1. Purpose of the Law This Law shall regulate management of geodetic, topographic, and cartographic activities, the principles of creating databases of the geographic information systems and their integrity, ownership of the geodetic control and cartographic material, the main rights and duties of state and municipal institutions and enterprises involved in map production, geodetic survey, gathering of data, its record keeping, and use, in the field of geodesy and cartography. Article
2. Definitions
3. Aerial photography - photographs of the Earth’s surface (positives and negatives of photo images) taken with special cameras from aeroplanes and intended for the production of maps.
4. Analogue (printed) map - a map printed on paper or a transparency.
5. Astronomic cartography - a type of activity which involves imaging on a plane of the celestial sphere, the planets and other celestial bodies.
6. Atlas - a systemic collection of maps, either of a general geographic type, thematic, complex or specialised, prepared and published in accordance with an established procedure.
7. Base map - a map, which is used as a primary source or a cartographic basic material for producing other maps.
8. Database - a collection of data, arranged systematically and methodologically, which may be accessed individually by electronic or other means.
9. Geodesy - a field of scientific and industrial activity involving determining the shape and dimensions of the Earth or its part, measurement of its gravitational field and the spatial position of the points on the surface of the Earth, above or below it, and determining the co-ordinates
10. Geodetic control - a sum total of geodetic networks, their co-ordinates and altitudes.
11. Geodetic point - a geodetic mark with a protection area for the protection of geodetic parameters on the Earth’s surface.
12. Geodetic network - a sum total of the geodetic marks secured on the Earth’s surface and connected by geodetic measurements. According to the parameters to be determined, it is grouped into GPS (spatial), planimetric, vertical, gravimetric, magnetometric, and according to the territory covered – into world, continental, state, municipal, local and special purpose networks.
13. Geodetic mark - a structure on a site, secured by a special construction, having fixed parameters of the geodetic network.
14. GIS (geographic information systems, geoinformation systems) – a computerised information system for collection, keeping, processing, storage, search and retrieval of information about geographic objects, their characteristics and other information relating to the Earth, intended for the solution of tasks involving design, modelling, analysis, research and other objectives of geographical space.
15. Databases of geographic information systems - a collection of geographic data organised, systematised and arranged methodologically according to the principles of geoinformation systems where bases of graphic and attributed data stored in automated data media are separated conditionally.
16. Georeference database - a collection of data bases of the geodetic control, engineering networks and topographic information of a certain territory systematised and methodologically arranged, organised in accordance with the principles of geoinformation systems, collected and stored in automated data media.
17. Database of the geodetic control - a subsystem of the georeferece database comprising a collection of geometric and attribute (textual) information on the geoid and the geodetic control arranged systematically and methodologically.
18. Geoid - an imaginary shape of the Earth defined by mean sea level and used for the solution of theoretical and practical geodetic tasks.
19. GPS (Global Positioning System) – a system of satellites and receiving devices used to determine positions, for development and updating of state geodetic networks and for other theoretical and practical tasks.
20. Engineering network database – a subsystem of a georeference database comprising a set of graphic and attribute (textual) information about the engineering network arranged in a systematic and methodological way.
21. Cartography - a method in geographic cognition as well as a field of scientific and industrial activity involving plane representation by graphic models of spatial natural and anthropogenic objects and phenomena, the production and publishing of cartographic products (maps, cartoschemes, plans etc.) and creation of geographic information databases.
22. Mapping - the process involving making, production and publishing of cartographic products.
23. Cartographic database – a set of cartographic data arranged systematically and methodologically.
24. Metadata – information relating to the data about a concrete geoobject, a group of objects or geographical database, their origin and brief description.
25. Official map – a map of the content approved by the institution authorised by the Government, made, following the cartographic methodology, bearing the copyright notice of the institution authorised by the Government as the administrator of the exclusive economic rights of the author.
26. Digital map – a model of a locality comprising the entirety of the spatial co-ordinates and characteristics of the coded points of a locality, recorded in an information media of a set structure either in the form of vectors or rasters.
27. Special cartography - activity involving making, production and publishing of maps, cartoschemes and plans for special purposes and development of special databases which are strictly subject to regulation.
28. Special purpose geodetic, topographic and cartographic work - work involving making and publishing of special maps, plans for building sites and engineering networks, and development of databases of other specialised information.
