Approved by Decree No GOVERNMENT OF THE REPUBLIC OF LITHUANIA DECREE No. 1153 ON THE ESTABLISHMENT OF HIGHER EDUCATION INSTITUTIONS AND ISSUANCE OF LICENSES TO PURSUE STUDIES Vilnius, 9 September 2003 Observing paragraph 4 of article 13, paragraph 3 of article 14, paragraphs 2, 3 and 4 of article 15 and paragraph 1 of article 67 of the Law on Higher Education of the Republic of Lithuania (Official Gazette, 2000, No.27-715; 2002, No.3-75; 2003, No.47-2058), the Government of the Republic of Lithuania r e s o l v e s: 1. To approve the Order of the Establishment of Higher Education Institutions and Issuance of Licenses to Pursue Studies (attached). 2. To establish that supervision of the activity of non-state higher education institutions, that have acquired licenses to pursue studies under the Rules on Issuance of Licenses for the Activity of Non-state Higher Education Institutions, approved by Decree No.999 of 30 August, 2000 of the Government of the Republic of Lithuania (Official Gazette, 2000, No73-2253; 2003, No.19-824), shall be carried out observing the procedure laid down in paragraph 1 of chapter VI of this decree. 3. To assign the Ministry of Education and Science to prepare and approve the order of issuance and registration of licenses to pursue studies up to 31 December, 2003. 4. To declare invalid: 4.1. Decree No.999 of 30 August, 2000 of the Government of the Republic of Lithuania “On the Approval of the Order of the Establishment of Higher Education Institutions and the Rules on Issuance of Licenses for the Activity of Non-state Higher Education Institutions, (Official Gazette, 2000, No.73-2253); 4.2. Decree No.1441 of 13 September, 2002 of the Government of the Republic of Lithuania “On the Amendment of Decree No.999 of 30 August, 2000 of the Government of the Republic of Lithuania “On the Approval of the Order of the Establishment of Higher Education Institutions” (Official Gazette, 2002, No.91-3903); 4.3. Decree No.244 of 20 February, 2003 of the Republic of Lithuania “On the Amendment of Decree No.999 of 30 August, 2000 of the Government of the Republic of Lithuania “On the Order of the Establishment of Higher Education Institutions and the Rules on Issuance of Licenses for the Activity of Non-state Higher Education Institutions” (Official Gazette, 2003, No.19-824). Prime Minister Algirdas Brazauskas Minister of Education and Science Algirdas Monkevičius Approved by Decree No.1153 of 9 September, 2003 of the Government of the Republic of Lithuania THE ORDER OF THE ESTABLISHMENT OF HIGHER EDUCATION INSTITUTIONS AND ISSUANCE OF LICENSES TO PURSUE STUDIES I. GENERAL PROVISIONS 1. The order of the establishment of higher education institutions and issuance of licenses to pursue studies (hereinafter referred to as “the Order”) shall establish the requirements for and preparation of initiative applications and applications for the establishment, shall regulate issuance of licenses to non-state higher education institutions to pursue studies, issuance of licenses to pursue studies following study programmes of higher education institutions of other states and to carry out other activity related to studies. 2. A state university shall be established by the Seimas of the Republic of Lithuania upon proposal of the Government of the Republic of Lithuania. A state university shall be established only by means of reorganization of a university subdivision, operating higher education institution or several operating higher education institutions. 3. A state college shall be established by the Government of the Republic of Lithuania upon proposal of the Ministry of Education and Science (hereinafter referred to as “the Ministry”). A college may also be established upon joint proposal of the Ministry and a university. In this case, the statute of the college shall be approved upon consent of the university council. 4. A state higher education institution shall be established in two stages: 4.1. after the analysis of the initiative application, a decision concerning the expedience and possibility to establish a new state higher education institution shall be made; 4.2. only after the positive decision in the first stage has been made – an application for the establishment of higher education institutions shall be submitted and considered. 5. A non-state higher education institution or a branch of the higher education institution of a foreign state can be established only by a legal entity (except for Lithuanian state higher education institutions), which has material basis indispensable for ensuring the activity of the higher education institution and the license to pursue studies issued in the procedure laid down by this Order. 6. In Lithuania studies following study programmes of higher education institutions of other states can be pursued only if there is a national assessment (accreditation) system in these states, in accordance with which these higher education institutions or their programmes have been assessed (accredited). These study programmes can be pursued by Lithuanian higher education institutions and other legal entities, as well as foreign higher education institutions that have received the license to pursue studies in the procedure laid down in this Order. 