- New Version of the Republic of Lithuania Law on Animal Breeding To amend the Republic of Lithuania Law on Animal Breeding to read as follows: “REPUBLIC OF LITHUANIA LAW ON ANIMAL breeding CHAPTER I GENERAL PROVISIONS Article
- Scope of the Law
- The Law shall regulate the preservation of the gene pool of animal breeds of the Republic of Lithuania, improvement of performance and breeding characteristics, assessment of the breeding value of animals, activities of the services supervising animal breeding, legal status of subdivisions thereof, mandatory state supervision of animal breeding, recognition of breeding institutions.
- The Law shall apply to the breeding of cattle, pigs, sheep, goats and horses. This Law shall apply to the breeding of other animals used in agriculture in as much as the said breeding is not regulated by special legal acts designated for each species of the animals.
- The purpose of the Law shall be to regulate the breeding of animals specified in paragraph 2 of this Article, so that: 1) the productivity of animals would increase and their viability would be sustained; 2) cost-efficiency and competitiveness of stockfarming would improve; 3) quality of animal production would satisfy the requirements set for it; 4) genetic diversity of animals would remain, breeds of animals of the Republic of Lithuania and the gene pool thereof would be preserved and improved. Article
- Main Definitions of the Law
- ”Animal breeding” means a system of animal selection methods to get and breed genetically improved animals.
- ”Breeding animal” means an animal the pedigree and individual breeding characteristics whereof satisfy the requirements for breeding animals.
- ”Pure-bred animal” means an animal the pedigree whereof satisfies the requirements for the pedigree of pure-bred animals.
- ”Animal” means an agricultural animal or a hybrid.
- “Hybrid” means a progeny of the animals of different species; in pig-rearing and poultry-farming it may be a progeny of the parents of different breeds and lines, produced under the hybridisation programme for further breeding or fattening.
- “Genetic value” means genetic potential of a breeding animal comparing to other breeding animals.
- “Herd-book” means totality of the data on a pedigree, performance characteristics and breeding value, kept by an approved breeding institution.
- “Pedigree register” means a register of animals which may be entered in a herd-book intended for identifying the pedigree of an animal and maintained by an approved breeding institution.
- “Register for hybrids” means a register of the hybridisation programme of animals intended for identifying the pedigree of an animal and maintained by an approved breeding institution.
- “Pedigree certificate” means an official document issued by an approved breeding institution, certifying the identity of an animal or an embryo and defining its pedigree, performance and other breeding characteristics.
- “Performance monitoring” means establishment of individual performance and breeding characteristics of animals, data accounting, registration and accumulation in animal breeding information systems.
- “Sampling test” means performance monitoring according to the hybridisation programme when the performance of crosses and their parents is established and compared in accordance with a selected sample.
- “Insemination of animals” means a biotechnological method by which the number of progeny of male reproducers is increased.
- “Embryo transplantation” means a biotechnological method by which the number of progeny of female reproducers is increased.
- “Embryo transplantation undertaking” means an undertaking in which embryos are washed from female donors and transplanted in female recipients.
- “Breeding institution” means an association or organisation registered in the manner established by law, which is authorised by the Ministry of Agriculture to implement breeding (hybridisation) programmes, maintain herd-books and the pedigree (hybrid) register.
- “Insemination centre” means an undertaking in which male reproducers are kept for semen production.
- “Test bull” means a bull of the insemination centre, which is checked in accordance with the conception rate and characteristics of progeny for the establishment of its breeding value.
- “Animal insemination technicians” means natural and legal persons as well as undertakings which do not have the rights of a legal person, carrying out insemination services.
- “Mating” means natural copulation of animals.
- “Mating stations” means a place in which natural or legal persons keep reproducers for mating with females. CHAPTER II ANIMAL PERFORMANCE MONITORING, BREEDING VALUE ASSESSMENT AND PROCLAMATION OF INFORMATION Article
- Performance Monitoring and Breeding Value Assessment
- Performance and breeding value shall be established with the purpose of improving genetic potential of animals.
