of Lithuania collects personal data concerning the data subject or information on the processing of his/her personal data from registered data controllers and makes such data or information available to the data subject in accordance with Article 20 of the Law on Legal Protection of Personal Data.
- The Government’s authorised institution shall receive payment for the service specified above. The fee shall be established and approved by the Government’s authorised institution subject to the expenses of data collection and service rendering.
- The Government’s authorised institution shall collect and disclose personal data or information only to the data subject who has paid in advance for the service to be rendered.
- The Government’s authorised institution shall create conditions for the data subject to pay for the service at the said institution or specify the number of its settlement account so that the data subject could transfer the payment thereto.
- Where the fee is paid to the data controller’s cashier, the data subject shall get a receipt for the money.