7. The higher education institution shall be entitled to start its activity from the day of its registration in the Register of Legal Entities and registration of the study programmes in the Register of Study and Teaching Programmes (until the beginning of the action of the Register of Legal Entities higher education institutions shall be registered in the State Register of Educational and Higher Education and Research Institutions). Higher education institutions shall be registered after the commission formed by the Ministry confirms that all the conditions prescribed when passing the resolution of the Seimas of the Republic of Lithuania or the decree of the Government of the Republic of Lithuania concerning the establishment of the higher education institution or the approval on issuance of the license to pursue studies have been fulfilled. 8. Lithuanian and foreign higher education institutions, other legal entities intending to pursue studies in Lithuania following study programmes of higher education institutions of other states and pursue other activities related to studies, can pursue these activities after the commission formed by the Ministry confirms that all the conditions prescribed when passing the decree of the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies following study programmes of higher education institutions of other states have been fulfilled. 9. The activity related to studies shall imply: announcement of the admission to studies, conclusion of study agreements, implementation of studies or consultations, issuance of state-recognized educational certificates, diploma of a professional qualification or qualification degrees. 10. Forwardness to pursue studies in cases laid down by this Order shall be assessed by the Lithuanian Centre for Quality Assessment in Higher Education (hereinafter referred to as “the Centre”) in the procedure established by the Ministry. 11. In case when, after analyzing the submitted documents, the Centre makes a decision that the higher education institution has not fully prepared for its activity and points out some supplementary conditions to be fulfilled or makes a decision that it has not been prepared for the activity of the higher education institution, within 20 days from the day of the receipt of the conclusion the applicant can once submit an appeal to the Minister of Education and Science, which shall be dealt by the appellate commission formed by the Minister of Education and Science in the order established by the Ministry. 12. The negative decision made by the appellate commission formed by the Minister of Education and Science shall be binding; following the decision, the Minister of Education and Science shall make a decision not to propose a draft decree on the establishment of a higher education institution or the approval on issuance of the license to pursue studies to the Government of the Republic of Lithuania. The Minister of Education and Science may also make a decision not to propose a draft decree on the establishment of a higher education institution or the approval on issuance of the license to pursue studies to the Government of the Republic of Lithuania, if the conclusions of the Centre are negative, but the appeal has not been made. 13. After the Minister of Education and Science receives all the documents required to be submitted by this Order, except for the cases pointed out in paragraph 12 of this Order, the Minister makes a reasoned decision concerning the submission of a draft decree to the Government of the Republic of Lithuania on the establishment of the higher education institution or the approval on the issuance of the license to pursue studies. Conditions to be fulfilled by the determined time may (if after the analysis of the application the Centre has made a negative conclusion – have

  1. to)be pointed out in the draft decree. 14. Licenses to pursue studies shall be issued by the Ministry. The order of the issuance and registration of licenses to pursue studies, the form and the content of these licenses shall be determined by the Ministry. II. ESTABLISHMENT OF STATE HIGHER EDUCATION INSTITUTIONS 15. Initiator of the establishment of a higher education institution (hereinafter referred to as “the initiator of the establishment”) may be a ministry of the Republic of Lithuania, council of a municipality, regional governor’s administration, state university. 16. The initiator of the establishment shall submit to the Ministry an initiative application consisting of: 16.1. the proposal to establish a state higher education institution; 16.2. reasoning of the need to establish a state higher education institution; 16.3. a draft programme of the activity of the state higher education institution to be established, the main components of which shall be the following: 16.3.1. a list of study programmes planned to be pursued and their short description; 16.3.2. a list of the planned research activity (in case of non-university studies – applied research activity) and reasoning of this activity; 16.3.3. reasoning of the need of the state property and budgetary means for the activity of the higher education institution; 16.4. a plan for the use of the state property necessary for the planned activity; 16.5. an outline of the development of the state higher education institution. 