- Performance monitoring shall be carried out and the genetic value of animals shall be assessed by state undertakings or other institutions authorised by the Ministry of Agriculture.
- When assessing the genetic value of animals, an institution authorised by the Ministry of Agriculture may use the following: 1) the data of the approved breeding institutions if such institutions guarantee that such data are unbiased; 2) performance monitoring and genetic value data of other states if accuracy of the received data is not lower than it is prescribed by the Ministry of Agriculture of the Republic of Lithuania, and they may be compared with the data obtained by the approved breeding institutions.
- In order for the assessment of male reproducers to be unbiased, all reproducers used for mating or insemination the data on the performance of the progeny whereof are included in the animal breeding information system, must be assessed through a whole period of their use. Breeding value data shall be announced regardless of the will of the owner of a reproducer. For the evaluation of bulls, cows of the I and II lactations from test herds (except selected cows) shall be inseminated with semen of test bulls. Article
- Performance Evaluation, Data Storage and Proclamation Institutions authorised by the Ministry of Agriculture, which carry out performance monitoring and assess the breeding value of animals, shall collect, process, analyse and store in breeding information systems the data on performance monitoring and breeding evaluation, publish the said data in special publications, inform breeding institutions which consult animal breeders and natural and legal persons which provide breeding services. Article
- Competence of State Administration Institutions in the Field of Performance Monitoring and Breeding Value Assessment The Ministry of Agriculture shall approve regulations concerning the implementation of performance monitoring, breeding value assessment, as well as the list of mandatory selection traits, and establish the procedure for the use of performance monitoring and breeding evaluation data. CHAPTER III GENERAL REQUIREMENTS FOR SUPPLY OF BREEDING ANIMALS, HYBRIDS, THEIR SEMEN, EMBRYOS AND OVA Article
- Supply of Breeding Animals and Hybrids Breeding animals and hybrids may be supplied for further breeding if they: 1) are permanently identified, and horses are identified or described in such a manner that it would be possible to establish their identity; 2) have a pedigree certificate. Article
- Supply of Semen
- Semen may be supplied if : 1) it is collected, treated and stored at an insemination centre or collected elsewhere by a person authorised by the insemination centre; 2) it is identified; 3) it comes from a breeding animal or hybrid for which a permit to collect semen is issued.
- A permit to collect and use semen shall be issued if: 1) the breeding value of a reproducer is higher than an average value of test animals (a boar may be selected in accordance with the data of a sampling test); 2) a reproducer and its parents, brought from abroad, are entered in the herd-book or registers of the breeding institution recognised in a prescribed manner in the place of its origin; 3) a reproducer and its parents, brought from abroad, are entered in the herd-book or registers of the approved of the Republic of Lithuania; 4) reproducers are checked in accordance with the performance of progeny or individual performance; 5) reproducers and their semen conform to veterinary requirements.
- Permits of competent institutions of the European Union to collect semen shall be recognised if they conform to the requirements of subparagraph 2 of paragraph 2 of this Article.
- Supplied semen shall be accompanied by a pedigree certificate of the semen donor which shows its blood grouping, and a semen quality certificate which is issued by a semen collector. Authenticity of the documents shall be guaranteed by a semen supplier. Article
- Supply of Embryos and Ova
- Embryos, ova may be supplied if they: 1) are obtained and treated in the ova transplantation undertaking; 2) are obtained from breeding animals or hybrids; 3) are identified or transplanted into identified female recipients.
- Supplied embryos shall be accompanied by a pedigree certificate of genetic parents, which shows their blood grouping, and an embryo quality certificate from the embryos transplantation undertaking as well as a veterinary certificate.
- Supplied ova shall be accompanied by a pedigree certificate of a female donor, which shows its blood grouping, and an ovum quality certificate from the embryo transplantation undertaking as well as a veterinary certificate. Article
- Competence of State Administration Institutions in the Field of Regulation of the Supply of Breeding Animals, Hybrids, their Semen, Embryos and Ova The Ministry of Agriculture shall establish: 1) general requirements for the supply of breeding animals and hybrids, their semen, embryos and ova, the procedure for identifying animals, requirements for the forms of pedigree certificates of breeding, pure-bred animals and hybrids; 2) requirements for the supply of semen and its quality, the procedure of semen accounting and identifying, the issuance of permits to collect semen, permits for insemination centres and animal insemination technicians; 3) the procedure of embryos and ova supply, accounting and identifying of embryos and ova, requirements for the forms of embryos and ova quality certificates.