29. Thematic cartography – activity involving making, production and publication of thematic maps and cartoschemes of various types, and creation of thematic databases.
30. Thematic map - a map representing objects or phenomena on a single topic.
31. Topography - an activity of geodetic and surveying engineering comprising spatial measurement of natural and physical objects (the relief, hydrography and vegetation) as well as anthropogenic and isolated topographic objects and their representation on topographic maps and plans by standard methods.
32. Topographic database - a subsystem of a georeference database consisting of a set of graphic and attribute (textual) information about physical, natural and anthropogenic objects of the Earth arranged in a systematic and methodological way.
33. Topographic cartography - activity involving the production of topographic maps.
34. Topographic plan - a topographic map at large scale (1:500-1:5000) made without taking into account the spheric shape of the earth.
35. Topographic map - a map that shows topographic objects of the Earth’s surface on a planar surface, in a certain mathematical projection, at a set scale and conventional symbols, in conformity with the international requirements. According to their scale, topographic maps are subdivided into large scale maps of 1:5000 – 1:20,000, medium scale maps of 1:25,000 – 1:50,000, and small scale maps of 1:100,000 – 1:1,000,000).
36. Nomenclature of topographic maps - an international and/or national system of dividing of maps into sheets and of indexing.
37. State geodetic base - a set of state geodetic networks, with their characteristic features and parameters.
38. Map – a reduced and generalised representation of the objects, natural or social and economic phenomena of the Earth on a planar surface, expressed by a mathematical projection, at a set scale and by conventional symbols.
39. Scale of a map or a plan – the ratio between the length of a line on a map or a plan and the horizontal projection of the corresponding line of a locality. CHAPTER TWO GEODETIC AND CARTOGRAPHIC ACTIVITIES Article
40. Geodetic and Cartographic Activities Geodetic and cartographic activities shall involve: 1) establishment and periodic updating of the state geodetic control of the territory of the Republic of Lithuania; 2) compilation, publishing and periodic updating of topographic maps and plans of the whole range of scale of the territory of the Republic of Lithuania, its economic zone and continental shelf in the Baltic Sea; 3) compilation publishing and periodic updating of maps and plans for special purposes; 4) compilation publishing and periodic updating of thematic maps, cartoschemes and atlases; 5) creation and maintenance of georeference databases; 6) creation and maintenance of geographical information systems. Article
41. Legal Acts Regulating Geodetic and Cartographic Activities Geodetic and cartographic activities shall be regulated by this Law, the Law on the Governing of the County, the Law on Local Self - Government, the Law on the Territorial Administrative Units of the Republic of Lithuania and their Boundaries, the Law on the State Border and Protection thereof, the Law on Archives, the Law on Metrology, the Law on Construction, the Law on Territorial Planning, the Law on State Registers, the Law on Land, the Law on State and Official Secrets, the Law on Copyright and Related Rights, the Law on the Management, Use and Disposal of State and Municipal Assets, the Law on Enterprises and other laws, international agreements of the Republic of Lithuania, resolutions of the Government and other legal acts. Article
42. Objects of Geodetic and Cartographic Activities The following shall be the objects of geodetic and cartographic activities: 1) the territory of the Republic of Lithuania and the objects situated on the surface of the Earth, as well as natural and socio-economic phenomena; 2) the economic zone of the Republic of Lithuania and its continental shelf in the Baltic Sea; 3) the state border of the Republic of Lithuania; 4) other territories, phenomena and objects when used for special purpose, thematic and astronomic mapping; 5) geographic place names. Article
43. Subjects of Geodetic and Cartographic Activities Subjects of geodetic and cartographic activities shall be the institution authorised by the Government (hereinafter – the authorised institution), ministries, county governors, other state institutions, municipal executive institutions, state enterprises, agencies, other legal and natural persons and enterprises without the status of a legal person whose activities are related to cartography, geodetic surveying, collection, recording and use of the data obtained in the cases provided by this Law and other legal acts. CHAPTER THREE OWNERSHIP OF GEODETIC, TOPOGRAPHIC AND CARTOGRAPHIC MATERIALS Article
44. Ownership of Geodetic, Topographic and Cartographic Materials
45. Topographic plans, large, medium and small scale topographic maps of the territory, the economic zone and the continental shelf of the Republic of Lithuania, satellite imagery and ortophotographic maps, charts and aeronavigational maps and other maps, in analogue/printed and digital form, their edited and printing originals, georeference databases, photoplans, aerial photography, geodetic networks of all types and geodetic databases and archival materials related to them (materials of field and laboratory operations, information about gravimetric and magnetometric measurements) where they have been financed from the state budget resources or foreign aid shall be regarded state property held in trust, used and disposed by the authorised institution in the manner laid down in law.