17. The ministry shall submit the received initiative application to the Science Council of Lithuania, Lithuanian Universities Rectors’ Conference (Conferences), Directors’ Conference (Conferences) of Lithuanian Colleges, Union (Unions) of Student Representatives of Lithuania and the Centre with the view of assessing the expedience and possibilities of the state higher education institution. 18. If the Ministry does not approve the establishment of the state higher education institution on the grounds of the conclusions of the institutions listed in paragraph 17 of this Order, it shall give a reasoned answer to the initiator of the establishment. Documents of the application shall not be returned to the initiator of the establishment. 19. If the Ministry approves the establishment of the state higher education institution based on the conclusions of the institutions listed in paragraph 17 of this Order, it shall propose to the initiator of the establishment to prepare an application for the establishment. 20. The initiator of the establishment (hereinafter, the applicant) shall prepare and submit an application for the establishment for the consideration of the Centre. The application for the establishment shall consist of: 20.1. a draft strategic plan of the activity of the state higher education institution to be established, prepared in the order established by the Government of the Republic of Lithuania; 20.2. descriptions of study programmes, prepared in the order established by the Centre; 20.3. forwardness (lists of research fields, researchers who agree to work in the higher education institution to be established, description of the research activity of these researchers and the reasoning of the activity) for the planned research activity (if non-university studies are planned to be pursued – the applied research activity) of the state higher education institution; 20.4. a draft statute of the state higher education institution; 20.5. a plan for the use of the state property necessary for the planned activity; 20.6. in case when the state higher education institution is being established by means of reorganization: 20.6.1. conditions of reorganization of legal entities in accordance with the civil code of the Republic of Lithuania; 20.6.2. a summary of self-analysis of legal entities being reorganized; 20.6.3. a plan for the organization of further studies for students; 20.7. if the state college is being established on the joint proposal of the Ministry and a state university – a draft agreement on cooperation between both state higher education institutions. 21. After the receipt of the summary of the assessment prepared by the Centre, the applicant shall submit to the Ministry: 21.1. documents, indicated in paragraph 16 of this Order and corrected according to the remarks of all the institutions which have made an assessment; 21.2. a conclusion of the State Labour Inspection that the planned workplaces and implements of work correspond to the employees’ safety and health requirements; 21.3. if new buildings have been constructed or existing structures have been adjusted changing their purpose, - copies of acts recognizing the buildings exploitable prepared in the order established by the Ministry of Environment. 22. The Ministry, basing on the summary of the assessment prepared by the Centre, the conclusion of the appellate commission formed by the Ministry of Education and Science concerning the received appeal and the documents listed in paragraph 21 of this Order, makes a decision concerning the submission of a draft decree of the Government of the Republic of Lithuania on the establishment of the state higher education institution to the Government of the Republic of Lithuania. 23. Having made a reasoned decision not to submit a draft decree on the establishment of the state higher education institution to the Government of the Republic of Lithuania, the Ministry shall inform the applicants thereof. Application documents shall not be returned. 24. Having made a decision to submit a draft decree on the establishment of the state higher education institution to the Government of the Republic of Lithuania, the Ministry shall prepare and submit a draft on the establishment of the state higher education institution to the Government of the Republic of Lithuania not later that within 30 days from the day when the decision was taken. The draft shall include: 24.1. the proposal to the Government of the Republic of Lithuania; 24.2. a draft interim statute of the state higher education institution; 24.3. a draft decree of the Government of the Republic of Lithuania; if the state higher education institution is being established by means of reorganization, it shall be indicated in the draft how continuity of studies shall be organized; 24.4. if a state university is being established, - a draft resolution of the Seimas of the Republic of Lithuania; 24.5. reasoning for the need of state property and budgetary means of the Republic of Lithuania for the activity of the state higher education institution; 24.6. names of candidates to the constitutive council and the position of a pro tem rector (director); 24.7. the decision of the Ministry to propose a draft decree on the establishment of the state higher education institution to the Government of the Republic of Lithuania; 25. The Government of the Republic of Lithuania, having approved the draft on the establishment of the state higher education institution, shall pass a decree on the establishment of the state college or submit a draft resolution on the establishment of the state university to the Seimas of the Republic of Lithuania. 