/me Official translation GOVERNMENT OF THE REPUBLIC OF LITHUANIA RESOLUTION No. 939 CONCERNING THE ESTABLISHMENT OF a CRISIS management CENTRE UNDER THE MINISTRY OF NATIONAL DEFENCE AND the APPROVAL OF its REGULATIONS 27 July 2001 Vilnius The Government of the Republic of Lithuania, acting pursuant to the Second Section of Chapter 14 of the Annex to the Law on the Basics of National Security of Lithuania (Official Gazette No. 2-16, 1997; No. 58-1710, 2000), implementing the measures for the implementation of the Conceptual Framework of the National Crisis Management System of the Republic of Lithuania which have been approved by RL Government Resolution No. 1365 of 8 November 2000 on the Approval of Measures for the Implementation of the Conceptual Framework of the National Crisis Management System (Official Gazette No. 98-3104, 2000), and having regard to the decision adopted by the meeting of the Strategic Planning Committee of the RL Government on 13 June 2001 (minutes of the meeting No. 23), hereby r e s o l v e s:
- To establish, as from 1 January 2002, a Crisis Management Centre under the Ministry of National Defence.
- To approve Regulations of the Crisis Management Centre under the Ministry of National Defence (enclosed herewith).
- To instruct state authorities and bodies to provide the Crisis Management Centre under the Ministry of National Defence with information necessary for its activities. Prime Minister Algirdas Brazauskas Minister of National Defence Linas Linkevičius APPROVED by Resolution No. 939 of 27 July 2001 of the Government of the Republic of Lithuania REGULATIONS OF THE CRISIS MANAGEMENT CENTRE UNDER THE MINISTRY OF NATIONAL DEFENCE I. GENERAL PROVISIONS
- The Crisis Management Centre under the Ministry of National Defence (hereinafter referred to as "the Centre") shall be a budgetary body.
- The founder of the Centre shall be the Government of the Republic of Lithuania.
- The Centre shall be a legal person and shall have an account with the bank and a seal bearing the Lithuanian state emblem and the name of the Centre.
- The Centre shall act pursuant to the Constitution of the Republic of Lithuania, laws and other legal acts adopted by the Seimas of the Republic of Lithuania, international agreements entered into by the Republic of Lithuania, decrees of the President of Lithuania, resolutions of the RL Government, the Prime Minister's ordinances, orders of the Minister of National Defence, other legal acts and these Regulations. II. TASKS AND FUNCTIONS OF THE CENTRE
- The following shall be the main tasks of the Centre: 5.
- to carry out comprehensive monitoring of risk factors and threats and to forecast possible crises; 5.
- to coordinate activities of state authorities and bodies (hereinafter referred to as "the Authorities" in the area of crisis prevention; 5.
- to ensure effective infrastructure for crisis management; 5.
- to ensure continuous exchange of information between the Authorities in the area of crisis management; 5.
- to develop international cooperation in the area of crisis management.
- The Centre, in implementing the tasks assigned to it, shall carry out the following functions: 6.
- collection, analysis and structuring of information received from the Authorities, means of mass communication and news agencies on threats and ensuring the protection of information representing a state or official secret; 6.
- carrying out a comprehensive analysis of information received in the area of crisis management, forecasting possible crisis situations and the scope of such situations, drawing up forecasts of the dynamics of threats and crisis events and making such forecasts available to the entities of the crisis management system; 6.
- carrying out continuous observation of the domestic and international situation as well as the development of events related to the country’s interests; 6.
- coordinating activities of authorities that are responsible for crisis forecasting and prevention, and drawing up, in liaison with such authorities, procedures for the management of crisis response activities and operations; 6.
- prepare, where appropriate, for the President of Lithuania, the RL Seimas, the RL Government and the Council of National Defence overviews of the most important developments, special communications and draft reasoned recommendations on the avoidance of crises or mitigation of the possible adverse effects; 6.
- implementing the system of early crisis prevention; 6.
- communicating information and giving instructions to the entities of the crisis management system participating in the management of emergency and crisis events; 6.
- maintaining the necessary readiness of infrastructure to enable the operation of the crisis management system; 6.
- providing support to the authorities of the crisis management system responsible for actions during emergencies or crises; 6.
- cooperating with relevant authorities in other countries and international organisations; 6.
- acting as a contact point for the Authorities and international organisations which can be accessed 24 hours a day; 6.
- advising the public through the media of foreseeable risks and activities aimed at the prevention of crises; 6.
- carrying out other functions provided for by laws, resolutions of the RL Government and the Minister of National Defence. III. RIGHTS OF THE CENTRE
- The Centre, in implementing the tasks assigned to it, shall have the right: 7.
- to obtain from the Authorities detailed information that is necessary for the prevention and management of crises; 7.
- to give instructions to the Authorities with regard to clarification of information provided to the Centre; 7.
- to invite independent experts and competent representatives of the Authorities for the assessment of a situation and drafting reasoned recommendations; 7.
- to get access to databases and registers maintained by the Authorities in order to obtain the necessary information on possible threats; 7.
- subject to the procedures laid down in crisis management plans, pool forces and resources necessary for the organisation of crisis management; 7.
- enjoy other rights provided for by laws, the RL Government resolutions and the Minister of National Defence. IV. ARRANGEMENT OF THE CENTRE’S ACTIVITIES
- The Centre shall be headed by a director who shall be appointed for a term of 5 years and dismissed by the Minister of National Defence under the procedure laid down in the RL Law on Public Service.
- The Centre’s director shall be directly subordinate to the Minister of National Defence and bear personal responsibility for the implementation of tasks and functions delegated to the Centre.
- The director shall be assisted by a deputy who shall be appointed and dismissed in accordance with the procedure laid down by the RL Law on Public Service. In the absence of the director (due to his holidays, illness, business trip, etc.), his duties shall be temporarily undertaken by the Centre’s deputy director.
- The Centre’s director shall: 11.
- organise and ensure the implementation of all tasks and functions delegated to the Centre, take decisions on matters within the scope of the Centre’s competence and exercise other functions assigned by the Minister of National Defence; 11.
- ensure the implementation of laws, international agreements entered into by Lithuania, decrees of the President of Lithuania, resolutions of the RL Government, ordinances of the Prime Minister, orders of the Minister of National Defence, other legal acts, and instructions of the RL Government, the Prime Minister and the Minister of National Defence; 11.
- issue orders and other legal acts approved by orders, and monitor their implementation; 11.
- define occupational functions for public servants and officials employed by the Centre; 11.
- appoint and dismiss the Centre’s civil servants, impose disciplinary sanctions and provide incentives to them; 11.
- approve, upon consultation with heads of the Authorities, the number of members, composition and the rules of procedure for expert groups for threat and crisis event monitoring and crisis forecasting.
- Expert groups for monitoring threats and crisis events and crisis forecasting, made up of experts and officials delegated on the basis of professional assistance between the Authorities, shall permanently operate in the Centre. These groups shall: 12.
- analyse, in the pre-crisis period, information which is collected by the Authorities indicating the dynamics of threats and risk factors; 12.
- forecast the possibility of a crisis and stages of its development; 12.
- present, where appropriate, to the President of Lithuania, the RL Seimas, the RL Government and the Council of National Defence conclusions, forecasts and recommendations on crisis prevention, and inform the public. X. FINAL PROVISIONS
- Issues related to the reorganisation or liquidation of the Centre shall be addressed by the RL Government in accordance with procedures laid down by relevant legislation. ––––––––––––––––