46. Geodetic networks, topographic maps and plans, and georeference databases financed from the municipal budgets shall be the property of the municipalities.
47. The products of thematic cartography shall be the property of the customer. Where there is no customer or where the customer transfers this right to the legal or natural persons which carried out the mapping, the latter shall acquire the right of ownership to manage, use and of the cartographic product. CHAPTER FOUR STATE MANAGEMENT OF GEODETIC AND CARTOGRAPHIC ACTIVITIES Article
48. Institutions of Geodetic and Cartographic Activities Geodetic and cartographic activities shall be managed by the Government through an authorised institution. Article
49. Competence of the Government in the Field of Geodesy and Cartography The Government shall: 1) formulate the policy of the State in the sphere of geodesy, cartography and creation of georeference databases; 2) establish an authorised institution for geodesy and cartography and approve its regulations; 3) approve the procedure for determining the systems of geodetic co-ordinates, altitudes and their use, as well as the frequency of periodic updating of state geodetic networks and official maps; 4) approve the rules for licensing of geodetic, topographic and cartographic activities, the programmes for the development of the state geodetic control and its updating, for mapping and creation of databases of georeference data, and for the schemes for dividing maps into map sheets. Article
50. Competence of the Authorised Institution The authorised institution, in implementing the state policy of the Republic of Lithuania in the field of geodesy, cartography and creation of georeference databases, shall: 1) develop, following the procedure laid down in legal acts, and in co-ordination with the interested institutions, programmes for establishing and updating the state geodetic control, for mapping and creation of georeference databases, and draw up schemes for dividing maps into map sheets, prescribe a periodic updating of state networks and official maps and submit them to the Government for its approval; 2) hold in trust, use and dispose of the state property comprising the geodetic and cartographic material of the territory of the Republic of Lithuania, its economic zone and the continental shelf of the Baltic Sea; 3) provide methodological guidance for mapping, establishment of the state geodetic control, geodetic, topographic work, creation of georeference databases, co-ordinate, within the limits of its competence, unification and compatibility of the georeference bases with the other information systems; 4) approve accuracy orders of state geodetic networks, the contents and mapping methodology of the official maps; 5) organise the implementation of the programmes for the establishment and updating of the state geodetic basis, mapping, and creation of the georeference databases; 6) organise the geodetic and topographic work of the state border of the Republic of Lithuania, provide methodological guidance for work of boundary marking and mapping of administrative boundaries of the territories of municipalities; 7) co-ordinate the state geodetic and cartographic work and the implementation of international and national programme and projects in the sphere of geodesy and cartography; 8) co-ordinate with other institutions and agencies aerial photography on the territory of the Republic of Lithuania, its economic zone and the continental shelf in the Baltic Sea, and issue authorisations for aircraft crews to carry out this work; 9) draft and approve the standard requirements, technical regulations and specifications for geodesy, cartography and creation of georeference databases, and ensure their approximation with the standards of the European Union and North Atlantic Treaty Organisation (NATO); 10) draft, following the established procedure, resolutions of the Government related to the spheres of its activity; 11) issue and withdraw, following the procedure established by laws and other legal acts, licences for geodetic and cartographic activities specified in this Law, and control quality of the licensed work; 12) administer, in accordance with the procedure prescribed by law, the exclusive economic rights of the authors of official maps and georeference databases; 13) provide methodological guidance to county governors and the employees and divisions authorised by the municipalities in organising geodetic and cartographic activities; 14) provide, in the manner prescribed by the Government, geodetic, topographic and cartographic materials and georeference data to state and municipal institutions and other undertakings; 15) perform the functions assigned to it by this Law, other legal acts and by the Government. Article
51. Competence of the County Governor and Municipal Executive Institutions in the Field of Geodesy and Topography
52. In exercising state supervision of the territorial planning of the municipality territories, the county governor shall, in the manner prescribed by the authorised institution, supervise geodetic, topographic and geoinformatic activities of the municipalities.