26. After the Seimas of the Republic of Lithuania or the Government of the Republic of Lithuania makes a decision to establish the state higher education institution, the Minister of Education and Science shall approve the constitutive council of the state higher education institution, designate a pro tem rector (director), approve an interim statute of the state higher education institution. 27. Having made a reasoned decision not to approve the establishment of the state higher education institution, the Government of the Republic of Lithuania charges the Ministry to inform the founders thereof. Application documents shall not be returned to the applicant. III. ISSUANCE OF LICENSES TO NON-STATE HIGHER EDUCATION INSTITUTIONS 28. The initiator of the establishment of a non-state higher education institution (hereinafter referred to as “the founder”) shall submit to the Ministry a written application in the Lithuanian language to receive the license for the non-state higher education institution to pursue studies. The application shall include: 28.1. a request to issue the license for the non-state higher education institution to pursue studies; 28.2. documents proving that founders have the necessary material basis to ensure the activity of the non-state higher education institution. Material basis must be substantiated not only by payments for studies paid by students, but by other financial resources comprising no less than 50 per cent of the planned budget; 28.3. a summary of self-analysis in the form established by the Centre made by the founder, if a new non-state higher education institution is being established by means of reorganization of the operating non-state higher education institution or another educational establishment; 28.4. a plan for the activity (business plan) of the non-state higher education institution being established in the form approved by the Ministry; 28.5. descriptions of study programmes planned to be pursued, prepared in the order established by the Centre; 28.6. forwardness (lists of research fields, researchers who agree to work in the higher education institution to be established, description of the research activity of these researchers and the reasoning of the activity) for the planned research activity (if non-university studies are planned to be pursued – the applied research activity) of the non-state higher education institution; 28.7. a draft statute of the non-state higher education institution; 28.8. reasoning concerning possibilities to organize studies during the first 4 years from the start of the activity; 28.9. a summary of documents listed in paragraphs 28.2-28.8 of this Order made by the Centre; 28.10. a conclusion of the State Labour Inspection that the planned workplaces and implements of work correspond to the employees’ safety and health requirements; 28.11. if new buildings have been constructed or existing structures have been adjusted changing their purpose for the activity of the non-state higher education institution which is being established, - copies of acts recognizing the buildings exploitable in the order established by the Ministry of Environment. 29. The Ministry, having analyzed the application and basing on the summary of the assessment prepared by the Centre, not later than within 30 days from the receipt of the documents indicated in paragraph 28 of this Order, shall make a decision to submit or not to submit a draft decree of the Government of the Republic of Lithuania on the approval of issuance of the license to the non-state higher education institution to pursue studies. 30. Having made a decision to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to the non-state higher education institution to pursue studies, the Ministry shall attach to this draft: 30.1. the proposal to the Government of the Republic of Lithuania; 30.2. the decision of the Ministry to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to the non-state higher education institution to pursue studies; 30.3. a summary of the assessment made by the Centre; 30.4. a draft statute of the non-state higher education institution. 31. Having made a reasoned decision not to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to the non-state higher education institution to pursue studies, the Ministry shall inform the founders thereof. Application documents shall not be returned. 32. After the Government of the Republic of Lithuania passes a decree on the approval of issuance of the license to the non-state higher education institution to pursue studies and the commission formed by the Minister of Education and Science confirms that all the conditions pointed out when passing the decree of the Government of the Republic of Lithuania referred to in this paragraph have been fulfilled, the non-state higher education institution shall be registered in the procedure established by legal acts and the Ministry shall issue to the registered non-state higher education institution the license of the established by the Ministry form and content to pursue studies. 