- The State Food and Veterinary Service shall establish veterinary requirements for breeding animals and hybrids, insemination centres, reproducers, semen, embryos and ova. CHAPTER IV INSEMINATION AND MATING OF ANIMALS Article
- Activities of the Insemination Centre and Mating Station
- An insemination centre or mating station must receive a permit to engage in its activities.
- A permit shall be issued for activities of an insemination centre if: 1) conditions are created for keeping reproducers, and qualified staff and equipment are available; 2) an undertaking is supervised by a veterinarian; 3) semen is provided by reproducers kept at the insemination centre, with the exception of the cases when the insemination centre receives semen from outside the centre in a prescribed manner; 4) an undertaking participates in breeding programmes of approved breeding institutions; 5) there is compliance with obligatory veterinary, semen quality and accounting requirements.
- The insemination centre may supply semen to: 1) approved breeding institutions; 2) other insemination centres; 3) animal insemination technicians or persons who are authorised by the insemination centre to perform inseminations; 4) animal breeders to inseminate animals from their herds.
- Persons to whom semen is delivered shall carry out semen use accounting.
- Permits to mate shall be issued by approved breeding institutions. Article
- Animal Insemination Technicians
- Animal insemination technicians must, in a manner prescribed by the Ministry of Agriculture, receive a permit to engage in their activities.
- A permit shall be issued to animal insemination technicians if they: 1) are qualified and have necessary equipment; 2) carry out breeding programmes of approved breeding institutions; 3) comply with veterinary and semen use accounting requirements. Article
- Competence of State Administration Institutions in the Field of Regulation of Animal Insemination and Mating The Ministry of Agriculture shall establish: 1) the procedure for issuance of permits to engage in the activities of insemination centres and mating stations, requirements for insemination centres and mating stations, their staff and equipment; 2) the procedure of issuance of permits to animal insemination technicians, organisation of training for animal insemination technicians.
- The State Food and Veterinary Service shall establish veterinary requirements for the activities of insemination centres, mating stations and animal insemination technicians. CHAPTER V TRANSPLANTATION OF EMBRYOS Article
- Activities of Embryos Transplantation Undertakings
- Embryos transplantation undertakings must, in a manner prescribed by the Ministry of Agriculture, receive a permit to engage in their activities.
- A permit to engage in activities of embryos transplantation undertakings shall be issued if: 1) qualified staff and equipment are available; 2) an undertaking is under supervision of a veterinarian; 3) requirements for embryos and ova quality, their accounting as well as veterinary requirements are complied with.
- Embryos transplantation undertakings may authorise qualified persons to transplant embryos and ova. Article
- Competence of State Administration Institutions in the Field of Regulation of Embryos and Ova Transplantation
- The procedure of issuance permits to engage in the activities of embryos and ova transplantation undertakings, requirements for embryos and ova quality and accounting, requirements for embryos and ova transplantation undertakings, their staff and equipment shall be established by the Ministry of Agriculture.
- The State Food and Veterinary Service shall establish veterinary requirements for the transplantation of embryos. CHAPTER VI BREEDING SYSTEM Article
- The System of Breeding of Animals of the Republic of Lithuania The system of breeding of animals of the Republic of Lithuania shall consist of the following: 1) breeders of breeding animals; 2) natural and legal persons as well as undertakings which do not have the rights of a legal person, providing breeding services; 3) approved breeding institutions; 4) the Chamber of Agriculture – the main institution which represents the self-governing of breeding; 5) the State Animal Breeding Supervision Service under the Ministry of Agriculture of the Republic of Lithuania. Article
- The State Animal Breeding Supervision Service
- The State Animal Breeding Supervision Service shall carry out the State animal breeding supervision in the Republic of Lithuania. When carrying out its activities, the State Animal Breeding Supervision Service shall observe this and other laws of the Republic of Lithuania, Government resolutions, orders of the Minister of Agriculture, as well as regulations of this Service which are approved by the Minister of Agriculture. The head of the State Animal Breeding Supervision Service shall be ex officio the chief state inspector of breeding. The deputy head of the Service shall be ex officio the deputy chief state inspector of breeding. The Minister of Agriculture shall conclude employment contracts with them. Senior specialists of the State Animal Breeding Supervision Service shall be state inspectors of breeding. The head of the Service shall conclude employment contracts with them.