53. The competence in the field of geodesy and topography of the municipal executive institutions shall be as follows: 1) to hold in trust, use and dispose of the property owned by the state made up of the topographic plans of the municipality territory at scale 1:500-1:5000, georeference databases and geodetic networks; 2) to solve the issues in respect of the updating of geodetic and topographic materials (M 1:500-1:5000) and their use, densification of geodetic networks and protection of geodetic marks on the territory of the municipality; 3) to organise survey, marking and mapping of the administrative boundaries of the municipality territories, making of topographic plans at scale 1:500-1:5000, georeference databases, local geodetic networks and determine the procedure of their use and display; 4) to determine, in accordance with the specifications of the georeference databases, the contents of the databases of the municipality territories and conditions of their use for natural and legal persons, without violation of the copyright; 5) to exercise, in the manner prescribed by the Government and in accordance with this Law, supervision of geodetic and topographic activities on the municipality territory; 6) to provide to the authorised institution the information at its disposal which is needed for making and updating of base and special maps; 7) when issuing authorisations for construction, following the procedure under the Law on Construction of the Republic of Lithuania, it must ensure the preservation of geodetic points and visibility between the adjacent points of the planimetric geodetic network. Article
54. Competence of the Ministries and State Institutions in the Field of Geography and Cartography
55. The interested ministries and state institutions shall: 1) take part in developing the strategy of mapping and updating as well as the strategy of creating georeference databases; 2) organise the implementation of the programmes of geodesy and cartography of appropriate departments; 3) co-ordinate the programmes and projects of geodesy and cartography which are financed from the state budget.
56. The administrators of state cadastres, classifiers, registers and other special purpose thematic geographic information systems which are financed from the state budget shall prepare, compile and arrange systematically the information, graphic documentation (plans and schemes) pertaining to territorial planning on the basis of base maps or georeference databases, guided by the standards, technical regulations and specifications approved by the authorised institution.
57. Administrators of departmental databases shall be held responsible for the credibility of the data and their integrity in the geographic information systems. Article
58. State Geodetic and Topographic Activities
59. There shall be the following types of state geodetic and topographic activities: 1) development and periodic updating of the State geodetic control as well as the adjustment of the parameters; 2) periodic adjustment of the parameters of the geoid; 3) aerial photography from the aeroplanes and artificial satellites for the needs of cartography; 4) making of ortophoto maps; 5) compilation , updating and publishing of topographic maps at scale 1:10,000, 1:20,000 (1:25,000),1:50,000, 1:100,000 (1: 125,000), 1:500,000 and 1:1,000, 000; 6) developing of georefernce databases. Article
60. Thematic and Special Purpose Geodetic, Topographic and Cartographic Work
61. State thematic and special purpose geodetic, topographic and cartographic work shall comprise: 1) compilation, publishing and updating of a national atlas; 2) compilation and updating of thematic inventory maps (register/cadastre of immovable property, geology, soil, forests etc.,) development of thematic geographic information systems; 3) compilation, updating and publishing of thematic maps; 4) compilation, updating and publishing of navigation charts and aeronautical charts; 5) compilation of transport, communications and other maps; 6) remote sensing from satellites and aeroplanes intended for environmental protection, forestry and agriculture, surveying of natural resources, etc.; 7) geodetic, topographic and cartographic work related to the State border; 8) tie-in of the military training sites, combat positions and other military objects and territories/boundaries with the geodetic control; 9) densification of geodetic networks/establishing of special-purpose geodetic networks; 10) specialized interpretation of aerial and satellite images; 11) developing special-purpose geographic information systems. Article
62. Municipal Geodetic and Topographic Work Geodetic and topographic work of the municipalities shall comprise: 1) development and periodic updating of geodetic networks of the municipalities, and adjustment of the parameters; 2) producing topographic maps of the territory of the municipality at scale 1:500-1:5,000, their periodic updating and development of the georeference databases; 3) large-scale aerial photography of the territory of the municipality intended for the updating of the topographic urban plans, detailed territorial planning and other needs; 4) topographic work for drawing up plans of construction sites and engineering networks, and updating of the existing maps/plans; 5) on-site project marking; 6) supervision of on-site marking of structures and facilities. Article
63. Management of Geodetic, Topographic and Cartographic Work
64. Geodetic, topographic and cartographic work shall be managed by the Government through the authorised institution, through its relations with the ministries, county governors, other State institutions, municipal executive institutions, enterprises, agencies and organisations whose activities fall under the regulation of this Law.