33. Having made a reasoned decision not to approve the issuance of the license to pursue studies, the Government of the Republic of Lithuania shall charge the Ministry to inform the founders thereof. Application documents shall not be returned. IV. ISSUANCE OF LICENSES TO PURSUE STUDIES IN BRANCHES OF FOREIGN HIGHER EDUCATION INSTITUTIONS 34. A foreign higher education institution wishing to establish its branch in Lithuania (hereinafter referred to as “the founder of the branch”), shall submit a written application in the Lithuanian language to receive the license to pursue studies in the branch of the foreign higher education institution (or an application in the language of origin with translation certified in the order established by legal acts) to the Ministry. The application shall consist of: 34.1. a request to issue the license to pursue studies in the branch following study programmes of the founder of the branch; 34.2. description of the planned study programmes, prepared in the order established by the Centre, where the material basis and the teaching staff for the realization of the programme shall be doubly described: available by the founder of the branch and planned for Lithuania; 34.3. a certificate concerning the assessment and (
  2. or)accreditation of the founder of the branch or its study programme; 34.4. a reference letter of the regulatory authority in the foreign state supervising the quality of studies concerning the system of the quality supervision and the planned supervision of the quality of studies in the branch, schedule for the supervision and possibilities to involve Lithuanian representatives into the procedures of the quality supervision; 34.5. obligations of the founder of the branch: 34.5.1. to ensure (concrete instruments shall be indicated) that the quality of studies in the branch shall conform to the quality of studies of the founder of the branch; 34.5.2. to award the graduates of the branch diploma with supplements of the founder of the branch recognized by the foreign state, where information concerning the awarded qualification, duration and volume of the study programme shall be included; 34.6. a mediation letter of the state institution of the foreign state regulating the field of higher education; 34.7. a summary of the assessment of the application documents listed in paragraphs 34.2-34.6 of this Order; 34.8. a conclusion of the State Labour Inspection that the planned workplaces and implements of work correspond to the employees’ safety and health requirements; 34.9. if new buildings have been constructed or existing structures have been adjusted changing their purpose for the activity of the branch, - copies of acts recognizing the buildings exploitable in the procedure established by the Ministry of Environment. 34.10. a registration document of the founder of the branch and its copy certified in the order established by legal acts and draft regulations of the branch. 35. Not later than within 30 days from the receipt of all the documents pointed out in paragraph 34 of this Order, the Ministry shall make a decision to submit or not to submit a draft decree of the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies in the branch of the foreign higher education institution. 36. Having made a decision to submit a draft decree of the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies in the branch of the foreign higher education institution, the Ministry shall attach to the draft: 36.1. the proposal to the Government of the Republic of Lithuania; 36.2. the decision of the Ministry to submit a draft decree of the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies in the branch of the foreign higher education institution; 36.3. a summary of the assessment prepared by the Centre; 36.4. draft regulations of the branch; 37. Having made a reasoned decision not to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies in the branch of the foreign higher education institution, the Ministry shall inform the founders thereof. Application documents shall not be returned. 38. After the Government of the Republic of Lithuania passes a decree on the approval of issuance of the license to pursue studies in the branch of the foreign higher education institution and the commission formed by the Minister of Education and Science confirms that all the conditions pointed out when passing the decree of the Government of the Republic of Lithuania referred to in this paragraph have been fulfilled, the Ministry shall issue to the founder of the branch the license of the established by the Ministry form and content to pursue studies. 39. Having made a reasoned decision not to approve the issuance of the license to pursue studies in the branch of the foreign higher education institution, the Government of the Republic of Lithuania shall charge the Ministry to inform the founders thereof. Application documents shall not be returned. V. ISSUANCE OF LICENSES TO PURSUE STUDIES FOLLOWING STUDY PROGRAMMES OF HIGHER EDUCATION INSTITUTIONS OF OTHER STATES AND TO PURSUE OTHER ACTIVITIES RELATED TO STUDIES 40. Lithuanian higher education institutions and other legal entities wishing to pursue studies in Lithuania following study programmes of higher education institutions of other state and pursue other activities related to studies, shall submit a written application in the Lithuanian language to receive the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies (or an application in the language of origin with translation certified in the order established by legal acts) to the Ministry. The application shall consist of: 40.1. a request to issue the license to pursue studies following study programmes of the higher education institution (higher education institutions) of the other state (the other states) and to pursue other activities related to studies; 40.2. description of the planned study programmes, prepared in the order established by the Centre, where the material basis and the teaching staff for the realization of the programme shall be doubly described: available at the higher education institution study programmes of which are planned to be followed and those planned for Lithuania; 40.3. a certificate concerning the assessment and (