- The State Animal Breeding Supervision Service shall carry out the following functions: 1) to control the implementation of the Law on Animal Breeding and other legal statutory acts related to the breeding; 2) to submit proposals to the Ministry of Agriculture regarding the financing of targeted breeding programmes, taking into consideration proposals of the approved breeding institutions and control the targeted use of the said funds; 3) to control the implementation of breeding programmes; 4) to prepare and submit to the Ministry of Agriculture drafts of legal acts on the issues of breeding; 5) to submit proposals to the Ministry of Agriculture regarding the improvement of breeding activities, taking into proposals of the approved breeding institutions; 6) to consider applications, complaints, proposals of natural and legal persons concerning the quality of breeding animals, management of breeding accounting and data accuracy; 7) to control the collecting and storage of breeding data; 8) to submit to the Ministry of Agriculture draft forms of animal breeding accounting documents; 9) to control the registration of breeding animals in herd books, publication of breeding accounting, catalogues and other publications; 10) to organise the evaluation of breeding reproducers; 11) to approve a pedigree certificate of breeding animals or assign such work to approved breeding institutions.
- The State Animal Breeding Supervision Service shall have the following rights: 1) to check animal breeding institutions, natural and legal persons raising breeding animals whether they observe the Law on Animal Breeding and other legal statutory acts regulating animal breeding; 2) in a prescribed manner, to hear cases relating to administrative violations of the law and to impose administrative penalties; 3) in a manner prescribed in the regulations of the said Service, to suspend activities of the natural and legal persons as well as undertakings which do not have the rights of a legal person, in the field of animal breeding and provision of animal breeding services, if they do not comply with the requirements of the Law on Animal Breeding and other legal acts regulating breeding. Upon the removal of the violations, the State Animal Breeding Supervision Service shall adopt a decision to revoke prohibition to engage in the activities related to animal breeding and provision of breeding services. Article
- Recognition of Breeding Institutions A breeding institution shall be recongised if: 1) it is established on the basis of laws of the Republic of Lithuania; 2) it has a prepared breeding programme; 3) breeding animal population is sufficient for the implementation of a breeding programme; 4) it has qualified staff and equipment; 5) breeding animals are identified, and horses are identified and described in such a manner that it would be possible to establish their identity; 6) a herd book, pedigree and hybrid registers are properly maintained. Article
- Entering of Animals in the Herd Book Each animal which meets the requirements in accordance with the pedigree and performance must, upon the request of a member of the breeding institution – an owner of an animal, be entered in a herd book or registered in a pedigree register. Requirements applicable to imported animals must not be less favourable than those applicable to local animals. Article
- Competence of State Administration Institutions in the Field of Recognition of Breeding Institutions
- The procedure of recognition of breeding institutions and requirements for the staff, as well as requirements for the equipment, requirements for the contents, forms and maintaining of herd books and registers shall be established by the Ministry of Agriculture, taking into consideration proposals of the Chamber of Agriculture.
- Veterinary requirements for breeding institutions shall be established by the State food and Veterinary Service. CHAPTER VII FINAL PROVISIONS Article
- State Aid to the Breeding Breeding stock-raising is a priority branch of agriculture. The State shall support breeding in accordance with the programmes approved by the Government or an institution authorised by it. Article 21.Validity of Permits Permits issued on the basis of Law on Animal Breeding No. I-384, passed on 8 February 1994, shall not cease to have effect.