65. Geodetic and cartographic work designed for producing topographic and other official maps, plans, georeference databases shall be performed in accordance with the work programme co-ordinated with the authorised institution. CHAPTER FIVE STATE SUPERVISION AND QUALITY CONTROL OF STATE GEODETIC, TOPOGRAPHIC AND CARTOGRAPHIC WORK Article
66. Objectives of State Supervision and Quality Control of State Geodetic, Topographic and Cartographic Work The objectives of State supervision and control shall comprise the following tasks: 1) to ensure co-ordination of State cadastres, registers, classifiers, other databases and maps, to provide a possibility to exchange and supplement information at minimum costs, to avoid duplication of work and accumulation of low quality information when conducting geodetic, topographic and cartographic work, when keeping record and exercising control; 2) to control compliance of the enterprises and departments with the requirements of the licensed activity when carrying out geodetic, topographic and cartographic work on the territory of the Republic of Lithuania. Article
67. Exercise of State Supervision and Quality Control of State Geodetic, Topographic and Cartographic Work
68. The authorised institution shall exercise state supervision and quality control of state geodetic, topographic and cartographic work, creating and maintenance of georeference databases.
69. The authorised institution shall control compliance of the licensed geodetic and cartographic work with the standards and quality requirements set out in technical regulations.
70. The county governor shall, following the procedure established by the authorised institution, exercise control the work involving creating, maintenance and updating of geodetic, topographic and georeference databases in the territory of the county. CHAPTER SIX CONDITIONS AND REGULATION OF GEODETIC, TOPOGRAPHIC AND CARTOGRAPHIC ACTIVITIES Article
71. Principal Requirements for Geodetic, Topographic and Cartographic Work When carrying out geodetic, topographic and cartographic work it shall be obligatory: 1) to ensure compliance with the international and national standards and the requirements of regulatory enactments, accurate representation of the boundaries of the State border and the administrative units on the territory of the Republic of Lithuania, that other political, administrative and geographic formations represented in cartographic products conform to the international agreements, and in the field of defence – to NATO standard requirements, legal acts and other documents; 2) to indicate place names in maps and georeference databases in accordance with the recommendations of the United Nations Organisation on standards and in compliance with the linguistic norms established and approved by the State Lithuanian Language Commission; 3) to perform geodetic, topographic and cartographic work by using the State systems of co-ordinates and heights; 4) to ensure adequate quality of cartographic products; 5) to compile, arrange systematically and keep geodetic and cartographic materials; 6) to employ methods of work which are not harmful for human health and the natural environment. Article
72. Licensing and Authorisation of Geodetic, Topographic and Cartographic Work
73. The licensing regulations of geodetic, topographic and cartographic work shall be approved by the Government.
74. The following geodetic work shall be subject to licensing: 1) establishment of the GPS /spatial network; 2) establishment of the planimetric network; 3) establishment of the level network; 4) establishment of the gravimetric network; 5) establishment of the magnetometric network; 6) surveying to determine setting and inclinations of buildings and structures; 7) surveying of the objects of the land registry index; 8) marking of structures and facilities in an area and drawing up schemes of their position.
75. The following topographic and cartographic activities shall be subject to licensing: 1) aerial photography intended for the production of maps and plans; 2) production of topographic maps; 3) production of topographic plans; 4) production of the engineering networks plans; 5) development of georeference databases; 6) production of batimetric plans and maps; 7) production of nautical charts; 8) production of air navigational charts; 9) thematic mapping for commercial purposes.
76. Licences for geodetic, topographic and cartographic activities shall be issued by the authorised institution following the provisions of this Law, the Law on Enterprises and the licensing regulations approved by the Government.
77. Authorisations for aerial photography of the territory, the economic zone and the continental shelf of the Republic of Lithuania shall be issued by the authorised institution following the procedure established by the Government or the authorised institution with the approval of the Directorate of Civil Aviation and the Ministry of National Defence.