  3. or)accreditation of the higher education institution of the other state or its study programme; 40.4. a reference letter of the regulatory authority in the foreign state supervising the quality of studies concerning the system of the quality supervision and the planned supervision of the quality of studies in Lithuania, schedule for the supervision and possibilities to involve Lithuanian representatives into the procedures of the quality supervision; 40.5. authorization of the higher education institution, following study programmes of which studies in Lithuania are planned to be pursued, to pursue studies where obligations of the foreign higher education institution shall be pointed out: 40.5.1. to ensure (concrete instruments shall be indicated) that the quality of studies in Lithuania shall conform to the quality of studies of that foreign higher education institution; 40.5.2. to award the graduates from studies in Lithuania diploma with supplements of that foreign higher education institution recognized by that foreign state, where information concerning the awarded qualification, duration and volume of the study programme shall be included; 40.5.3. to notify about the expiration date of the authorization to pursue studies; 40.6. a mediation letter of the state institution of that foreign state regulating the field of higher education; 40.7. a summary of the assessment of the application documents listed in paragraphs 40.2-40.6 of this Order made by the Centre; 40.8. a conclusion of the State Labour Inspection that the planned workplaces and implements of work correspond to the employees’ safety and health requirements; 40.9. if new buildings for studies in the Lithuanian higher education institution or another legal entity have been constructed or existing structures have been adjusted changing their purpose, - copies of acts recognizing the buildings exploitable in the order established by the Ministry of Environment. 40.10. a registration document of the legal entity and its copy. 41. Foreign higher education institutions can pursue studies in Lithuania following their study programmes only by means of establishing their branches in the order established in chapter IV of this Order. 42. Not later than within 30 days from the receipt of all the documents listed in paragraph 40 of this Order, the Ministry shall make a decision to submit or not to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies. 43. Having made a decision to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies, the Ministry shall attach to the draft: 43.1. the proposal to the Government of the Republic of Lithuania; 43.2. the decision of the Ministry to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies; 43.3. a summary of the assessment prepared by the Centre. 44. Having made a reasoned decision not to submit a draft decree to the Government of the Republic of Lithuania on the approval of issuance of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies, the Ministry shall inform the founders thereof. Application documents shall not be returned. 45. After the Government of the Republic of Lithuania passes a decree on the approval of issuance of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies and the commission formed by the Minister of Education and Science confirms that all the conditions pointed out when passing the decree of the Government of the Republic of Lithuania referred to in this paragraph have been fulfilled, the Ministry shall issue to the Lithuanian higher education institution or another legal entity the license of the established by the Ministry form and content to pursue studies in Lithuania following study programmes of higher education institutions of other states and pursue other activities related to studies. 46. Having made a reasoned decision not to approve the issuance of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies, the Government of the Republic of Lithuania shall charge the Ministry to inform the founders thereof. Application documents shall not be returned. VI. SUPERVISION OF THE QUALITY OF THE ACTIVITY OF HIGHER EDUCATION INSTITUTIONS AND LICENSED STUDIES PURSUED IN THEM 47. The quality of the activity of state and non-state higher education institutions, except for studies pursued following study programmes of higher education institutions of other states, shall be assessed by the Centre in accordance with the schedule approved by the Ministry, basing on summaries of the self-analysis of these institutions and conclusions of experts. Overall qualifying assessment of the activity of the newly established higher education institution shall be made after 4 years from the start of its activity. 