78. Authorisations for geodetic, topographic and cartographic activities in the border area, high risk facilities, prohibited zones and military training sites shall be issued by the institutions to which these objects are assigned, following the procedure by the authorised institution and subject to the approval of the authorised institution.
79. Authorisations to use and access geodetic and cartographic information constituting a state secret shall be issued in accordance with the procedure laid down in the Law on State and Official Secrets. Article
80. Verification of Geodetic, Cartographic and Photogrametric Equipment
81. The authorised institution shall organise, co-ordinate and exercise supervise the verification and validation of geodetic, cartographic and photogrametric instruments.
82. The licensed enterprises engaged in geodetic, topographic and cartographic work must organise and conduct, on a periodic basis, metrological verification or calibration of the technical equipment according to the requirements of technical regulations and prescribed standards.
83. Verification and certification of instruments shall be conducted following the provisions of the Law on Metrology and other legal acts. Article
84. Financing of Geodetic, Topographic and Cartographic Activities
85. State geodetic, topographic and cartographic activities shall be financed from the state budget and funds from the financial assistance provided by foreign states. Cartographic products shall include production of printing originals of maps and publishing of the minimum number of maps intended for state institutions.
86. State thematic and special purpose geodetic, topographic and cartographic work shall be financed from the state budget.
87. Geodetic and topographic work as well as geoinformatics work which, under the Law on the County Governance and the Law on Territorial Planning, is within the jurisdiction of county governors, and which, under this Law, fall within the competence of the executive municipal institutions, shall be financed from the state budget, municipal budgets and other financial sources. CHAPTER SEVEN PROTECTION OF GEODETIC POINTS Article
88. Geodetic Points
89. The following shall be regarded as geodetic points: 1) underground, ground, wall and surface marks of geodetic networks of all levels of accuracy with the adjacent safety zone; 2) special purpose points of the geodetic control.
90. Geodetic points shall be protected by the State.
91. Geodetic points shall be marked by geodetic marks the types whereof shall be determined in technical regulations and standards approved by the authorised institution. Article
92. Setting Up and Protection of Geodetic Marks
93. The owners and users of land parcels as well as the owners and users of structures shall be obliged: 1) to permit setting up of geodetic marks on land parcels and structures belonging to them, subject to a mutual agreement in respect of the site of setting up the mark; 2) not to destroy or damage geodetic marks set up for state and research needs; 3) to permit surveying, subject to a mutual agreement in respect of the work schedule and compensation for any potential losses.
94. One-metre wide safety zone shall be established around the ground geodetic marks from their external boundary, where any economic activity shall be prohibited.
95. By way of exception, in order to set up geodetic points, land may be taken for public needs, following the procedure laid down in the Law on Land.
96. Losses incurred by the owners and users of land parcels resulting from taking of the land for public needs in order to set up geodetic points shall be compensated for, following the procedure laid down in the Law on Land.
97. Record keeping of the geodetic points shall be administered and their protection shall be organised by the executive institutions of the municipalities.
98. Destroyed or damaged points of the geodetic network shall be reinstated or repaired at state expense. Persons who have caused destruction of or damage to the points of the geodetic network shall be held liable following the procedure under law.
99. In exceptional cases geodetic marks may be moved to another place or destroyed: 1) marks of the state geodetic networks – subject to an authorisation of the authorised institution; 2) marks of the municipal networks or local geodetic networks – subject to an authorisation of the executive institution of a municipality; 3) marks of special purpose geodetic networks – subject to an authorisation of their owners. CHAPTER EIGHT MAPS AND DATABASES Article
100. Topographic Maps and Plans
101. Topographic maps and plans must be updated at least once every ten years.
102. Topographic maps and plans as well as the results of surveying of the geodetic networks shall constitute the basic information which must be used as a reference for other maps and development of spatial databases. Article
103. Special Purpose Cartographic Products
104. Special purpose cartographic products shall include the following: 1) maps of the delimitation and demarcation of the State border; 2) maps prepared on the basis of satellite images; 3) aeronautical charts; 4) nautical charts; 5) batimetric maps;
105. plans of the engineering networks.
106. Special purpose maps and plans shall be made and updated within the time limits determined by the Government or the institutions authorised by it. Article
107. Thematic Cartographic Products
108. Thematic cartographic products shall include the following: 1) the national atlas; 2) inventory maps, including maps of registers(cadastres); 3) scientific maps, cartoschemes and atlases; 4) maps, cartoschemes and atlases for educational purposes; 5) maps, cartoschemes and plans for the purposes of planning; 6) multi-purpose maps and cartoschemes.
109. Thematic maps, cartoschemes and plans shall be produced and updated within the time limits determined by the Government, the authorised or interested institutions. Article
110. Georeference Database
111. The georeference database shall be created, revised and updated continuously taking into account the topographic and engineering networks databases.
112. The information contained in the georeference database shall be used as a basis for updating the databases of state cadastres, registers and classifiers or for developing their own databases built according to the principles of geographical information systems. Article
113. Database of the Geodetic Control
114. The database of the geodetic control shall be created according to the principles of geoinformation systems and shall comprise the following information: 1) the geodetic networks and points; 2) the parameters of the geoid; 3) the metadata.
115. The database of the geodetic control shall be updated and systematically supplemented following the requirements established by the authorised institution. Article
116. Cartographic Database
117. The purpose of the cartographic database shall be to provide the cartographic basis and data for the production of topographic and thematic maps at an appropriate scale, and for creation and updating of thematic databases.
118. A cartographic database shall be created in accordance with a single coding system of geodata and following the methodology of data accumulation established by the authorised institution. 3, The contents, symbols, element codes and attributes of a cartographic base of a specific scale shall be laid down in the technical regulations approved by the authorised institution. The requirements set therein shall be mandatory for all enterprises, departments and organisations of the Republic of Lithuania.
119. Cartographic databases for defence purposes shall be created according to the NATO standard coding system and structure and shall be used for making special purpose maps, area assessment and other defence objectives.
120. Cartographic databases make possible a systematic and structured accumulation, updating and filing of topographic and cartographic data for diverse purposes, its transmission to other data banks and geoinformation systems. Article
121. Database of the Engineering Networks The engineering networks database shall be created according to the principles of information systems from the entirety of graphic and attribute (textual) data and shall comprise information about the engineering networks: 1) electricity transmission lines; 2) energy supply lines; 3) telecommunications lines; 4) water supply system; 5) oil, gas and other fuel pipelines; 6) heating system; 7) waste water disposal lines. Article
122. The Integrated Geoinformation System
123. The integrated geoinformation system (InGIS) is a subsystem of the State Information System of the Republic of Lithuania comprising the interrelated data exchange processes between the major State cadastres and registers in the development and use of official geoinformation. The system shall determine how geodata is to be created, registered, standardised and administered, and will serve as a link between various cadastres and registers which make use of the cartographic base.
124. The integrated geoinformation system shall be intended for providing state institutions in an economic and efficient way with the basic geoinformation when dealing with the administration, planning and record keeping of national, regional and local issues.
125. The integrated geoinformation system shall embrace building of georeference, state, departmental and territorial cadastres and registers, as well as compiling, updating, managing, using and supplementing of integrated databases of territorial planning. Article
126. Storing of Geodetic, Topographic and Cartographic Information
127. The authorised institution shall store, before transferring them to the State archives, the following geodetic, topographic and cartographic materials: 1) the materials relating to the establishment and updating of the State geodetic network; 2) analogue (printed), topographic and special purpose maps of the whole range of scale and made in accordance with different co-ordinate systems; 3) maps of Lithuania's territorial sea, economic zone, continental shelf and State border; 4) satellite images; 5) aerial photos.
128. Municipal institutions shall store, before transferring them to the State archives, the following geodetic and topographic materials: 1) the materials relating to the establishment and updating of the geodetic network of the territory of the municipality; 2) analogue (printed) and digital topographic plans of the whole range of scale, made in accordance with various co-ordinate systems.
129. The geodetic and cartographic material constituting a state secret shall be stored and used in accordance with the Law on State and Official Secrets.
130. The authorised state and municipal institutions shall transfer geodetic, topographic and cartographic materials to state archives following the procedure laid down in the Law on Archives. Article
131. Copyright Protection
132. The Republic of Lithuania shall be the copyright holder of the exclusive economic rights to official maps and digital databases financed from the state budget and foreign assistance for the Republic of Lithuania. The authorised institution shall, within the limits of its competence, administer the exclusive economic rights of the authors to official maps and georeference databases. The municipalities shall be the copyright holders of the exclusive economic rights of the authors to topographic maps, plans and georeference databases financed from the municipal budgets and shall, within the limits of their competence, administer the exclusive economic rights of the authors. For the use of official maps and georeference databases, publishing of thematic maps or development of institutional digital databases, with the exception of their use for defence needs, an author's fee shall be charged and a copyright licensing agreement shall be made with the user. The remuneration received as the author's fee shall be used for adjustment of official maps and georeference databases. The rights to cartographic works, thematic and other maps and databases shall be protected following the procedure under law.