48. If the activity of the higher education institution is assessed negatively, the Minister of Education and Science may determine a period not exceeding 2 years to eliminate the defects. 49. If upon expiration of the determined period the state higher education institution is assessed negatively again, the Minister of Education and Science shall initiate reorganization or liquidation of the state higher education institution in the procedure established by legal acts. 50. On the proposal of the Ministry the Government of the Republic of Lithuania may revoke the validity of the license of the non-state higher education institution to pursue studies, if: 50.1. after expiration of the determined period the activity of the non-state higher education institution is repeatedly assessed negatively as not meeting the requirements established by this Order and other legal acts; 50.2. all the study programmes pursued in the higher education institution have not been accredited after the assessment; 50.3. the non-state higher education institution or its founder submits a request to revoke the license to pursue studies; 50.4. for more than 2 years since the issuance of the license to pursue studies the higher education institution does not exercise the activity determined in the license; 50.5. the non-state higher education institution is reorganized or liquidated. 51. On the proposal of the Ministry the Government of the Republic of Lithuania may make a decision to revoke the validity of the license to pursue studies following study programmes of higher education institutions of other states and to pursue other activities related to studies, if: 51.1. the period of authorization of the foreign higher education institution to pursue studies in Lithuania following study programmes of that institution expires, the foreign higher education institution revokes the authorization, the authorized legal entity refuses the authorization, the foreign higher education institution or the authorized legal entity stops functioning, or a bankruptcy suit is entered against the authorized legal entity; 51.2. the institution pursuing studies submits a request to revoke the license to pursue studies; 51.3. the institution of the other state dispensing supervision of the quality of studies does not dispenses supervision of the quality of studies in Lithuania; 51.4. for more than 2 years since the issuance of the license to pursue studies the institution does not exercise the activity determined in the license; 51.5. it turns out that the license has been received submitting false data, spurious documents or concealing some facts, because of which the license could not be issued. 51.6. the institution pursuing studies or its activity does not meet the requirements established in this Order or other legal acts. 52. Lithuanian higher education institutions and other legal entities pursuing studies following programmes of higher education institution of other states and involved in other activities related to studies, on the time set by the Ministry must submit to it: 52.1. lists of the pursued study programmes and the information concerning other activities related to studies; 52.2. information concerning the validity of the authorization to pursue studies; 52.3. lists of teachers and copies of working permits for foreign teachers in the Republic of Lithuania, concrete measures for the assessment of teachers’ professional qualifications; 52.4. student admission rules; 52.5. lists of newly admitted, studying and expelled students, persons who have acquired higher education; 52.6. information concerning awarded qualifications, issued higher education certificates, their supplements; 52.7. other data required by the Ministry. 53. The Ministry shall have the right to require the information indicated in paragraph 52 of this Order form non-state higher education institutions. 54. Information concerning regulations of the entity pursuing studies, its governing structure, teaching basis, study programmes, aims of teaching services, tasks and the content, international programmes and projects must be available to public. 55. After receiving the information described in paragraphs 52 and 54 of this Order, the Ministry shall control if the higher education institution or another legal entity is pursuing studies following study programmes of higher education institutions of other states and is pursuing other activities related to studies observing conditions of the license issued for it. Basing of the information received, the Ministry shall be entitled to initiate revocation of the license to pursue studies following study programmes of higher education institutions of other states and pursue other activities related to studies. VII. FINAL PROVISIONS 56. After the Seimas of the Republic of Lithuania, the Government of the Republic of Lithuania or the Ministry does not approve the establishment of the higher education institution or the issuance of the license to pursue studies, the applicant can repeatedly submit application documents for the assessment not earlier that one year after the negative decision concerning the establishment of the state higher education institution or the issuance of the license was made.