133. Original works of thematic cartography shall be regarded as research work and their publication shall be recognised as scientific publications. Article
134. Procedure of Use of Geodetic, Topographic and Cartographic Materials
135. Geodetic, topographic and cartographic materials and georeference data shall be public and available to any natural and legal persons and enterprises without the status of a legal person.
136. The authorised institution and executive institutions of the municipalities shall provide to the consumers geodetic, topographic and cartographic materials and georeference data following the procedure established by the authorised institution and executive institutions of the municipalities. Fees for the materials and data shall be charged in the manner stipulated by laws.
137. Enterprises, departments, organisations, citizens, stateless persons and foreign nationals who are in permanent residence in the Republic of Lithuania shall have a right to use geodetic, topographic and cartographic materials and georeference data in the possession of the authorised institution and executive institutions of the municipalities following the procedure laid down in laws.
138. When using geodetic, topographic and cartographic materials and georeference data of the authorised institution and executive institutions of the municipalities it shall be prohibited: 1) to copy without an authorisation of the authorised institution cartographic materials, aerial photos sand geodedetic data for the purposes of distribution except when intended for defence purposes; 2) to transfer in any way the materials/their copies obtained in the process of conducting geodetic, topographic and cartographic work without a prior authorisation and where this is not provided for in a licensing agreement on the use of the materials and data except when intended for defence purposes.
139. Cartographic materials and data related to the information constituting a state secret shall be made available to the consumers in accordance with the Law on State and Official Secrets. CHAPTER NINE RIGHTS AND DUTIES OF THE ENTERPRISES CARRYINGOUT GEODETIC, TOPOGRAPHIC AND CARTOGRAPHIC WORK. DISPUTE RESOLUTION Article
140. Rights and Duties of the Enterprises Involved in Geodetic, Topographic and Cartographic Work
141. Enterprises involved in geodetic, topographic and cartographic work, subject to the approval of the authorised institutions, shall have the right: 1) to enter land parcels or building sites and carry out the necessary surveying; 2) to install geodetic points and protective equipment.
142. The enterprises shall be obliged: 1) to maintain the sites of the geodetic points, repair the railings, restore the earthwork and provide information about the condition of geodetic points to the executive institution of municipalities; 2) to ensure that during construction works the geodetic control points are not destroyed and that visibility between the adjacent points of the planimetric network is not impaired; 3) to submit, following the procedure prescribed by the authorised institution, surveying reports and reports about cartographic work.
143. The provisions of paragraph 1 of this Article shall not apply to the grounds of the missions of foreign states, missions of international organisations, consular institutions and restricted areas of the divisions of the Ministry of the Interior. Article
144. Dispute Resolution
145. Disputes in respect of geodetic, topographic and cartographic activities, their state supervision, the use of geodetic and cartographic materials, and protection of geodetic points shall be settled in accordance with the procedure provided for by law.
146. Disputes between legal and natural persons as well as between enterprises without the status of a legal person of the Republic of Lithuania and foreign states shall be settled in the manner prescribed by law of the Republic of Lithuania unless international agreements to which the Republic of Lithuania is a party provide otherwise. Article
147. Liability for Breaches of this Law Legal and natural persons as well as enterprises without the status of a legal person which are in breach of this Law shall be prosecuted under the laws of the Republic of Lithuania. CHAPTER TEN INTERNATIONAL AGREEMENTS Article
148. Rights of Legal and Natural Persons of Foreign States and Foreign Enterprises without the Status of a Legal Person to Carry out Geodetic and Cartographic Activities in the Republic of Lithuania Legal and natural persons of foreign states as well as foreign enterprises without the status of a legal person shall be granted the right to carry out geodetic, topographic and cartographic work in accordance with the international agreements to which the Republic of Lithuania is a party, this Law, other laws and legal acts of the Republic of Lithuania.
